UFC 1-300-08 provides comprehensive guidance on the documentation of real property acceptance throughout the DoD by identifying the use of a draft, interim, and final version of the DD 1354, Transfer and Acceptance of DoD Real Property. It also describes how the DD 1354 is used as part of a real property business process and defines the roles and responsibilities in the DD 1354 process. Though the DD 1354 is the basic source document, it typically does not stand-alone. |

Appropriation
A provision of legal authority by an act of the Congress that permits Federal agencies to incur obligations and to make payments out of the Treasury for specified purposes. An appropriation usually follows enactment of authorizing legislation. An appropriation act is the most common means of providing budget authority. Appropriations do not represent cash actually set aside in the Treasury for purposes specified in the appropriation act; they represent limitations of amounts which agencies may obligate during the time period specified in the respective appropriation acts. [Reference: DoD 7000.14-R Volume 2A “Financial Management Regulation (FMR)]
(Annual) - An annual appropriation has a period of availability for one fiscal year. An example of an annual appropriation is Operation and Maintenance, Army, 21X2020. [Reference: DOD 7000.14-R FMR, Vol 12, Ch 1]

Audit Readiness
| (Fiscal Context) - Each DOD reporting entity has the capabilities in place to allow an auditor to scope and perform a full financial statement audit that results in actionable feedback. Actionable feedback from auditors forms the cornerstone of DOD’s audit strategy—remediating auditor findings is the most certain and cost-effective path to achieving a clean opinion. DOD audits bring light to issues that cut across federal agencies and could impede the ability to audit the U.S. Government’s Consolidated Financial Statements, such as the methods used to reconcile financial transactions between federal agencies. | Authority Having Jurisdiction (AHJ) |
DODI 6055.06 (2006) defines the AHJ as "The organization, office, or individual responsible, designated by the DOD Component for approving equipment, materials, and procedures for DOD Component fire departments. "UFC 1-200-01 defines the terms “Building Official” and “Authority Having Jurisdiction” (AHJ) as used in the codes and standards referenced in this UFC means the component office of responsibility, i.e., U.S. Army, HQ USACE/CECW-CE; U.S. Navy, NAVFACENGCOM HQ Code CHE; U.S. Marine Corps, HQMC Code LFF-1; and U.S. Air Force, \1\ AFCEC /1/. The enforcement of the codes and standards as they pertain to facility projects can be delegated to the local Components Office’s Chief Engineer’s Technical Representative at the discretion of the components aforementioned office." AF IDBIO Context: the role of the Authority Having Jurisdiction (AHJ) is designated to HQ USAF/A4C (reference AFI 32-2001). For this program we recognize the Base File Marshall as the AHJ as long as they meet the requirements outlined in the DODI, UFC and AFI above.

Beneficial Occupancy Date (BOD)
The date the customer can expect to receive useful occupancy of the facility or construction work. Although all construction efforts at the construction site may not be completed (for example, punch-list items and other minor construction activities may still be required for construction to be considered complete), and DCA may need to continue administering the final stages of the project construction contract until such completion, the user may begin to occupy all or agreed upon parts of the facility and use it for its intended purpose. The user may initiate follow-on contracts such as furniture or IT roll-outs after this date in order to complete the fit-out of the facility. This milestone is typically synonymous with substantial completion, i.e. facility can be used for its intended purpose. Liquidated damages end.
Government has the right to occupy a building prior to final acceptance. It requires the Contracting Officer to notify the contractor, in writing when that occupancy occurs. The Government assumes all risk when occupying the premises early with the exception of latent defects or fraud. If alterations, repairs or changes to the facility or equipment occur prior final acceptance, both parties’ rights under the contract clauses for warranty and inspection may be altered.

Bona Fide Need
[Rule] - The “bona fide needs rule” is a fundamental rule of appropriations law. It mandates that a fiscal year’s appropriations be obligated only to meet a legitimate need existing in the fiscal year for which the appropriation was made. It restricts this year’s appropriated funds from being used to fund next fiscal year’s requirement. Refer to DOD FMR, Vol. 3, Ch. 8, for detailed guidance regarding bona fide need. Applications of the bona fide need rule include delivery or production lead time, stock level, non-severable and severable services, maintenance, repair, and construction. (Reference: AFI 65-601; DFAS-DE 7000.4-R, Chapter 2, and GAO, Principles of Federal Appropriations Law, Volume 1, Chapter 5, for more information concerning the bona fide need rule).”
