About this file

This document is an Appendix D Statement of Qualifications, Conflicts, and Technical Questionnaire for legal services to support the Underground Storage Tank Indemnification Fund (USTIF), administered by the Pennsylvania Insurance Department's Office of Liquidations, Rehabilitations and Special Funds. The Commonwealth seeks outside counsel to provide coverage opinions, legal support, and representation of the USTIF and Tank Installers Indemnification Program in defending claims, managing third-party liability matters for property damage and bodily injury, handling subrogation claims, and performing other general work as designated by the Chief Counsel and Governor's Office of General Counsel. The solicitation will result in a limited multiple award to the highest evaluated law firms based on established evaluation criteria.

Responding law firms must demonstrate substantial qualifications in environmental law, administrative proceedings, and litigation, with specific expertise in Underground Storage Tank Fund claims, the Storage Tank and Spill Prevention Act, Clean Streams Law, and federal RCRA regulations. Applicants must provide detailed information regarding attorney qualifications and Pennsylvania Supreme Court admission, years of relevant experience, office locations in Pennsylvania, litigation history within the past five to seven years, and division of duties among personnel. All firms must acknowledge compliance with the Office of General Counsel's Conflict Waiver Policy, fully disclose any existing or potential conflicts of interest including adverse representation to the Commonwealth, and represent that no conflicting representations exist without General Counsel waiver. The document requires written acknowledgment that the law firm will perform services according to the Standard Contract for Legal Services.
