About this file
This is a Technical Questionnaire and Statement of Qualifications document issued by the Pennsylvania Department of Military and Veterans Affairs (DMVA) through the Governor's Office of General Counsel (OGC) for legal services relating to estate recovery matters. The RFP seeks law firms to provide litigation and real estate services specific to DMVA State Veterans' Homes estate recovery efforts. Interested law firms must respond to detailed qualification requirements, including confirmation that all team members are admitted to practice before the Pennsylvania Supreme Court, documentation of federal court authorizations, and descriptions of each attorney's background in litigation and real estate services. The questionnaire requires firms to demonstrate their experience as litigation counsel for governmental entities, specifically detailing the number of litigation and real estate matters handled in the previous three years, with particular emphasis on matters related to State Veterans' Homes estate recovery efforts during that same period.
The questionnaire mandates extensive disclosures regarding conflicts of interest, professional liability, and compliance with OGC's Conflict Waiver Policy, with failure to disclose conflicts serving as grounds for proposal rejection or removal from engagement. Law firms must provide acknowledgment of compliance with the Standard Contract for Legal Services terms, maintain professional liability insurance in amounts customary for their size and practice area, and disclose any litigation or administrative proceedings involving assigned team members within the preceding five years. Additionally, the document requires detailed descriptions of the firm's use of artificial intelligence or automated technologies in legal service delivery, including identification of specific tools, data security measures, and verification procedures to ensure Commonwealth data is not used to develop proprietary AI tools or models.
