About this file
This is an Electronic Transaction Fee Appendix document for the Maryland Department of General Services (DGS) applicable to all DGS-controlled procurements, including Statewide and Agency-Specific Contracts. The document outlines the fee structure and payment requirements for contractors operating under state contracts. The electronic transaction fee is calculated as one percent (1%) of the total invoiced amount for all sales made under the contract during each reporting period, with the fee due no later than forty-five (45) calendar days after the end of each reporting period. The contractor must calculate the fee on the gross invoice amount minus any returns or credits and is prohibited from charging the electronic transaction fee separately to customers or identifying it as a line item or surcharge on invoices; instead, the fee must be incorporated into the contract's unit prices.
Contractors may remit the electronic transaction fee via ACH transfer to the Comptroller's office using the designated ACH form with notation in the comments section indicating the payment is for "DGS 1% Fee," or by check to the Department of General Services, Fiscal Services Division at the Baltimore office. Simultaneously with payment, contractors must submit a Monthly Usage Report in Microsoft Excel format documenting all contract sales to the designated email address using the required template. Failure to timely and accurately remit the electronic transaction fees constitutes a material default under the contract, with enforcement provisions available to the State. This requirement became effective as of January 2026.
