About this file

Amendment No. One is a document related to the South Carolina Department of Public Health's (DPH) Invitation for Bid (IFB) #5400027973 for hazardous waste disposal services. The amendment modifies the original solicitation by extending the bid submission deadline from 4/22/2025 to 5/13/2025 at 2:30 PM ET and shifting the award date from 5/5/2025 to 5/30/2025. The scope of work has been expanded to include universal and e-scrap waste disposal in addition to chemical hazardous waste. The contract will cover packing, labeling, manifesting, transportation, and disposal of hazardous waste generated statewide by DPH facilities, with disposal methods including recycling, incineration, chemical inactivation/stabilization, and other approved technologies.

The amendment includes responses to 36 vendor questions that provide additional clarity on the procurement, such as waste characterization, container requirements, scheduling, and pricing expectations. The solicitation requires vendors to provide comprehensive pricing for various container sizes and waste streams, with pricing to be submitted per pound. The current incumbent is Tradebe Environmental Services LLC. Vendors must be prepared to handle various waste types, including solvents, caustic wastes, acutely toxic materials, and calibration gases, while adhering to local, state, and federal hazardous waste regulations. The document emphasizes that waste quantities are estimates, and actual costs will depend on specific waste generation, with an expectation that vendors will price flexibly to accommodate varying waste volumes across different DPH locations.

Change to:

To establish a source for services necessary for the packing, required labeling, manifesting, transportation and disposal of chemical hazardous waste and universal waste generated statewide by the South Carolina Department of Public Health (DPH) on an as-needed basis, in accordance with all local, state, and federal hazardous waste laws and regulations. These services shall include all necessary personnel, labor, transportation, packaging, detailed chemical analyses (if required for disposal) materials, equipment and reports. The methods for disposal include (a) recycling; (b) incineration; (c) chemical inactivation/stabilization; and (d) other best available technologies as deemed necessary by law. The contractor will give preference to incineration when this is the most appropriate disposal method. DPH will not be held liable for additional costs not stated on the bidding schedule.

The following prospective offeror questions and agency responses are hereby incorporated into the solicitation:

Question 1:

Are there preferred disposal methods or treatment technologies the department prioritizes over others?

State’s Response:

Per the solicitation’s scope of work, “The methods for disposal include (a) recycling; (b) incineration; (c) chemical inactivation/stabilization; and (d) other best available technologies as deemed necessary by law. The contractor will give preference to incineration when this is the most appropriate disposal method.”

Question 2:

Is there any available data regarding historical waste volumes collected from county health departments statewide to assist in pricing calculations? May you provide info for the previous incumbent?

State’s Response:

All county health departments are very small quantity generators. With rare exception, waste pick-ups from county health departments are sporadic and may only occur every few years per site. These pick-ups can be accommodated with a standard pick-up truck and several 5 and 15 gallon overpacks. Historically, these pick-ups are $500 to $1500 for services and cost for disposal.

Question 3:

Could you confirm if there are specific container types or labeling requirements that differ from standard DOT guidelines?

State’s Response:

All of our wastes are either already stored in DOT compliant containers or are overpacked as a laboratory pack by the vendor at the time of pick-up into DOT compliant containers. All items will meet standard DOT requirements.

Question 4:

What is the best way to schedule a site visit?

State’s Response:

A site visit was not offered for this solicitation.

Question 5:

Who is the current or past vendor / incumbent?

State’s Response:

The current incumbent is Tradebe Environmental Services LLC.

Question 6:

Please confirm the address to be mentioned on the certificate of insurance.

State’s Response:

No specific clause or reference to this statement was found in the solicitation to provide a response to this question.

Question 7:

Can we have the copy of the current contract?

State’s Response:

The current contract #4400024394 can be found by clicking on this link, https://apps.sceis.sc.gov/SCContractWeb/contractDetail.do?solicitNumber=5400019919&contractNumber=4400024394.

Question 8:

Is prevailing wage included in this contract?

State’s Response:

Please see attachment A – Schedule C to labor charges.

Question 9:

What is the Annual spent / last 3 invoices and manifests?

State’s Response:

Generally, pick-ups from the Hayne Building are regularly scheduled between 2-3 months apart. These pick-ups range from $7,000 - 12,000 per pick up depending on the wastes included at the time. County Health Department pick-ups are sporadic and uncommon, with only five to eight per year at around $500 to $1500 each. High-hazard pick-ups are not planned but are included in the contract for speed of purchasing should they occur. In the past high-hazard pick-ups are $6,000 - $10,000 per incident.

https://apps.sceis.sc.gov/SCContractWeb/contractDetail.do?solicitNumber=5400019919&contractNumber=4400024394

Question 10:

What is the budgetary number for the waste removal and disposal service in 2024?

State’s Response:

Please see the response to question 9. Budgeted amounts are flexible and based on need.

Question 11:

Is liquidated damages applicable to this bid ? If yes, please specify the details.

State’s Response:

No specific clause or reference to this statement was found in the solicitation to provide a response to this question.

Question 12:

Does vendor need any special equipment to make these pickups, any limitations of the loading dock area?

State’s Response:

Yes, the vendor should assume responsibility for any carts, dollies, lift equipment needed to transport and maneuver drums.

While our main location and several health departments have loading docks, the vendor should have transport with a lift-gate.

Question 13:

Confirm if given waste is packaged or you want us to pack the waste.

State’s Response:

The majority of these wastes will need to be placed in consolidated laboratory packing prior to transport. Very few of our wastes are voluminous enough to necessitate their own drum.

Question 14:

Do any of the locations listed in Attachment A currently have existing waste profiles established?

State’s Response:

Only the Hayne Building located at 8231 Parklane Road has existing waste profiles established, however; these change and are created and modified frequently.

Question 15:

Is there any preference or requirement for waste transportation scheduling (e.g., frequency, specific days)?

State’s Response:

It is the expectation that waste pick-up will be on-demand only. Pick-ups for the Hayne Building are generally every 2-3 months. Health Departments are generally every other year. There is the understanding that “on-demand” pick-ups must fit an agreeable date and time for the vendor and location and that this be reasonably prompt upon request.

Question 16:

Do you have an estimate of the average pounds per drum typically generated at these locations?

State’s Response:

No because the number and variety of wastes is too dynamic for this estimate to be meaningful. Drums range in size from 5-55 gallons and may be a mostly empty lab-pack or may be a full drum.

Question 17:

Can Attachment A (Schedule E) be modified to itemize any applicable fees—such as fuel surcharges—or to distinguish between transportation and disposal costs?

State’s Response:

No, It is the intent of the schedule A and Schedule B to account for these extra fees.

Question 18:

Can we get some examples of Acutely Toxic Wastes? (Pg 1 #4) State’s Response:

We have several RCRA P-coded chemicals on inventory in small amounts. These include, and are not limited to, sodium azide, sodium cyanide, and several small vials of control materials for pure pesticides, herbicides, and insecticides.

Question 19:

Can we also get some examples of High Hazard Chemical Stabilization and Removal? (Pg 2 #10)?

State’s Response:

While these events are rare, our laboratory has tetrahydrofuran and ethyl ether in stock. Our most likely high-hazard removal would be one of these peroxide forming chemicals that has sat for too long and may be shock sensitive.

Question 20:

Can we get a list of disposal chemicals ahead of time?

State’s Response:

An inventory of items for disposal will be sent prior to each pick-up. One will not be shared for this bid as the variety and quantity chemicals needing disposal is not static and varies widely.

Question 21:

What types of equipment and containers will the contractor be responsible for providing? While it's specified that containers need to meet local, state, and federal standards, more clarity on which exact containers are required for each type of waste (e.g., 55-gallon drums, specialized containers for mercury or cyanide) would be helpful. I couldn’t find this detail.

State’s Response:

Please see the answer to question 12. The contractor will be responsible for providing all DOT labels and manifesting papers, personal protective equipment for their staff, spill control supplies on-route, and materials for placarding vehicles.

Containers shall meet DOT requirements for the materials they contain. See section 3.3 for a list of container sizes and types. Should an unusual situation occur where the use of more specialized containers be required, the contract for the successful bidder can be modified as needed.

Question 22:

How will the DPH handle the pricing adjustments if hazardous waste quantities exceed or fall short of the estimated quantities? The RFP specifies that the quantities provided are estimates and that the total contract cost will depend on the actual needs. How should contractors factor this into their pricing structure?

State’s Response:

The estimated quantities provided are not a guarantee to purchase a specific amount but are provided for bidders to evaluate their capacity to provide the service. This is why pricing per pound is suggested for your entries in schedule E.

Question 23:

Is the contractor required to maintain waste manifests for all waste transferred, and is there a specific format required by the State of South Carolina for these records? The RFP requires waste manifests but doesn't specify the detailed format or additional compliance documents needed during the disposal process.

State’s Response:

Yes, the contractor is expected to be familiar with the documentation and record retention requirements needed to meet the state and federal regulations for both the DOT and EPA. Formatting is flexible as long as these requirements are met.

Question 24:

The RFP says “This contract will cover hazardous waste streams including but not limited to: 8. Chemicals and laboratory sample residues” - in III. SCOPE OF WORK. Will DPH be able to provide enough information about these sample residues for the Contractor to accurately classify the waste according to EPA and DOT requirements?

State’s Response:

Yes, of course. Our processes are clearly defined and mixtures well characterized prior to offering wastes to our vendor for disposal.

Question 25:

The RFP says “This contract will cover hazardous waste streams including but not limited to: 9. Pressurized gas cylinders containing VOC standards” - in III. SCOPE OF WORK. Are these cylinders considered “calibration gases” which are used for the calibration of analytical instruments or hand-held devices?

State’s Response:

Yes, these are calibration gases. Some are used for analytical instruments and others for handheld devices.

Question 26:

The RFP says “This contract will cover hazardous waste streams including but not limited to: 10. High hazard chemical stabilization and removal” - in III. SCOPE OF WORK. Based on the current inventory of chemicals at the DPH facilities, can you please provide some examples of the types of “high hazard” chemicals that might be encountered?

State’s Response:

Please see the response to question 19.

Question 27:

The RFP at 3.2.4.4 says that “Contractor shall conduct any chemical analyses and characterizations of the waste that are needed to allow proper classification.”

a. Will field testing (also known as “HazCat Testing”) be considered sufficient for any “lab Quantity” unknown chemicals (less than 5-gallon containers)?

b. Will DPH provide the Contractor with a list of all bulk waste streams (containers >5 gallons) currently being disposed of?

State’s Response:

Two parts: 1.) Yes. This occurrence would be very rare. 2.) No. Assume that a bulk waste stream exists for all wastes described in schedule E unless otherwise “omitted.”

Question 28:

The RFP at 3.2.10 says that “Contractor shall dispose of hazardous waste by a method that will leave no future expense potential to the State of South Carolina.” Seeing that the ‘cradle to grave” responsibility under CERCLA rests solely with the generator of the waste, will DPH be satisfied that the wastes will be managed such that future expense potential to the State of South Carolina are MINIMIZED? The most favorable waste treatment for the reduction of liability is incineration. Does DPH require that all hazardous waste be incinerated?

State’s Response:

Two parts. 1) Yes. It is the intent that the “cost” for disposal be invoiced once. Waste treatment and management consistent with state and federal regulation is the responsibility of the vendor and will be considered sufficient to minimize this risk to DPH. 2.) No, incineration is only preferred when this is the most appropriate disposal method.

Question 29:

The RFP at 3.2.13 requires the “Contractor shall complete and furnish to the DPH site contact a State of South Carolina manifest, listing all waste picked up.” Can DPH provide the contractor with an example of the form which will provide the information required by DPH?

State’s Response:

The copy of the EPA compliant manifest used by the vendor for each pick-up is sufficient to meet this need. Formats may have some variability but must meet all state and federal requirements.

Question 30:

The RFP at 3.2.14 requires that “A hazardous waste manifest is required for the removal from all DPH sites of all items pertaining to this contract.” Does DPH require that all non-EPA regulated wastes be incinerated in order to meet this provision of the RFP?

State’s Response:

No, this is not a DPH requirement.

Question 31:

General note - 3.4.5.3. If pricing is conducted by weight, please put the price per pound in the across all drum sizes (Ex.

“$10 / lb”) - Does this allow for minimum pricing for drums, which are charged by many disposal facilities?

State’s Response:

No, it does not, however; DPH does not wish to waste resources nor contribute unnecessarily to waste generation. It is rare to have an empty or nearly empty drum. Should a successful bidder feel that we are taking advantage of this, we can modify the contract in the future.

Question 32:

We are requesting copies of the previous Hazardous and Non-Hazardous Manifest for the past 3 years for the Department of Public Health.

State’s Response:

No, this will not be provided.

Question 33:

Will there be any Radioactive/Chemo Waste for any of your facilities? If so how much and what type of waste can be expected for Disposal?

State’s Response:

Our facility does have a radiochemistry laboratory, however; all radioactive wastes are strictly separated and are managed under a separate contract. None of these materials will be offered to this vendor on this contract.

Question 34:

Will there be any Biological Waste that needs to be disposed of at any of your facilities? If so what type and how much?

State’s Response:

Our facility does generate infectious wastes, however; we are registered to treat most infectious wastes on-site. Infectious materials not treated on-site (like tissues and sharps) are handled by another vendor. In the rare circumstance that a mixed waste is encountered, all infectious materials will be inactivated and destroyed prior to offering for chemical waste disposal.

This would be very unusual, and we would reach out to our vendor prior to offering to ensure both parties are comfortable.

Question 35:

The Scope of Work does not list any type of Universal or E-Scrap Waste for disposal by the contactor, under the list of supplies to be provided by the contractor it states 4 Ft and 8 Ft lightbulb Boxes along with Cubic Yard Boxes. Will the contractor be required to dispose of Universal and E-Scrap Waste? If so can it be added to the Scope of Work listing the different types of Universal and E-Scrap waste the contractor will be required to dispose of?

State’s Response:

Yes, refer to Changes to Original Solicitation, III. Scope of Work/Specifications Changes, in Amendment No. One.

Question 36:

The Scope of Work list different types of containers the Contractor must provide, under the Pricing section it only list one line item for pricing. Is the Department of Public Health requesting one price for all the containers the contractor must provide? If not can the Department of Public Health add additional pricing sections for each container requested?

State’s Response:

Please see schedule D of Attachment A for bidding container prices.
