About this file

This is Amendment 1 to a Best Value Bid solicitation issued by the State of South Carolina's Division of Procurement Services on behalf of Midlands Technical College for snack and beverage vending services. The solicitation requires two separate awards: one for exclusive beverage vending services and one for exclusive snack vending services across all campuses. A pre-proposal conference is scheduled for August 29, 2024, at 10:30 AM ET via Microsoft Teams, with access code requests due by August 28, 2024, at 10:00 AM ET. Questions from offerors must be received by September 4, 2024, at 11:00 AM ET. Offers are due online by October 3, 2024, at 11:00 AM ET. Award notification is scheduled for November 12, 2024. Offerors must submit one original electronic technical copy, one redacted electronic technical copy, one original electronic price copy, and one electronic price copy marked as copy.

For the exclusive beverage vending contract, bidders must offer a minimum commission rate of 48% on estimated gross sales of $69,000 (based on sales from July 1, 2023, through June 30, 2024) or a minimum guaranteed commission of $45,000, plus a support fee, with the total being the greater of the commission or guarantee plus the support fee. For the exclusive snack vending contract, bidders must offer a minimum commission rate of 20% on estimated gross sales of $93,000 or a minimum guaranteed commission of $30,000, plus a support fee. The current mechanical rate adjustment is $2.25 per beverage and will be accepted. The incumbent beverage provider is Pepsi Bottling Group with exclusive access to Sweet Aromas outlets on Airport and Beltline Campuses; the awarded beverage contractor will also gain this exclusivity. The incumbent snack provider is Canteen Vending Company/Campus Group. The amendment clarifies that the $20,000 minimum support fee is separate from the overall minimum thresholds and confirms that vendors not meeting Best Value Bid requirements will be deemed non-responsive.

QUESTIONS FROM OFFERORS - AMENDMENT (JUN 2017)

THE SOLICITATION IS AMENDED AS PROVIDED HEREIN. INFORMATION OR CHANGES RESULTING FROM QUESTIONS WILL BE SHOWN IN A QUESTION-AND-ANSWER FORMAT. ALL QUESTIONS RECEIVED HAVE BEEN REPRINTED BELOW. THE “STATE’S RESPONSE” SHOULD BE READ WITHOUT REFERENCE TO THE QUESTIONS. THE QUESTIONS ARE INCLUDED SOLELY TO PROVIDE A CROSS-REFERENCE TO THE POTENTIAL OFFEROR THAT SUBMITTED THE QUESTION. QUESTIONS DO NOT FORM A PART OF THE CONTRACT; THE “STATE’S RESPONSE” DOES. ANY RESTATEMENT OF PART OR ALL OF AN EXISTING PROVISION OF THE SOLICITATION IN AN ANSWER DOES NOT MODIFY THE ORIGINAL PROVISION EXCEPT AS FOLLOWS: UNDERLINED TEXT IS ADDED TO THE ORIGINAL PROVISON. STRICKEN TEXT IS DELETED. [02-2A097-1]

1. Mech Rate $1.75 per most beverages. This mech rate was scheduled to go up in 2020. Then came Covid and the rate did not change. Current mech rate is $2.25. Is this adjustment going to be allowed?

State’s Response: Yes, current mech rate will be accepted

1. Support Fund. Will there be language in contract around a un for seen situation such as Covid to prevent the machines to have the opportunity to have sales of the machines.

State’s Response: No, however if such situation occurs, the College will access on a case-by-case basis.

1. Does the beverage provider awarded the beverage vending also gain exclusive access to the bookstore outlets that are self-operated by Midlands Technical College?

State’s Response: In section I. Scope of Solicitation, it states:

Currently, Pepsi Bottling Group operates the exclusive beverage vending contract on all campuses to include exclusivity with Sweet Aromas on Airport and Beltline Campuses. The awarded beverage Contractor from this solicitation will also gain exclusivity with Sweet Aromas. As for the snack services, Canteen Vending Company/Campus Group operates exclusive snack vending services on all campuses.

1. Could you please provide the detailed breakdown of sales for the bookstores?

State’s Response: This information will not be provided as the commission reported does not include bookstore sales; it includes the sales from vending only. The College bookstores are currently self-operated. The College bookstore currently purchases directly from the current provider.

1. Will the RFP proposed response be considered responsive if the offer is in line with total financial expectations even if one specific element is not met? (Example: Commission percentage not met, but guaranteed payment meets minimum)

State’s Response: Vendors not complying with requirements of the BVB will be deemed non-responsive.

1. Does the $20,000 minimum support fee part of the overall $45,000 minimum or separate?

State’s Response: No, it is not included

1. In the “Calculating the low bid” section, the beverage commission calculations is based off of $93,000, however the average beverage sales listed on “attachment 1” is $71,501. Should we use $75,000 to calculate our totals?

State’s Response: This is an example however the estimated sales are modified to read estimated sales for the period of 7/1/2023 – 6/30/2024

CALCULATING THE LOW BID

Two (2) awards will be required, one (1) for the Beverage Vending Service provider and one (1) for the Snack Vending Service provider.

The following formula will be used in determining the price score of each offer which includes your total commission and support fee.

For the Exclusive Beverage Contract, multiply the commission percent by the estimated gross sales ($69,000) to determine commission amount. (Estimated sales are from 7/1/2023 – 6/30/2024) Add either commission amount or minimum guarantee (whichever is greater) to the support fee in order to determine the total annual commission and support fee.

The College will accept different commission rates on products provided commission rates meet the minimum of 48%. If the rates are different the higher of the two rates will be used to calculate your total commission.

A. ____________% commission percentage x $69,000 $___________ B. $_________ Support fee offered C. $_________ Total Commission and Support Fee

OR

A . $45,000 minimum guaranteed commission B. $_________ Support fee offered C. $_________ Total Commission and Support Fee

For the Exclusive Snack Vending Contract, multiply the commission percent by estimated gross sales ($93,000) to determine the total annual commission and support fee. (Estimated sales from 7/1/2023 – 6/30/2024) Add either commission amount or minimum guarantee (whichever is greater) to the support fee in order to determine the total annual commission and support fee.

The College will accept different commission rates on products provided commission rates meet the minimum of 20%. If the rates are different the higher of the two rates will be used to calculate your total commission.

A. __________% commission percentage x $93,000= $___________ B. $_________ Support fee offered C. $_________ Total Commission and Support Fee

OR

A . $30,000 minimum guaranteed commission B. $_________ Support fee offered C. $_________ Total Commission and Support Fee
