52.204-11 American Recovery and Reinvestment Act—Reporting Requirements. (JUL 2010)

(a) Definitions. For definitions related to this clause (e.g., contract, first-tier subcontract, total compensation etc.) see the

Frequently Asked Questions (FAQs) available at http://www.whitehouse.gov/omb/recovery_faqs_contractors. These FAQs are also linked under http://www.FederalReporting.gov.

(b) This contract requires the contractor to provide products and/or services that are funded under the American

Recovery and Reinvestment Act of 2009 (Recovery Act). Section 1512(c) of the Recovery Act requires each contractor to report on its use of Recovery Act funds under this contract. These reports will be made available to the public.

(c) Reports from the Contractor for all work funded, in whole or in part, by the Recovery Act, are due no later than the

10th day following the end of each calendar quarter. The Contractor shall review the Frequently Asked Questions (FAQs) for Federal Contractors before each reporting cycle and prior to submitting each quarterly report as the FAQs may be updated from time-to-time. The first report is due no later than the 10th day after the end of the calendar quarter in which the Contractor received the award. Thereafter, reports shall be submitted no later than the 10th day after the end of each calendar quarter. For information on when the Contractor shall submit its final report, see http://www.whitehouse.gov/omb/recovery_faqs_contractors.

(d) The Contractor shall report the following information, using the online reporting tool available at www.FederalReporting.gov.

(1) The Government contract and order number, as applicable.

(2) The amount of Recovery Act funds invoiced by the contractor for the reporting period. A cumulative amount from all the reports submitted for this action will be maintained by the government’s on-line reporting tool.

(3) A list of all significant services performed or supplies delivered, including construction, for which the contractor invoiced in this calendar quarter.

(4) Program or project title, if any.

(5) A description of the overall purpose and expected outcomes or results of the contract, including significant deliverables and, if appropriate, associated units of measure.

(6) An assessment of the contractor’s progress towards the completion of the overall purpose and expected outcomes or results of the contract (i.e., not started, less than 50 percent completed, completed 50 percent or more, or fully completed). This covers the contract (or portion thereof) funded by the Recovery Act.

(7) A narrative description of the employment impact of work funded by the Recovery Act. This narrative should be cumulative for each calendar quarter and address the impact on the Contractor’s and first-tier subcontractors’ workforce for all first-tier subcontracts valued at $25,000 or more. At a minimum, the Contractor shall provide—

(i) A brief description of the types of jobs created and jobs retained in the United States and outlying areas (see definition in FAR 2.101). This description may rely on job titles, broader labor categories, or the Contractor’s existing practice for describing jobs as long as the terms used are widely understood and describe the general nature of the work;

and

(ii) An estimate of the number of jobs created and jobs retained by the prime Contractor and all first-tier subcontracts valued at $25,000 or more, in the United States and outlying areas. A job cannot be reported as both created and retained. See an example of how to calculate the number of jobs at http://www.whitehouse.gov/omb/recorery_faqs_contractors.

(8) Names and total compensation of each of the five most highly compensated officers of the Contractor for the calendar year in which the contract is awarded if—

(i) In the Contractor’s preceding fiscal year, the Contractor received—

(A) 80 percent or more of its annual gross revenues from Federal contracts (and subcontracts), loans, grants

(and subgrants) and cooperative agreements; and

(B) $25,000,000 or more in annual gross revenues from Federal contracts (and subcontracts), loans, grants (and subgrants) and cooperative agreements; and

(ii) The public does not have access to information about the compensation of the senior executives through periodic reports filed under section 13(a) or 15(d) of the Securities Exchange Act of 1934 (15 U.S.C. 78m(a), 78o(d)) or section 6104 of the Internal Revenue Code of 1986.

(9) For subcontracts valued at less than $25,000 or any subcontracts awarded to an individual, or subcontracts awarded to a subcontractor that in the previous tax year had gross income under $300,000, the Contractor shall only report the aggregate number of such first tier subcontracts awarded in the quarter and their aggregate total dollar amount.

(10) For any first-tier subcontract funded in whole or in part under the Recovery Act, that is valued at $25,000 or more and not subject to reporting under paragraph 9, the contractor shall require the subcontractor to provide the information described in paragraphs (d)(1)(i), (ix), (x), (xi), and (xii) of this section to the Contractor for the purposes of the quarterly report. The Contractor shall advise the subcontractor that the information will be made available to the public as required by section 1512 of the Recovery Act. The Contractor shall provide detailed information on these first-tier subcontracts as follows:

(i) Unique identifier (DUNS Number) for the subcontractor receiving the award and for the subcontractor’s parent company, if the subcontractor has a parent company.

(ii) Name of the subcontractor.

(iii) Amount of the subcontract award.

(iv) Date of the subcontract award.

(v) The applicable North American Industry Classification System (NAICS) code.

(vi) Funding agency.

(vii) A description of the products or services (including construction) being provided under the subcontract, including the overall purpose and expected outcomes or results of the subcontract.

(viii) Subcontract number (the contract number assigned by the prime contractor).

(ix) Subcontractor’s physical address including street address, city, state, and country. Also include the nine-digit zip code and congressional district if applicable.

(x) Subcontract primary performance location including street address, city, state, and country. Also include the nine-digit zip code and congressional district if applicable.

(xi) Names and total compensation of each of the subcontractor’s five most highly compensated officers, for the calendar year in which the subcontract is awarded if—

(A) In the subcontractor’s preceding fiscal year, the subcontractor received—

(1) 80 percent or more of its annual gross revenues in Federal contracts (and subcontracts), loans, grants

(and subgrants), and cooperative agreements; and

(2) $25,000,000 or more in annual gross revenues from Federal contracts (and subcontracts), loans, grants

FLOW METERS & CHLORINATORS PROJECT

SECTION 13120

BUILDING

PART 1 - GENERAL

1.01 SCOPE:

The work includes the construction of an eight (8) foot by eight (8) foot wood framed pump house building as specified hear in and as shown on the drawing.

1.02 DELIVERY, STORAGE, AND HANDLING:

Delivery and Storage: Keep all materials under cover and dry. Protect against exposure to weather and contact with damp or wet surfaces. Stack lumber as well as plywood and other panels up off of the ground; provide for air circulation within and around stacks and under temporary coverings including polyethylene and similar materials. Protect all other materials such as paint, and caulk from freezing or other exposures. Any material showing signs of delamination, broken or split or any other damage do to improper storage and handling shall be remover from the project.

1.03 QUALITY CONTROL

A. Codes and Standards: Quality of products and installation shall conform to codes and standards referenced below, as applicable.

1. Uniform Building Code, 2007 or latest Edition.

B. Grade Stamps: All lumber and plywood shall be grade-stamped.

PART 2 - PRODUCTS

2.01 LUMBER, GENERAL:

A. Lumber Standards: Furnish lumber manufactured to comply with PS 20 "American Softwood Lumber Standard" and with applicable grading rules of RIS, WCLIB, WWPA.

B. Grade Stamps: Provide lumber with each piece factory-marked with grade stamp of inspection agency evidencing compliance with grading rule requirements and identifying grading agency, grade, species, moisture content at time of surfacing, and milling.

2.02 DIMENSION LUMBER

A. All dimension lumber shall be graded as indicated.

2.03 CONSTRUCTION PANELS, (PLYWOOD), GENERAL

A. Construction Panel Standards: Comply with PS 1 "U.S. Product Standard for Construction and Industrial Plywood" for plywood construction panels and, for products not manufactured under PS 1 provisions, with APA PRP-108.

B. Trademark: Furnish construction panels that are each factory-marked with APA trademark evidencing compliance with grade requirements.

2.04 AIR INFILTRATION BARRIER - EXTERIOR WALLS

Available Products: Subject to compliance with requirements, air infiltration barriers that may be incorporated in the Work include, "Tyvek House wrap, " Fibers Department, DuPont Company or approved equal.

2.05 FASTENERS

A. Provide fasteners of size and type indicated.

B. Where rough carpentry is exposed to weather, or ground contact, provide fasteners with a hot-dip zinc coating per ASTM A 153.

C. Nails;

1. Framing members, 16d and 8d Teflon coated

2. Exterior, 8d hot dipped galvanized

2.06 METAL FRAMING ANCHORS

Use galvanized steel framing anchors ½” diameter, 12” long.

2.07 ASPHALT SHINGLES

A. Square Tap Strip Shingles: U.L. Class “A”, Heavy weight: Mineral-surface, self-sealing, 3-tab asphalt fiberglass shingles. Provide shingles bearing UL Class “A” external fire exposure label and UL “Wind Resistant” label, and a weight of 300#. Color shall be a Medium Brown and approved by the Contracting Officer. Ridge shingles shall be the same color and manufacture as the shingles.

B. Felt Underlayment: No. 15 unperforated asphalt impregnated organic felt.

2.08 METAL DOOR AND FRAME WITH HARDWARE

Door shall be 1-3/4” thick insulated metal door. Doors face shall be 18 gauge steel with minimum 20 gauge steel stiffeners and fiberglass batts between stiffeners or approved equal.

Frames shall be of the same manufacturer and when joined with door shall be weather tight.

All hardware shall be supplied with door. Hardware shall be Yale, Schlage, or Corbin Manufacture Co. Locksets shall be commercial type and shall be approved by the Contracting Officer.

2.09 PAINTING

Paint shall be by a major manufacturer such as Fuller, Dunn Edwards, Pittsburgh Paint, Sherwin Williams, or approved equal. All exposed metal shall be either factory primed or primed on the job before applying finishing coats. Product description for each material to be painted is as follows: Dunn Edwards coating systems are indicated; other equivalents are acceptable upon Contracting Officer approval.

1. Metal Door and Frame: 1st coat: Primer, Ferrous Metal – W711 Van Prime with pretreatment required. Follow manufacturer’s recommendations. Note: Doors and Frames to be shop-primed.

2nd and 3rd coat: W901 Permsheem Acrylic Semi-Gloss Enamel, Color: 56 “Weather Brown”

2. Exposed Wood, Siding, Trim, Eves, and Facia: 1st and 2nd coat: 717 Olympic Semi-Transparent stain; Color: Naturaltone Redwood.

2.10 CONCRETE

See Section 03300

PART 3 - EXECUTION

3.01 WOOD FRAMING, GENERAL

A. Framing Standard: Comply with National Forest Products Association (N.F.P.A.)

"Manual for House Framing," unless otherwise indicated.

B. Install framing members of size and spacing indicated. Coordinate with other framing and to other trades prior to actual construction.

C. Do not splice structural members between supports.

3.02 STUD FRAMING

A. Cut studs and posts with square ends, unless otherwise shown, and erect plumb. Studs in walls shall be 2X4, or 2X6 as indicated on drawings.

B. Double studs shall be provided on each side of all openings, unless noted otherwise.

Construct corners and intersections with not less than 3 studs. Install miscellaneous blocking and framing as shown and as required for support of facing materials, fixtures, specialty items, and trim.

C. Openings in stud walls and partitions shall be framed with headers across the top with a minimum size of 6 inches deep x stud width resting on cripple studs, unless otherwise noted.

D. Top plates shall be double, set one at a time; sill plates single, secured as indicated on drawings. Corners where stud wall or partitions meet shall be framed solid. Double top plates shall be lapped at corners. Where openings are cut through plates, install 16-gauge steel strap ties 1-1/4 inches wide at single plate, and 2-5/16 inches wide at double plate extending minimum 9 inches past each cut.

E. Holes through studs exceeding 1/3 the width of the stud are not permitted without review by the Contracting Officer.

3.03 INSTALLATION OF CONSTRUCTION PANELS (PLYWOOD)

A. General: Comply with applicable recommendations contained in Form No. E30, "APA Design/Construction Guide - Residential & Commercial," for types of construction panels and applications indicated.

B. Wall sheathing may be installed with face grain either perpendicular to or parallel to the studs. No piece shall be less than 2 feet wide.

C. Roof and floor sheathing shall be installed with face grain perpendicular to the framing members. No piece shall be smaller than 2 feet by 4 feet.

3.04 AIR INFILTRATION BARRIER

A. Cover sheathing with air infiltration barrier as follows:

1. Apply asphalt-saturated organic felt horizontally with 2-inch overlap and 6-inch end lap; fasten to sheathing with corrosion-resistant staples, or

2. Apply plastic sheet to comply with manufacturer's printed directions.

3.05 ROOFING

A. Comply with all shingle manufacturer’s instructions and recommendations for installation.

B. Apply on layer of felt horizontally over entire roof surface, overlapping succeeding courses 2” minimum and fastening with sufficient nails to hold in place until shingle installation.

C. Install starter strip of rolled roofing or inverted shingles with tabs removed. Fasten shingles in pattern, weather exposure and number of fasteners per shingle as recommended by manufacturer. Shingles shall have a ½” overhang on eve and rack.

3.06 DOORS AND FRAMES

A. Prepare all doors and frames to receive hardware to be applied in accordance with the hardware manufacturer’s templates and instructions.

B. Set frames to maintain design dimensions, hold head level and maintain jambs plumb, square and true. Anchorages and connections shall be secured to adjacent, firm construction.

C. Install thresholds, weather-stripping and hardware to assure the door function is smooth and secure. Adjust operable parts to correct the function.
