STATEMENT OF WORK/DESCRIPTION/SPECIFICATIONS

Scope of Contract

This contract provides for fuels reduction/modification and fuels removal through chipping of hand piles created from past projects for approximately 138 acres, to be performed in compliance to the contract terms, specifications and provisions.

The Contractor shall furnish labor; equipment; supervision; transportation (including but not limited to mobilization);

operating supplies and incidentals (including but not limited to all water and all Sporax® necessary for contract operations).

Location and Description

The project is located on the Santa Clara Mojave River Ranger District of the Angeles National Forest along the Sawmill Mountain ridge west of the Lake Hughes community. The legal descriptions of the locations are as follows: T7N R16W, Sec 24 for Maxwell and Mile High plantations, Sec 13 and 14 for Upper Shake plantation, Sec 9 and 16 for Digger and Fish plantations and Sec 17 for Atmore Plantation. These plantations are located in Los Angeles County, California. See attached Task Order Map(s) for general plantation locations. More site specific maps will be available at time of bid tour and/or pre-work meeting after contract award.

Contract Time

Estimate start work date is September 30, 2013. The contract time will be 450 days. Contract time includes delays for weather; project activity level restrictions; all applicable wildlife limited operating periods; locating and transporting supplies and materials; and final cleanup.

Access

Access routes include Elizabeth Lake Road, also known as Lake Hughes Road off Interstate 5 North, and Pine Canyon Road to Forest Road 7N23 (Atmore, Fish, Digger, Upper Shake, Mile High, and Maxwell plantations).

DESCRIPTION/SPECIFICATIONS

General

The purpose of the SCMRRD Plantation Chipping Project is to improve the health and vigor of the plantations and surrounding natural stands and reduce the hazardous fuels that contribute to crown fire initiation and sustain crown fire spread during a wildfire. The project is designed to reduce hazardous fuels and to promote forest health and reduce tree mortality from bark beetles and wildfire.

Unit boundary will be marked with blue flagging to guide the contractor unless otherwise specified by the agency at the pre-work meeting. Where flagging is absent such as in the Upper Shake plantation, a well-defined boundary will be present.

There is a “Limited Operating Period” for this project. No activities will be permitted within the project boundary from April 1 to September 1 unless previously coordinated with the agency.

Riparian Conservation Areas (RCA) will be identified with a designated color of flagging and/or identified on the task order maps presented at time of bid tour and/or pre-work meeting after contract award. No manual or mechanical work will take place within 300 feet from a streambank on either side of a perennial stream or 100 feet from the streambank on either side of an intermittent stream.

Other “Control Areas” will be identified with orange flagging and/or identified on the task order maps presented at time of bid tour and/or pre-work meeting after contract award.

Chippers will be allowed in designated areas only.

Fomes annosus (Heterobasidion annosum) is a fungus that attacks a wide range of woody plants causing a decay of the roots and butt and the death of sapwood and cambium. All conifer species in California are susceptible to the fungus. To reduce the risk of fomes annosus infestation, Sporax will be applied to freshly cut stumps no later than 4 hours after the

SOLICITION #: AG-91T5-S-13-0002 Page 5 of23 tree is cut. The active ingredient in Sporax is borax, a naturally occurring mineral made of sodium, boron, oxygen, and water. No treatment of vegetation would occur within 50-200 feet of streams; therefore, no borax is anticipated to enter the streams within the project area. Sporax would be applied in localized treatments, has low toxicity, and would not be used near water or during rain events. The Contractor shall adhere to all County, State, and Federal laws and regulations regarding this pesticide. This includes label directions and restrictions for application, handling storage, transportation and employee safety. The Contractor shall obtain all necessary permits and licenses for application of this pesticide. The Contractor shall submit all required Use Reports to all appropriate agencies within required time frames.

Snag Removal Cut all dead and dying trees less than 16.0 inches DBH (diameter at breast height) and leave them bucked to 20 foot lengths on the ground and/or chip them. Snags larger than 16.0 inches are to be left at 2-3 per acre.

Down logs shall be left for wildlife habitat not to exceed 120 lineal feet of largest available on site. Additional lineal feet shall be chipped and scattered. Priority shall be given to existing partially buried down logs. Within 20 feet of roads and trails additional down logs shall be left in numbers and locations approved by the COR or inspector to restrict motor vehicle access.

Slash Treatment

All created and existing slash within the project area, including logs, dead brush, and other woody debris less than 3.0 inches in diameter or less resulting from thinning, pruning, brush clearing, and dead tree removal activity shall be chipped.

This includes all piles that were created in previous implementation contracts.

Residual chipped vegetative debris resulting from Contractor’s operations shall lie flat on the ground and not exceed an average of 2-6 inches in depth. Individual pieces of vegetative debris shall not exceed 2.0 inches in diameter and 4.0 feet in length and shall lie flat. No chipped material shall accumulate against boles or beneath the dripline of residual trees.

All slash, shrubs, cut and downed trees over 3 inches in diameter shall be lopped and bucked to a 5 foot length and spread apart. No piling of this material shall take place. Downed trees shall not stay across each other. They must be separated, lopped and bucked and spread out.

All material 6 inches in diameter and greater will be left for use in firewood sales. These sections will not be chipped but will be left scattered and off of any road or trail.

Where existing illegal OHV trails are present, it is preferred that slash material be lopped and scattered over the trails and trailheads to aid in erosion control and prevention of future illegal entrance.

Other Contractor's operations shall not unnecessarily damage any retained trees or live vegetation. All vegetation to be cut and/or removed for access routes to the treatment areas will be approved by the COR or contract inspector.

All materials, waste and equipment will be removed from the project site(s) at completion of the project.

Work crews will avoid disturbing or creating impacts to and shall notify the COR or contract inspector of any sightings of ANF Special Status Species, TECS species and any injured, sick or abandoned animals found in the project site(s) immediately.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed.

A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
