Materials produced or processed from Government lands in excess of the quantities required for performance of this contract are the property of the Government. The
Government is not obligated to make reimbursement for the cost of producing these materials.
106 - Acceptance of Work
106.01_nat_08_12_2004
106.01 Conformity with Contract Requirements.
Delete Subsection 106.01 and substitute the following:
Follow the requirements of FAR Clause 52.246-12 Inspection of Construction.
References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.
Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.
Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is more strict.
Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.
When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.
The Government may inspect, sample, or test all work at any time before final acceptance of the project. When the Government tests work, copies of test reports are furnished to the
Contractor upon request. Government tests may or may not be performed at the work site.
If Contractor testing and inspection is verified by the Government, the Contractor’s results may be used by the Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.
Acceptable work conforming to the contract will be paid for at the contract unit bid price.
Four methods of determining conformity and accepting work are described in Subsections
106.02 to 106.05 inclusive. The primary method of acceptance is specified in each Section of work. However, work may be rejected at any time it is found by any of the methods not to comply with the contract.
Remove and replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted, at no cost to the Government.
(a) Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the CO. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request. Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:
(1) Sampling method;
(2) Number of samples;
(3) Sample transport;
(4) Test procedures;
(5) Testing laboratories;
(6) Reporting;
(7) Estimated time and costs; and
(8) Validation process.
If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third party laboratory. Use a third party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed
Government test results or that produced the test results used as a basis for the dispute.
The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the
Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the Government will be responsible for all costs associated with developing and performing the resolution protocol. If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.
(b) Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:
(1) Have the work accepted at a reduced price; or
(2) Be given permission to perform corrective measures to bring the work into conformity.
The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The CO will determine disposition of the nonconforming work.

109.02_0117_11_15_2004
109.03 Weighing Procedures and Devices.
(c) Project weighing system.
Add the following after the fifth paragraph.
Under observation of the Engineer or a designated Government Representative, the contractor shall perform the following tests:
Daily Zero Load Tests.
Initial Materials Tests the first day pay item materials are available.
Subsequent Materials Tests as required by the Engineer when Daily Zero Load
Tests or Simulated Load Tests indicate a doubt exists in the original calibration.
A minimum of one subsequent materials test shall be conducted for each 7500 ton quantity of material weighed.
Simulated Load Tests or other procedures recommended by the manufacturer shall be performed, even though they may not be covered in this specification.
Tests shall be conducted in accordance with the following:
Conditions of Test. A belt conveyor scale shall be tested after it is installed according to manufacturer’s instructions, or NIST Handbook No. 44. All tests shall be conducted at the same belt speed that will exist during actual weighing of aggregate for payment.
Materials tests shall be conducted at the same loading that will exist during actual weighing of aggregate for payment. All tests shall be run after the belt-conveyor scale system has run at normal loading for a minimum of 15 minutes to equalize belt temperature.
Zero Load Tests. Zero load tests shall be run every day the scale is used, after the conveyor framework is disturbed, and after any adjustment for belt tension or alignment.
The variation between the beginning and ending indication of the master weight totalizer shall not be more than 1 scale division when the belt-conveyor scale is operated at no load for a period of time equivalent to that required to deliver the minimum totalized load of 1000 scale divisions.
The zero-load test shall be conducted over a whole number of belt revolutions, but not less than three revolutions or 10 minutes' operation, whichever is greater.
During any point of time while conducting the zero-load test, the totalizer shall not change more than three scale divisions from its initial indication.
Material Tests. The actual aggregate to be purchased by the Government shall be used for this test. Aggregate must be loaded into the hauling vehicles that are to be used on the project, each load must be weighed on certified platform scales, and the weights from both scales compared for each load to see if they meet the accuracy and variation requirements.
An initial materials test done at the start of the project shall consist of three individual loads of aggregate. Subsequent materials tests at 7500 ton intervals shall consist of two individual loads of aggregate. The performance of the belt scale is not to be determined by averaging the results of the individual tests. The results of all of these tests shall be within the accuracy and variation requirements.
The belt scale accuracy requirement is plus or minus 5 percent from the weights from certified platform scales. The determination of final quantities for payment shall be based on the percentage correction that results in the smallest quantity; all materials test results will be considered.
The maximum variation between the individual tests conducted during initial Materials
Test verifications and the maximum variation between the individual tests conducted during subsequent Materials Test verifications shall not be greater than 1.0 percent
To assure that the test load is accurately weighed and determined, the following precautions shall be observed:
The truck boxes must not leak, and shall not be overloaded to the point that aggregate will be lost.
The actual empty or tare weight of the hauling vehicle shall be determined at the time of the test. Stenciled tare weight of hauling vehicles shall not be used.
Gross and tare weights shall be determined on the same scale.
The elapsed time between the test on the belt-conveyor scale and the determination of the weight of the aggregate on certified platform scales shall not be more than eight hours.
The test shall not be valid if the weight of the aggregate has been affected by environmental conditions.
Simulated Load Tests. Simulated load tests shall be conducted in accordance with the belt-conveyor scale manufacturer instructions. These tests shall not be used for official certification.
Security. All adjustable components and recording equipment shall be secured and locked. Access to recording equipment shall be restricted to the Engineer."
Bin Scales (Hopper): Bin Scale (Hopper) weighing will be accepted in lieu of platform scales, provided the method or device meets the requirements specified below and is compatible with the provisions of measurement and payment in the applicable construction specifications. Scales shall be of beam type, electronic type, or springless dial type. The scales shall be accurate within 0.5 percent throughout the range of use.
When beam type scales are used, provisions, such as a "Tell-tale" dial, shall be made for indicating to the operator that the required load in the weighing hopper is being approached. A device on weighing beams shall indicate critical position clearly. Poises shall be designed to be locked in any position and to prevent unauthorized change. The weigh beam and "tell-tale" device shall be in full view of the operator while charging the hopper, and the operator shall have convenient access to all controls.
Before use on the project, (after installing for use on the project) the Contractor shall have scales and weighing devices checked, adjusted, and certified by a representative of the State agency responsible for weights and measures or by a qualified manufacturer's representative.
The Engineer may permit use of scales and weighing devices for three calendar days prior to certification, provided field testing indicates consistent compliance within the limits of accuracy specified herein.
In the event that checking and certification reveals: (a) the scales and weighing devices have been underweighing (indicating less than true weight) they shall be adjusted and no additional payment to the contractor will be allowed for materials previously weighed and recorded; or (b) the scales and weighing devices have been overweighing (indicating more than true weight), they shall be adjusted and all materials received subsequent to the last previously correct weighing accuracy test will be reduced by the percentage of error in excess of 0.5 percent.

109.10 Methods of Measurement
One of the following methods of measurement for determining final payment is
DESIGNATED IN THE SCHEDULE OF ITEMS for each PAY ITEM:
(a) Designed Quantities (DQ). These quantities are synonymous with “Contract
Quantities” in section 109.02B. They denote the final number of units to be paid for under the terms of the contract. They are based upon the original design data available prior to advertising the project. Original design data include the preliminary survey information, design assumptions, calculations, drawings, and the presentation in the contract. Changes in the number of units DESIGNATED IN THE SCHEDULE OF
ITEMS may be authorized under any of the following conditions:
(1) Changes in the work authorized by the CO.
(2) A determination by the CO that errors exist in the original design that cause a PAY ITEM quantity to change by 15 percent or more.
(3) A written request submitted to the CO showing evidence of errors in the original design that cause the quantity of a PAY ITEM to change by 15 percent or more. The evidence must be verifiable and consist of calculations, drawings, or other data that show how the designed quantity is in error.
(b) Stake Quantities (SQ). These quantities are determined from staked measurements prior to construction.
(c) Actual Quantities (AQ). These quantities are determined from measurements of completed work.
(d) Vehicle Quantities (VQ). These quantities are measured or weighed in hauling vehicles.
(e) Lump Sum Quantities (LSQ). These quantities denote one complete unit of work as required by or described in the contract, including necessary materials, equipment, and labor to complete the job.

All permanent erosion control measures shall be in place within 5 days following completion of earthwork at the location.
For projects, including road obliteration, no more than one feature shall be cleared of established vegetation, with disturbed soil exposed, at a time for each excavator, except for the situation described at the end of this paragraph. One feature is defined as one road. The exception to the limitation of one feature exposed at a time would occur when a series of features are linked together, and all preceding features would need to be cleared to access the feature at the end of the linked features.
Work during wet conditions shall cease if rutting and erosion cannot be controlled. Prior to leaving the site, any rutted areas and other damaged areas shall be smoothed, sloped and graded to drain, and all erosion control features required under this contract shall be constructed and functional.

211.01
(a) Method 1.
Delete the section and replace with the following:
Obliterate the roadway by restoring to approximate original ground contours.
Decompact all surfaces that have become hardened. Remove all pipes, bridges, and other structures and all fill material associated with them down to “natural ground” or as shown on the drawings. Keep excavated material within the original construction limits. Finish slopes to provide gradual transitions in slope adjustments without noticeable breaks.
(b) Method 2.
Delete the section and replace with the following:
Close roads by constructing a barrier to vehicle passage, decompacting the roadbed, filling and removing ditches and outsloping to drain. Remove designated pipes, bridges, and other structures and all fill material associated with them down to
“natural ground”. Eliminate all ruts and low spots that could hold water.
211.02
(b) Nonrigid Material.
(1) Nonasphalt Material.
Delete the section and add the following:
Decompaction. Any specified road segment or surface area where embankment is to be placed shall be decompacted prior to placement to promote water infiltration and establish vegetation. This work shall consist of loosening 100 % of the soil in the existing roadbed or landing surface to a depth of 18 inches or AS
SHOWN ON THE DRAWINGS. A sufficient number of passes shall be made to attain complete decompaction. Equipment shall not be operated on decompacted areas. If this occurs, the area shall be decompacted again at the Contractor's expense.
Outsloping. Roads and landings shall be outsloped by pulling the fill shoulder towards the cut bank as shown on the drawings. Excavated material shall be spread over the roadbed or landing. The finished grade shall be a free draining, straight-line surface across the existing roadway. Any existing ditches at the toe of the cutslope shall be ripped and filled with the material excavated during outsloping. Any berms remaining along the upper or lower edges of this work shall be blended with the surrounding terrain, and all other berms, tracks, and other surface irregularities shall be smoothed to allow a free draining surface.
Drainage excavation. Drainage excavation shall include the removal of fill material over culverts and bedding material underneath, reconstruction of the natural channel course and blending of sideslopes. All designated drainage structures and appurtenances (culverts, downpipe, anchors, drop inlets, and trash racks, etc.) shall be removed as described in Section 203 - Removal of Structures and Obstructions. Removal and disposal of log drainage structures shall be considered incidental to this section, and no additional payment will be made.
Stream channel width after drainage structures have been removed shall be the same as the undisturbed width above or below the crossing. The depth and alignment of excavation will be to the depth and position of the existing culvert, plus removal of any material between the natural channel and the culvert
(bedding), unless specified otherwise on the drawings. A uniform grade shall be constructed from the inlet to the outlet to facilitate a free draining channel for the entire length. Excavated material shall be incorporated in the adjacent areas while maintaining the “natural slopes”. Culvert removal shall be AS SHOWN ON THE
DRAWINGS. Materials excavated during culvert removal shall be deposited evenly on the roadbed as shown on the drawings or work list. When removing culverts in wet draws or streams, water diversions, pumping or other approved means will be utilized to reduce water siltation and erosion. Low stage check dams shall be installed to reduce erosion of newly created stream beds WHEN
SHOWN ON THE DRAWINGS OR WORK LISTS.
Vegetation removal. This work shall consist of clearing, grubbing, trimming, removing and disposing of debris and vegetation. Vegetation includes dead woody debris, trees, stumps, roots and other vegetation within the limits of the project area necessary to be cleared for access to project sites, covering areas designated for excavation or embankment, and woody material generated from excavations. Vegetation shall be preserved and later placed on top of finished road segments and completed channel side slopes in stable positions. Trimmed or removed vegetation shall not be left "hung-up" in remaining live vegetation.
Standing trees of greater than 10 inches in diameter at breast height shall not be disturbed without prior approval of the engineer.
Seeding. Seed and fertilize disturbed areas in accordance with Section 625.
