Combined Synopsis/Solicitation Solicitation Number: AG-64R4-S-16-0022
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.
This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is issued as a Request For Proposal. The documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-87.
This procurement is set aside 100% for Small Business. The applicable NAICS code is 115310 and the Small Business Size Standard is $7.5M.
Note – The Base Period will begin at award (anticipated mid-August 2016) and run 12 months.
Each successive Option year (if exercised) will be 12 months in duration and begin immediately upon expiration of the previous. (AGAR 452.211-74 Period of Performance)
This solicitation shall result in either 1 or 2 Requirements Contracts. Offerors must propose on EVERY task/line item for either 1 or both Disricts to be eligible for award. Offerors who do not propose on every task will be considered unresponsive and removed from further consideration for award. Unreasonably high, unreasonable low or unbalanced pricing may also eliminate a proposal from competition.
By submitting the offer, the Contractor agrees to all terms, conditions, clauses, and provisions included in the solicitation and agrees to furnish any awarded items at the price set in the schedule. The offer is valid for 60 days after the closing date of the solicitation unless a formal extension is granted by the contractor.
Requirements Contract: The quantities contained on the bid schedule represent the Government’s best estimate of its requirements for the period of contract performance. The Government reserves the right to order quantities in excess of the stated estimated quantities on the Bid Schedule. However, such quantities shall not exceed 150 percent of the total estimated contract dollar amount. It is estimated that the Government’s requirements for any additional quantities for each line item will be in approximately the same proportions that each item currently bears relative to the entire estimate; however, mathematical precision is not required.
The Contractor shall perform work on these quantities at the same bid price. The Contractor’s lack of receipt of quantities shall not create an entitlement to an equitable adjustment from the Government. This is a Requirements Contract (reference FAR 52.2167-21). There is NO GUARANTEED MINIMUM under this contract.
Any Warranted Contracting Officer within the Ohio River Basin Procurement Zone shall be authorized to place task orders against this contract within their delegated warrant authority. All task orders are subject to the terms and conditions of this contract.

Description of Requirement/Scope of Work
SCOPE OF WORK: The contractor shall provide all labor, equipment, supplies, services, transportation/lodging, licenses and permits necessary to perform the tasks detailed in this scope of work. All work performed shall be in compliance with the terms, conditions and specifications of this solicitation and any resultant contract.
This work shall be performed within the boundaries of the Houston/Rolla/Cedar Creek and Ava/Cassville/Willow Springs Ranger Districts. Several maps will be listed as attachments. These maps are an indication of areas that work may be ordered in/on – this is NOT a guarantee of this or ANY work. Specific locations, area data, and maps will be issued with each task order.
SCOPE OF WORK: The purpose of this work is to reduce the density and continuity of slash and small diameter vegetation (slash, stumps, trees, and sprouts). Mulching Units will have the Unit boundaries marked and GPS traversed prior to Contractor’s crews working in the area. All work shall be performed in accordance with the terms, conditions and specifications of this solicitation and any resultant contract. This statement of work consists of completing the tasks/subtasks in Section 5 to the performance requirements of the technical specifications.
Acreages listed have been determined by Global Positioning System (GPS) Traverses.
Progress Schedule – Within 5 days of receipt of a Task Order, contractor shall prepare and submit to the COR a practical work schedule showing the order in which the contractor will perform the work ordered and the dates on which the contractor contemplates starting and completing each area included on the project lists that accompany each task order.
DESCRIPTION AND LOCATION: The areas are located within the boundaries of the Mark Twain National Forest in Missouri. Some areas to be treated have had the trees ≤ 12 diameter at ground level cut in the past and left on the forest floor. While other areas still have the trees ≤ 12 diameter at ground level standing and need mulched. Fuels to be reduced consist of these downed/standing midsotry trees, stumps, slash, and stump sprouts. Specific locations, area data, and maps will be issued with each task order.
BOUNDARIES: Individual mulching unit boundaries will be premarked by the Forest Service prior to Contractor doing the work. Boundaries will be marked with either orange paint or with flagging. If orange paint is used, trees would be painted with two slash marks at eye level facing the interior of the Unit. These marks would be able to be seen when inside of the unit. Forest Service roads may also be used as boundaries.
RE-MEASUREMENT: The Contractor may at any time after issuance of this contract request re-measurement of acres. The request must be in writing to the Contracting Officer.
Payment will be based on the re-measurement of the acreage, except no adjustment shall be made for areas less than 1 acre. The Contractor shall pay for the cost of re-measurement if the re-measurement results in an increase of less than 10 percent. Method of re-measurement to be used will be done with GPS (Global Positioning System) traverses by the Government.
PAYMENT: Payment for performed work shall be made at the contract price per acre for mulching work actually completed by the Contractor and accepted by the Government.
Payment will be processed for completed units only and for a minimum amount of $1,000 OR the entire Task Order in the case of a Task Order for less than $1,000.
CONTRACTOR REPRESENTATIVE: The contractor shall provide a contract representative for the performance of the work. The name of this person and an alternate(s) who shall act for the contractor when the contractor is absent shall be designated in writing to the contracting officer. The contractor representative or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.
The contractor representative and alternate(s) must be able to read, write, speak, understand English, and communicate with his crews.
PRE-WORK CONFERENCE: Prior to commencement of work, the Contracting Officer (CO) or Contracting Officer's Representative (COR) will arrange a meeting with the Contractor to discuss the contract terms and work performance requirements. A work progress schedule will be developed at this meeting.
Prior to commencement of work, preferably at the pre-work conference, the Contractor shall designate in writing a person to act for him in his absence. The Contractor or the designated representative shall be on the job whenever work is in progress. In the absence of the Contractor, the authorized representative will take action as required to keep the job in progress under the terms of the contract. The presence of the Contractor's Representative or Contracting Officer's Representative on the job will not relieve the Contractor of responsibility for satisfactory performance.
WORK PROGRESS: The Contractor shall complete all work within the contract time stated on each task order. Contract time shall be 1 day for every 2 acres plus 5 additional days for initial mobilization
DAMAGE TO PROPERTY: The Contractor shall be responsible for any damage caused by his/her personnel or equipment to any existing structures, private or public. Damaged items shall be repaired or replaced by the Contractor at no additional cost to the Government.
In the event of interruption to utility service, the Contractor shall promptly notify the proper authority and shall cooperate with the authority in the restoration of service.
PROTECTION OF IMPROVEMENTS: Any improvements (roads, power lines right-of-ways, buried utility lines, fences, trails, ponds, etc.) damaged by the contractor’s work shall be repaired to the condition that existed prior to the start of work at the contractor’s expense.
EQUIPMENT REQUIREMENTS: All heavy equipment must be equipped with protective canopies or roll-over protection devices and fire extinguishers.
Mulching equipment must be of sufficient size and type capable to meet all requirements of Tasks- 5.1, 5.2, 5.3, & 5.4. A skid steer or a larger sized piece of equipment with a mulching attachment may be used as long as it has a minimum of 100 Horse Power. There are no restrictions on drive train, i.e. rubber-tired or track mounted. Bids for this mulching project shall include a description of the equipment that will be used for the project. (rubber tire or tracked equipment, horsepower, etc.)
Transportation equipment shall meet DOT requirements and be capable of transporting required equipment over access roads. All equipment including dozers, lowboys, trucks, mulchers etc.
must be cleaned prior to start of contract to prevent the introduction and spread of nonnative invasive species. Equipment shall be in good repair and free of abnormal leakage of lubricants, fuel, coolants, and hydraulic fluid. Contractor shall remove from National Forest lands all contaminated soil, vegetation, debris, vehicle oil filters, batteries, oily rags, and waste oil resulting from use, servicing, repair, or abandonment of equipment.
