SECTION F
DELIVERIES OR PERFORMANCE
49 Amendment 04
(i) The MAP may be effective up to 45 days before the date specified in the Schedule of Items.
(c) Post Season Period (Subject to mutual agreement by both parties.) The Government may order services on a day to day basis up to 60 calendar days following the MAP. This service is subject to acceptance by the Contractor. If accepted, all terms and conditions of the contract will apply.
(d) During the MAP and any extensions thereof, aircraft shall be stationed and remain at their designated or alternate base of operations fully operational and ready for takeoff.
F.4 DAILY AVAILABILITY REQUIREMENTS
(a) Equipment. The aircraft and related equipment will remain at the assigned base 24 hours per day and shall not be removed without the approval of the Contracting Officer.
(b) Personnel. Each day, each of the Contractor's personnel WILL BE IN ONE of the following conditions of availability.
(1) Standby. Personnel will be on standby each day for the number of hours specified in the Schedule of Items. The start of the standby period will be established by the Contracting Officer and may be adjusted from day to day. During this time, flying is required on short notice in that no longer than 15 minutes elapse from the time dispatch orders are given to the pilot and the time that the aircraft is airborne. At any time that standby or a flight mission is ordered prior to the assigned standby hours, the standby (duty hours) period is automatically adjusted in that the duty period will begin when standby or flight mission commences.
(2) Extended Standby. Hours of standby, in addition to those specified in the Schedule of Items, may be ordered by the Contracting Officer.
(3) Return to Standby (Alert). The Contractor will inform the Contracting Officer how to contact appropriate personnel. Subject to Flight and Duty Limitations, this personnel shall be allowed 2 hours to return to standby status after the contact attempt is made.
Failure to return to standby status within 2 hours may result in loss of availability status.
(4) Authorized Breaks. The aircraft may be released from standby, upon advanced approval by the COR, for scheduled or preventative maintenance and the Contractor will continue to be paid the availability rate.
(5) Release From Standby. Upon advance approval of the COR, Contractor personnel may be released from standby prior to lapse of their individual crew standby period.
Service will continue to be recorded as available (this will constitute a duty day). When released during the duty day, crews shall inform the COR how they may be contacted should a recall be needed.
F.5 UNAVAILABILITY OF AIRCRAFT AND/OR PERSONNEL
(a) The Contractor will be considered unavailable whenever the aircraft or pilot is not in condition to perform or fails to perform within the availability requirements. The Government may exercise its right to Termination for Default if there is unavailability in excess of three (3) full consecutive calendar days or an accumulation of 10 percent of the total days in the MAP and Post Season Periods.
SECTION G
CONTRACT ADMINISTRATION
For adjustment purposes, the baseline price for Jet A Fuel is established at $4.30 per gallon based on the February 16, 2016 National Government Fuel Survey.
(3) The reference price for Jet A Fuel will be established utilizing the average price for aviation fuel in effect at the time of the economic price adjustment. The reference price will be obtained from the same source as the baseline price. The reference price will become the baseline price for the subsequent adjustments during each optional renewal period.
(4) The adjustment to the fuel portion of the flight rate shall be the difference from the average baseline price to the current average reference price, multiplied by the fuel consumption rates located in the solicitation/contract for the applicable aircraft type.
(5) For each contract option renewal period, an initial adjustment to the Contractor’s proposed flight rate shall be made on February 16th to re-establish the baseline price, regardless of the variation in price. Subsequent adjustments to the flight rate shall be made on May16th and July 16th of each renewal contract period, provided the variation between the baseline price and the reference price, as stated above is $.10 higher or lower.
G.16 EXTENDED STANDBY ADJUSTMENTS
(a) The extended standby rate will be reviewed on an annual basis to insure compliance with the Service Contract Act and an adjustment will be made if needed. The extended standby rate will be computed by taking the minimum wage rate from the current Department of Labor Wage Determination, for Nationwide Pilot, times 1.5 plus 20% for benefits, overhead and profit. If needed, adjusted rates will become effective annually on February 16 of each year.
(b) Extended standby is intended to provide the Contractor compensation for employee time when ordered services are provided in excess of the first 9 hours of service. Extended standby is not intended to compensate the Contractor on a one-to-one basis for all hours necessary to service and maintain the aircraft.
