About this file
This document contains affidavits required by the Missouri Highways and Transportation Commission (MHTC) and Missouri Department of Transportation (MoDOT) for the Janitorial Services contract at the Transportation Management Center (TMC) in the St. Louis District. The affidavits establish compliance with Missouri state law regarding worker eligibility verification and proof of lawful presence in the United States. Exhibit 1 is an Annual Worker Eligibility Verification Affidavit that requires the business entity to affirm enrollment in a federal work authorization program operated by the United States Department of Homeland Security and certify that it will not knowingly employ unauthorized aliens in connection with services contracted by MHTC. The affidavit must be notarized and accompanied by documentation of enrollment in the federal work authorization program. Exhibit 2 is an Applicant Affidavit for Sole-Proprietorship or Partnership that requires each owner and general partner to provide affirmative proof of lawful presence in the United States by attesting to U.S. citizenship or lawful permanent resident status. This affidavit also requires notarization and includes acknowledgment of criminal penalties under Missouri law for obtaining public benefits through false statements or fraudulent means.
Both affidavits are mandatory compliance documents for bidders on this janitorial services contract, which runs from the date of award through October 31, 2027, with options to renew for up to four additional one-year periods. The affidavits reference Section 285.530 and Section 208.009 of the Revised Statutes of Missouri and establish that the contracting entity and its principals must provide sworn verification of work authorization status prior to contract award. Signatories acknowledge potential liability for knowingly employing unauthorized workers and understand the serious criminal penalties for fraudulent misrepresentation in obtaining public benefits from MHTC/MoDOT.
