About this file
This document contains additional terms and conditions for an Alabama Department of Corrections (ADOC) contract to procure Pepper Ball Non-Lethal Launchers, projectiles, and accessories. The contract will be established for an initial 12-month period with options to extend for four additional 12-month periods, provided both parties agree in writing at least 30 days prior to expiration of each period. The exact quantities to be purchased are not predetermined, and orders will be placed on an as-needed basis with no guarantee of minimum purchases. Suppliers must be authorized manufacturer representatives for their proposed brand and must provide proper documentation to avoid bid rejection. The question deadline is July 21, 2026, at 3:00 PM.
Award will be made on an all-or-none basis to the lowest acceptable bidder meeting all specifications and offering the highest discount percentage off manufacturer's suggested retail price (MSRP). Bidders must enter discount percentages for lines 1-4 and zero for lines 5-6, with the latter excluded from evaluation. All materials must be new, unused, of recent manufacture, and delivered within 60 days of purchase order receipt unless otherwise communicated. Awarded suppliers must accept multiple forms of electronic payment at no cost to the state and submit E-Verify and State of Alabama Vendor Disclosure Statement documentation. Payment is made 30 days in arrears only upon receipt of all ordered items in satisfactory condition. Price increases during contract performance are permitted only with documented manufacturer or supplier justification and cannot exceed Consumer Price Index increases for the same period, while price decreases must be passed to the state immediately. Freight charges are the supplier's responsibility through delivery destination, and suppliers must unload products upon delivery to ADOC facilities.
