About this file
This is Addendum I to Invitation for Bid #27-5-PI issued by Cumberland County, North Carolina through the Fayetteville Area Metropolitan Planning Organization (FAMPO) for the procurement of six portable bicycle and pedestrian counting systems. The solicitation requires man-portable units that are installable and removable within two hours, with individual components weighing no more than 50 pounds each. The systems must count and differentiate between bicycles and pedestrians using wireless connectivity (non-Wi-Fi/non-Bluetooth), feature weather-resistant design, require minimal tools for installation without causing lasting site damage, and provide office computer data accessibility. Written questions were due August 26, 2026 by 12:00 PM, with bids due September 4, 2026 at 3:00 PM. Delivery is required by December 2026. Award will be made to the lowest responsive, responsible bidder, and the county reserves the right to make separate awards to different vendors or cancel the solicitation.
Addendum I clarifies that the Build America, Buy America Act (BABAA) Certification (Attachment E) does not apply to this procurement and is not required to be completed or signed. The addendum addresses a bidder's question regarding whether portable, non-affixed counting equipment falls within BABAA's domestic preference scope. County response confirms that because the equipment is man-portable and not permanently affixed to infrastructure, it does not constitute an integral part of a structure subject to BABAA requirements. The equipment will be moved periodically to various locations within FAMPO territory rather than remaining fixed at a single federally-funded infrastructure project location, further supporting the determination that BABAA compliance certification is not applicable to this procurement.

1. Modification to Language Attachment E: Certification Regarding Build America, Buy America Act (BABAA) This attachment doesn’t appear to apply to this purchase, therefore it is not required to be filled out and signed.
2. Questions/Answers
1. I have a question regarding the IFB #27-5-PI FAMPO Bicycle & Pedestrian Counting Systems, specifically Page 9 : the CERTIFICATION REGARDING BUILD AMERICA, BUY AMERICA ACT
(BABAA)
Can you confirm if portable, non-affixed counting equipment falls within the BABAA domestic preference scope for this procurement? There is ongoing ambiguity as to whether things tehcnology like bicycle counters, especially portable ones, would be subject to BABAA conditions at all.
The most recent federal implementation guidelines fro BABAA that we are aware of (attached) stipulate on page 4 that:
'A Buy America preference only applies to articles, materials, and supplies that are consumed in, incorporated into, or affixed to an infrastructure project. As such, it does not apply to tools, equipment, and supplies, such as temporary scaffolding brought to the construction site and removed at or before the completion of the infrastructure project. Nor does a Buy America preference apply to equipment and furnishings, such as movable chairs, desks, and portable computer equipment, that are used at or within the finished infrastructure project, but are not an integral part of the structure or permanently affixed to the infrastructure project. A Buy America preference only applies to the iron and steel, manufactured products, and construction materials incorporated into an infrastructure project receiving a Federal award. If an agency has determined that no funds from a particular project receiving a Federal award will be used for infrastructure, a Buy America preference does not apply to that project. A Buy America preference does not apply to non-infrastructure components or expenditures under an infrastructure project receiving a Federal award.'

Given that the equipment you are requesting in the call for proposals - Man-portable units (installable/removable in two hours or less and can be carried in components weighing no more than 50 lbs. (22.68kg) each) - they would therefore not be 'an integral part of the structure or permanently affixed to the infrastructure project'. Will the counters be located only on a federally-funded infrastructure project, or moved around periodically to various locations within the FAMPO territory? Is conformity therefore with Certification regarding BABAA even relevant to this call for proposals? Similarly, if this procurement uses federal funds that were allocated prior to 2026, certain waiver conditions and exemptions apply for de minimis material implications
