ADDENDUM TO JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
UNDER AUTHORITY OF 10 U.S.C. 2304(c)(1) FOR FULL FOODSERVICE PRIME VENDOR
CUSTOMERS IN THE NORFOLK, VIRGINIA LAND AREA
1. The initial Justification and Approval (J&A) was approved by the HCA on June 25, 2020 for a thirty (30) day bridge contract with US Foods Raleigh effective July 12, 2020 through August 10, 2020. The purpose of the bridge contract with US Foods Raleigh was to provide Subsistence Prime Vendor coverage for customers in the Norfolk, VA Land region until the transition to a follow-on competitive procurement could be completed.
2. On June 30, 2020, US Foods Raleigh filed a protest with the Government Accountability
Office (GAO) challenging the award of the Norfolk, VA Land Subsistence Prime vendor contract to Sysco Hampton Roads. The protest requires an automatic stay of performance on the contract awarded to Sysco Hampton Roads. The sixty (60) day contract implementation period for Sysco Hampton Roads began the day of the award on June 12, 2020 and performance was suspended on July 2, 2020 by the issuance of a stop work order. Therefore, Sysco Hampton Roads has completed only twenty (20) days of the sixty (60) day implementation period required by the contract. The GAO decision is due on October 28, 2020. In the event the protest is dismissed or denied, Sysco Hampton Roads will need an additional forty (40) days to complete the full sixty
(60) day implementation period.
3. The length of the bridge contract referenced in the initial J&A is changed from thirty (30) days to 129 days and the effective dates are changed from July 12, 2020 through August 10, 2020 to July 12, 2020 through November 17, 2020. The estimated total dollar value for the proposed bridge contract is revised from $2,500,000.00 to $11,000,000.00. The guaranteed minimum dollar value which is ten percent (10%) of the estimated dollar value is changed from $250,000.00 to $1,100,000.00. The maximum total dollar value, including surge of 200% is changed from $5,000,000.00 to $22,000,000.00.
4. As the Contracting Officer, I hereby certify that this addendum is accurate and complete to the best of my knowledge and belief.
