About this file

This Addendum 4 document, issued by the New York State Office of Parks, Recreation and Historic Preservation (OPRHP), provides clarifications and modifications to bid documents for the Phase 2 Renovation of the Regional Administration Building at Belmont Lake State Park in West Babylon, New York. The addendum addresses Requests for Information (RFIs) submitted by Preferred Construction Inc. and EJ Electric Installation Co., as well as revisions to construction drawings. Key clarifications include confirmation that the 18" W x 21" D trench drain dimensions are correct (not the 12" W x 12" D shown in Detail 9/C-601); Door 115 is existing and to remain with frame preparation and painting per specifications, with wall demolition not occurring in this area; plywood underlayment is required for new LVT/RSF on the first floor with leveling per manufacturer requirements; wood repairs may be required where existing flooring is present; flooring will not be installed in herringbone or diagonal patterns; 10% attic stock must be provided for LVT/RSF and rubber cove base; project duration remains 420 days regardless of alternate selections; and sheet vinyl has been replaced with LVT flooring throughout. The addendum includes revised sheets AD-111, A-111, and C-600 as attachments and supersedes conflicting information in original bid documents. All bidders must acknowledge receipt of this addendum by inserting its number and date in the bid form or face potential disqualification.

The addendum also clarifies that New York State agencies are exempt from paying New York State sales tax, and contractors should complete and submit Form ST-120.1 (Contractor Exempt Purchase Certificate) to retailers once the contract is awarded to receive tax exemption on applicable purchases for construction, improvement, maintenance, service, or repair of real property. No specific pricing information, set-asides, or funding requirements are detailed in this addendum document, as it serves solely as a clarification and modification instrument to the original bid documents and RFI responses.

5 9.30.26 Refer to dwg. AD111 and A701

Refer to dwg. AD111 In Room 115, the demolition legend indicates that the wall is to be removed.

However, Drawing A701 (Door Schedule) indicates an existing door and frame, with a door size provided.

Additionally, Detail 21/A400 on Drawing A400 states, “Prepare, prime and paint existing door frame to remain.”

Please clarify whether the door and frame is to be replaced or not. If replaced then provide type of door.

ADDENDUM 4

Door 115 is existing to remain. Frame to be prepared and painted per elevation on 21/A-400. AD-111 and A-111 graphics have been revised to clarify the door is existing, and wall demolition will not occur in this area as the door is existing.

Question: Please advise on the tax status of this project.
Answer: New York State (NYS) agencies are exempt from paying NYS sales tax. Contractors working for NYS Office of Parks, Recreation and Historic Preservation (OPRHP) that make purchases to construct a building, structure, improve real property or to maintain, service, or repair a building, structure, or real property, should complete and provide the Form ST-120.1 to retailers to receive tax exemption once the contract is awarded.

The Contractor Exempt Purchase Certificate ST-120.1 can be found at the Department of Taxation and Finance website: https://www.tax.ny.gov/pdf/current_forms/st/st120_1_fill_in.pdf. The form itself further explains what purchases are applicable to receive tax exemption.
