About this file
This is Addendum No. 3 to SEPTA's RFP No. 26-00142-AHAC for Management Consulting Services for Curricula Development, issued August 25, 2026. The addendum extends the technical proposal due date from August 20, 2026 to August 27, 2026, both at 4:30 PM EST. All inquiries must be directed to Heather Casullo at hcasullo@septa.org or 215-580-7421. The addendum primarily provides clarification on insurance requirements, addressing two questions regarding ambiguities in coverage specifications. The document confirms that both prime contractors and all subconsultants must maintain the necessary insurance requirements independently. All proposers must acknowledge Addendum No. 3 by signing the included acknowledgement sheet and submitting it with their technical proposal.
The insurance requirements clarified in this addendum mandate comprehensive coverage including General Liability Insurance at $1,000,000 per occurrence and annual aggregate, Automobile Liability at $1,000,000 combined single limit, Workers' Compensation at $1,000,000, and Umbrella/Excess Liability at $1,000,000 occurrence and annual aggregate limits. All insurance carriers must have an A.M. Best Rating of "A-" or greater, and self-insurance retention is limited to $50,000 or less subject to SEPTA's approval. SEPTA must be named as additional insured on all applicable liability policies (excluding Workers' Compensation and Professional Liability) with primary and non-contributory language, and policies must provide 10 to 30 days written notice before cancellation. Coverage must remain in force until all work is completed and accepted by SEPTA, with certificates of insurance required simultaneously with contract execution before any Notice to Proceed is issued.

ADDENDUM NO. 3 INCLUDES THE FOLLOWING:
1. Insurance Section 24. Clarification ( see attached)
3 OF7 ADDEDNUM 3
Part I, Section 1, Paragraph IV.J to identify two ambiguities in the insurance requirements. We are not requesting a modification to the Contract.
1. The revised insurance requirement referenced in Addendum No. 2. Three answers in the Requested Contract Modifications section of Addendum No. 2 direct proposers to a revised insurance requirement: Q1 regarding products and completed operations, Q2 regarding cyber and privacy liability, and Q13 regarding the A.M. Best rating, self-insured retention cap, additional insured endorsements, and professional liability. Addendum No. 2 lists its contents as the Questions and Answers, the Revised Price Proposal Form, and the Revised Scope of Work, and we do not find a revised insurance requirement in either addendum. Would SEPTA please issue that document, or confirm that the answers in Addendum No. 2 constitute the revision in full.
We read Addendum No. 2 as establishing that the twelve-year products and completed operations requirement is removed, that professional liability and errors and omissions coverage is not required, and that automobile liability may be omitted where performance is fully remote or satisfied by hired and non-owned auto liability where travel is incidental. We would appreciate confirmation, and specifically whether cyber and privacy liability at $1,000,000 remains required given SEPTA's answer at Q3 that the selected proposer would not have access to personally identifiable information.
A2. See attached revised insurance requirements
2. Application of the insurance requirement to individual contract personnel. Part I, Section 1, Paragraph IV.F provides that the Proposer "and its subcontractor(s)/subconsultant(s) shall be required to provide, at their own cost and expense, the insurance required in the Contract." The RFP does not define whether individual practitioners engaged under contract to the prime, working under the prime's direction on the prime's contract, are subconsultants for the purposes of that paragraph, or whether coverage maintained by the prime that extends to work performed on its behalf satisfies the requirement.
We note that Section 24 of the Contract places the obligation on the Contractor to purchase and maintain insurance protecting against claims arising from "the Contractor's operations under the Contract, whether such operations are by itself or by any Subcontractor or by anyone directly or indirectly employed by any of them or by anyone for whose acts any of them may be liable for." That language reads as a single obligation on the prime whose coverage must reach work performed on its behalf, rather than a requirement that each individual separately procure the stated limits.
Would SEPTA please confirm that coverage maintained by the prime, extending to work performed on its behalf by personnel engaged under contract to it, satisfies Paragraph IV.F. The distinction is material to pricing, since the fully loaded hourly rates submitted under Attachment 3 must absorb the cost.
A2. All primes and subconsultants should maintain the necessary insurance requirements.
