About this file

The document provided is Addenda 1 related to a state and local contract opportunity issued by the New York State Office for People with Developmental Disabilities (OPWDD) for the Building 9D Window Glass Replacement project located at 500 Balltown Rd, Schenectady, NY. The project involves the replacement of 16 windows measuring 5'7"x1'7.75", 10 windows measuring 3'7.25"x1'7.75", and 9 windows measuring 2'9"x1'7.5". The solicitation was issued on 2/23/24 with bids due by 3/8/24 at 1PM. Attendance at the mandatory site visit scheduled for 3/1/24 at 9AM is required. The awarded vendor must confirm all measurements before ordering the windows.

The Addenda also includes an asbestos inspection report which indicated that while some window caulking contained trace amounts of asbestos, the materials were in fair condition. There are no Minority/Women-owned Business Enterprise (MWBE) goals required for this single activity project, though the overall MWBE goal for the agency is provided. Prevailing wages must be paid as this is a New York State public works project.

Building 9D Window Glass Replacement 500 Balltown Rd Schenectady, NY 12304

Solicitation Date: 2/23/24 Bid Due Date: 3/8/24 – 1PM Date of update: 3/6/24

Good afternoon, Below is the answers to questions submitted that should be considered when submitting your estimates.

1) Please provide a schedule for window replacements to include size and qty of each type.

a. The size and quantity are as follows:

i. 16 of 5’7’’x1’7.75’’

ii. 10 of 3’7.25’’x1’7.75’’

iii. 9 of 2’9’’x1’7.5’’

b. We have a schematic of the facility and the windows needing replacement. We have attached the upper floors. The right side of the schematic is the “D” wing and the area we a focusing on to replace the windows.

c. The awarded vendor must confirm measurements before ordering.

2) Are windows glazed from the interior or exterior?

a. There is no Glazing, these are aluminum insert windows or double pane windows.

3) Are there any concerns about hazardous materials (e.g. asbestos, PCB, lead)?

a. The ACM report is attached.

4) Are WMBE goals incorporated in this project? Bid docs say yes - site visit mentioned they are not. As this is a single activity, even if the awarded contractor is a WMBE, the goals noted cannot be met for all categories.

a. There is a general goal, but not required. Our overall goal is listed in the Contract Reporter Ad.

Please be sure any estimates include this information.

Please let us know if there are any questions.

Spectrum Project # 22-645

Dear Mr. Mclear:

Spectrum Environmental Associates, Inc. (Spectrum) is submitting this letter and attached documentation as our final report for the above referenced asbestos bulk sampling project.

Mr. Nate Martin (AH # 21-04856), Spectrum’s inspector of record for this project, collected six

(6) samples of suspect asbestos containing materials on December 13, 2022 as requested by

Nathan Pannone of DDSO. All of the samples were sent to AmeriSci under proper chain of custody record for asbestos analysis.

The inspection and sampling were performed in accordance with generally accepted industry practices and applicable state and federal regulations including, but not limited to; NYS-DOL

Industrial Code Rule 56, USEPA – Title 40 CFR Part 763 “AHERA”, USEPA Title 40 CFR Part

61 “NESHAP” and OSHA – Title 29 CFR Part 1926.1101 “Construction Standard”. The bulk samples were analyzed by an independent laboratory approved by the New York State

Department of Health (NYS-DOH) Environmental Laboratory Approval Program (ELAP).

According to USEPA and New York State Department of Labor - Industrial Code Rule 56 (NYS

ICR 56) an asbestos containing material contains more than one percent (1%) of asbestos by weight. Analytical results indicating less than 1% or a “trace” means the material may be treated as non-asbestos. OSHA does require that an employer not expose its workers above the PEL and therefore specific training, work practices and/or respiratory protection may need to be consideration when handling materials that are less than one percent.

In the attached table, results are provided of the materials requested to be sampled. Any other materials that may be disturbed should be assumed to contain asbestos until properly assessed and/or sampled in accordance with applicable regulations.

Limitations:

The following limitation/conditions were noted as part of the survey:

OSHA requires that an employer not expose its workers above the PEL and therefore specific training, work practices and/or respiratory protection may need to be a consideration when handling materials that are less than one percent.

The sampling was limited to the request material(s) and location(s) by the client.

If materials not sampled in the survey are uncovered during renovation/demolition, per

ICR56 work should stop and those materials should be assessed before work continues. Also per ICR 56, a copy of the survey report should be submitted to the local agency issuing the demolition permit and a copy should be kept on site during the demolition phase of the project.

This report reflects the conditions found at the date and time of the inspection(s). Conditions of the area and materials may change due to external events, forces or influences. Re-inspection of the area may be required prior to the start of any work if an extended period of time has passed or if disturbances have occurred.

All asbestos locations on drawings are approximate. All quantities are estimated and must be field verified prior to use as part of a bidding document. Materials may extend or be hidden behind or within other materials or structural members. Any contractor or other user of this report is required to physically confirm the quantities and verify measurements of materials to be removed, to be bid for removal, or for any other purpose. Contractors are responsible to physically visit the site and confirm all quantities for bidding purposes.

Sample Summary Table

Quantities of identified ACM are estimates only and should be field verified prior to bid by the contractor or confirmed as part of an RFP or design specification. Please see the limitation listed above.

*NAD/NSD =no asbestos detected; NA =not analyzed; NA/PS=not analyzed/positive stop, (SOF-V) = Sprayed On Fireproofing containing Vermiculite;

(SM-V) = Surfacing Material containing Vermiculite; PLM Bulk Asbestos Analysis using Leicia, Model DMEP Pol Scope, Microscope, Serial #: 13595, by Appd E to Subpt E, 40 CFR 763 quantified by either CVES or 400 pt ct as noted for each analysis (NVLAP 200546-0), ELAP PLM Method 198.1 for NY friable samples, which includes the identification and quantitation of vermiculite, or ELAP 198.6 for NOB samples, or EPA 400 pt ct by EPA 600- M4-82-020 (NY ELAP Lab 11480); Note:PLM is not consistently reliable in detecting asbestos in floor coverings and similar non-friable organically bound materials. NAD or Trace results by PLM are inconclusive, TEM is currently the only method that can be used to determine if this material can be considered or treated as non asbestos-containing in NY State (also see EPA Advisory for floor tile, FR 59,146,38970,8/1/94) National Institute of Standards and Technology Accreditation requirements mandate that this report must not be reproduced except in full without the approval of the lab. This PLM report relates ONLY to the items tested.
