The contractor shall be responsible for providing proper disposal of all items collected, including obtaining and paying for dump-fill privileges, if necessary.

III. Frequency of Trash Removal

B. Containers provided to the Approval and Certification Center under this contract must be void of broken lids, rust, sharp edges, damaged wheels, or otherwise damaged. If such damage or wear should occur, the containers are to be repaired to original-like condition or replaced.

C. Once trash is emptied, containers must be placed upright and in aligned position (not scattered from designated loading point or toppled on grounds or driveways).

V. Environmental Requirements The contractor shall be required to dispose of rubbish in a manner that will not cause conditions detrimental to the public health or constitute a health hazard. The contractor will assume full responsibility for compliance with all Federal, State, City, and County laws, rules and regulations governing the removal of waste materials.

VI. Compression of Rubbish The contents of each rubbish container will be compressed by Government contract personnel as tightly as may be possible without the application of mechanical force. Most rubbish will be in plastic bags. Also, shredded paper placed in dumpsters will be in plastic bags and secured.

VII. Failure to Perform If the contractor fails to make pickups as scheduled or described herein, it is agreed that the Government is authorized to make arrangements to remove the rubbish or perform associated tasks; such as, cleanup after pickup. Costs of such arrangements will be charged to the contractor. The Center’s maintenance crew will maintain a record of time used to clean up spillage left by the contractor.

Contractor’s Liability The contractor is responsible for all costs associated with repairs of damages to the Center’s facilities and grounds caused by contractor-owned vehicles or contractor-employed personnel. If contractor response to reports of damage is not received by the Contracting Officer’s Representative at the Approval and Certification Center, the Government reserves the right to deduct costs incurred by the Mine Safety and Health Administration from the monthly payment to the contractor.
