Section SF 1449 - CONTINUATION SHEET
SCOPE OF WORK
North Lake Gap Planting on the Upper Mississippi River near Prairie Island, MN
1. BACKGROUND
This statement of work describes a tree planting targeting canopy gaps and multiple option years of spot spraying and plantskydd application on areas totaling approximately 10 acres within a 378 acre stand on US Army Corps of Engineers (COE) owned l and near Prairie Island, MN.
Services to be rendered include mapping out canopy gaps and providing GPS coordinates to the center of the gaps, use of herbicide to control reed canarygrass (Phalaris arundinacea) and other herbaceous vegetation, planting bareroot tree seedlings and additional spot spraying around tree seedlings and applying Plantskydd on planted seedlings. The contract will be awarded as a base year plus two option years.
1.1. SITE DESCRIPTION
The project area is located on the Upper Mississippi River in Pool 3 on the right descending bank between River Miles 803 and 802. The project area can only be accessed by boat. The best way to access the area is to launch a boat from the Diamond Bluff, WI public boat landing and travel approximately 3 miles north on the main channel. Approximate coordinates of the center of the project area are located at 92°40'42.09"W, 44°40'07.82"N. Canopy gap planting as part of this contract will be conducted on approximately 10 acres of the larger 378 acre North Lake forest stand. Vicinity and site specific maps are attached.
1.1.1. North Lake, Forest Stand P03C04U004
This project area is dominated by large, over mature silver maple (Acer saccharinum) and cottonwood (Populus deltoides). Elevation is highest along the main channel to the east, and canopy cover is also the densest in this area. Generally, elevations slowly decrease to the west, transitioning into marsh east of the project area. Two main secondary channels bisect the project area and elevations along these channels are slightly higher than the surrounding area. Hackberry (Celtis occidentalis) and American elm (Ulmus americana) are prevalent in some areas in the center of the project. There are many canopy gaps within the stand that are dominated by reed canarygrass (Phalaris arundinacea).
PRESCRIPTIONS
Identify Canopy Gaps and Provide Coordinates The contractor shall identify canopy gaps within the North Lake forest stand that total 10 acres.
A canopy gap is defined as any area within the forested matrix that is devoid of trees but completely surrounded by forest. Gaps should be between 0.25 ac. and 2 ac. in size, and no narrower than 66 feet from tree canopy edge to canopy edge. Gaps closer to the main channel edge, in higher elevation areas, are preferred to gaps in lower elevation areas. Natural regeneration (silver maple or cottonwood) may be present in these gaps. If natural regen is established throughout the gap (average of 2,000 stems/ac. of native tree species greater than 1 ft.
tall), the contractor shall designate this while identifying the gaps. Gaps classified as having established natural regeneration will have different treatments than gaps without natural regeneration (section 1.2.1.2 and 1.2.1.3 below).
A coordinate shall be taken in the middle of the gap and a boundary for each gap shall be delineated with a GPS unit in the field. The contractor shall calculate total gap area across all identified gaps using GIS or other appropriate tools; the gap area should equal approximately 10 acres (+/- 0.5 ac). The coordinates for the gap centers shall be provided to the government for review in either a degree decimal format or UTM (NAD 1983, Zone 15N, Meters) and provided to the government review. Coordinates may be provided in either text format, Google Earth kmz format, or an Arc GIS format (.shp or.gdb). Gap polygons may be provided either as a hand-drawn map over an aerial photo or as Google Earth (.kmz) or Arc GIS (.shp or .gdb) polygons.
After the identified canopy gaps have been reviewed and approved by the Government, the contractor can proceed with the rest of the contract.
Apply Herbicide within the Canopy Gaps Each gap identified shall be broadcast sprayed twice in the first year with a broad spectrum herbicide to combat reed canarygrass and other competing vegetation for site prep. The herbicide shall be labeled for use in aquatic areas or areas with standing water. If established natural regeneration is present in the gap (silver maple or cottonwood), the contractor shall spray only half of the gap area with smaller sprayed blocks scattered throughout the area where natural regeneration is lowest. In this case, the sprayed block should be approximately 36 x 36 feet, with 15 sprayed blocks per acre.
Herbicide application shall be conducted by hand with backpack sprayers.
Tree Planting within the Canopy Gaps The contractor shall have the option of planting in the fall or spring at a stem density of 500 stems/acre and on an approximately 9 x 9 foot spacing (+/- 2 ft). A total of 5,000 tree seedlings will be planted across all gaps. Prior to being planted, seedlings shall be dipped in Plantskydd deer repellant according to manufacturer instructions. Below is a table of tree seedling species and quantities.
Tree Species Target seedling height1

Bur oak (Quercus macrocarpa) >24” 12” 3/8” 1,250
Silver maple (Acer saccharinum) >24” 12” 3/8” 1,250
1 At least 40% of seedlings must be >24” tall 2 At least 50% of seedlings must have a 3/8” or larger root collar diameter
Tree seedling supply, storage, handling and planting
Quality hardwood tree seedlings often have large root systems, and stems may be as large as 2-3 feet tall. Large seedling size shall be accounted for in determining planting tools to use.
The contractor shall be responsible for acquisition of tree seedlings, and shall provide the government with an invoice detailing the seedling order at least two months prior to initiation of planting. If seedlings are acquired by the contractor but, due to circumstances outside of the contractor’s control the seedlings cannot be planted, the Government will be responsible for the cost of the seedlings.
Seedlings shall be of the species and quantities listed below. A +/- 10% variance is allowed for the total number of seedlings from any species without requiring authorization from the government. In the event that species are not available, the contractor may substitute for the number of stems of up to 2 species by increasing the total number of stems of another species on the list to equal the stems required for the substituted species. The contractor shall inform the government of this change but is not required to receive authorization. Substitutions of more than two species, or the addition of species not currently on the list, shall receive prior written authorization from the government.
Large, vigorous seedlings are critical for planting success in the floodplain. Thus, a minimum of 60% of the planted seedlings shall be greater than two feet tall. Of the remaining 40%, no seedlings shall be less than 1 foot tall. A minimum of 50% of seedlings shall have a root collar diameter of 3/8 inches or larger.
Seedlings may be root pruned at the time of planting to down to a minimum of 12 inches, measured from the root collar. First order lateral roots shall not be removed in this process but may be trimmed back.
All seedlings shall be of native stock and no cultivars shall be planted unless specifically listed in the table below. Seed for seedlings shall have been sourced from USDA Forest Service Eastern Seed Zones 22 or 231, and the nurseries from which the contractor procures seedlings must verify that the seed origin is within these seed zones. The contractor shall not substitute species or stock types without written approval from the Contracting Officer.
The Government reserves the right to refuse seedlings not meeting the standards describe above, requiring the contractor to procure replacement seedlings at no cost to the government. The Government also reserves the right to assess a payment penalty upon a quality assessment of planted seedlings that falls below the thresholds described herein.
All seedlings shall be handled and stored in an appropriate manner to minimize seedling stress prior to outplanting. Seedlings shall be kept in a cooler at or below 40 degrees F until the day of planting. In no case shall seedlings be kept outside of cold storage for more than two days (48 hours). In the field, seedlings shall be stored in full shade with roots well moistened. Prior to planting, trees shall be treated with PlantSkydd deer repellant. Trees shall be stored in planting bags or other containers to prevent desiccation of roots while being transported to individual planting locations. Trees shall not be held outside of a container for more than one minute. The government reserves the right to inspect the operation at time of planting and may levy a payment penalty up to and including the total cost of seedling acquisition and planting for

The government also reserves the right to stop planting operations at any time that it determines that these guidelines are not being followed.
The Contractor shall prepare a planting hole or slit that is wide enough to fully suspend the roots of the plant material. The Contractor shall suspend the root system near the center of the planting hole or slit, with roots in a near –natural arrangement, at a depth at which the top of the root system is covered by approximately one inch of top soil after filling, packing and leveling. A “near-natural arrangement” means that roots approximate the position they would have when growing in nature or in the nursery, and are not twisted, tangled, compacted, curled, or bent relative to a position that is perpendicular to the ground surface. Root collars shall not be visible but shall be below the soil surface. Each plant shall be set firmly in the ground, with moist soil filled in and placed firmly around the roots. The Contractor shall level the soil near the plant after planting and firming so there are no depressions or mounds near the stem.
The Government Inspector may also specify where certain plant species or associations of plant species are to be planted within the project area. Plant material planted in inappropriate places will be subject to rejection by the Government Inspector during inspections.
The Contracting Officer may suspend planting work if weather conditions could damage plant material, even if the material is handled in accordance with this agreement. The Contracting Officer may also suspend planting work at any time if the Contracting Officer determines that the contractor is not handling plants or planting in accordance with this agreement.
Excess and waste material shall be removed and properly disposed of off-site. Areas that have been damaged by planting operations shall be restored to original condition at the Contractor’s expense.
Quality Assessment Tree planting shall be considered acceptable if the following are true:
- 95% of Government sampled planted trees are > 1 foot tall, and, of those, 60% are > 2 feet tall
- 50% of seedlings have a root collar diameter of at least 3/8 inches
- 95% of Government sampled planted trees are within +/- 2 feet of target spacing
- Percent of trees of each species within Government samples is within +/- 10% of the target above, unless a wider variation has been approved by the Government
- 95% of trees stay in the ground following the “tug test” (a light pull on the seedling does not dislodge it from the ground), with no roots or root collar visible at the soil surface Up to 5% of planted seedlings will be sampled in initial quality assessments by the government.
If, based on the initial sample, planting quality appears to be below contract standards, an additional 5% will be sample to reach a total of a 10% sample (240 seedlings). Any performance penalties will be assessed on the proportions of seedlings falling outside of specifications in the 10% sample; this proportion will be assumed to be representative of the planting as a whole and may be applied to the entire pay request associated with the quality assessment.
Spot Spraying Planted Seedlings One follow-up herbicide application will be implemented in June of 2021, 2022 and 2023 with spot spraying around each planted seedling. A spot will be considered to be adequately sprayed if there is a 2 foot diameter weed free patch around the seedling. The seedling shall be protected while a broad spectrum from drift while herbicide is being applied; a payment penalty may be assessed if more than 5% of seedlings show signs of herbicide injury.
Herbicide application shall be conducted by hand with backpack sprayers.
Plantskydd Application on Planted Seedlings One application of Plantskydd deer repellant will be implemented in from May 15-June 30 of 2021, 2022. Plantskydd should be applied in a liquid mixture from a backpack sprayer according to the manufacturer’s instructions for hardwood seedlings.
Treatment Schedule Treatments must be completed within time windows that will maximize treatment effectiveness.
Begin and End Dates for each treatment in each area and in the Base and Option Years are provided in the Bid Schedule Items table in Error! Reference source not found. below. No treatments may begin prior to the Begin Date and all treatments must be completed by the End Date for any given area. The contractor may select any date between those two dates to perform work, given that site conditions are appropriate and that the Government has given approval to proceed. In addition, upon contract award, the contractor shall submit to the Government point of contact (POC, Section 2 below) a tentative work schedule for the contract period. The Contractor submitted work schedule is not binding and may be updated as needed, but is intended to allow the Government to plan according to the contractor’s work schedule. The Contractor’s tentative work schedule shall in no way supersede the Begin and End Dates provided in this contract.
MEASUREMENT AND PAYMENT
Payment for this work will be based on the bid schedule below. Acreage provided by the Government in this solicitation are Government estimates only, based on GIS area calculations.
The Contractor may submit invoice(s) for payment when each work ITEM listed below has been completed. Payment on this contract will be based on the Contract Line Items (CLINS) and only for the total amounts for each CLIN. Following the completion of each CLIN, the Contractor may submit an invoice for payment with the exception of the tree seedling purchase. The tree seedling purchase invoice must be submitted along with the respective tree planting invoices once all planting is completed. A copy of the nursery receipt must be submitted for any purchased plant material.

HERBICIDE
Herbicide Plan The Contractor shall submit a general written plan that addresses their recommended herbicides, application rates, timing, and spray methods proposed to achieve the contract goal of vegetation control at the management area, target pest and reason for choice as part of their quote. Only herbicide formulations in the Government list (Attachment 02) and approved for use in wetlands shall be used; if the contractor wishes to use an alternative herbicide, a request shall be made to the Government POC no less than twenty (20) business days prior to anticipated application. The request will require submission for environmental review and the contractor shall not assume that approval will be granted. If appropriate, surfactants shall be added per label instructions to appropriate herbicide mixtures. All carriers and adjuvants shall be non-toxic.
The herbicide plan shall detail the carriers, adjuvants and surfactants to be used. Also include application rates, where mixing will occur, and plans for environmental protection if mixing is to occur on government property. EPA product labels and material safety data sheets (MSDSs) for all proposed products (website links are acceptable) shall be submitted with the herbicide plan.
The Government POC must receive submission of this plan a minimum of five (5) working days in advance of the desired application date. The request will be reviewed, considering as a minimum, for relative effectiveness and toxicity. The contractor shall also submit a tentative application schedule to the contracting officer a minimum of five (5) working days prior to initiating any work on this contract.
All treatments shall be conducted during a period when target species are susceptible to the herbicide being used. All herbicides used shall be labeled for application in aquatic areas. No broadcast spraying shall be performed when wind speeds exceed specifications listed on the herbicide label, or wind directions are likely to result in drift to surface water or non-project lands. To protect groundwater resources, herbicide applications shall not be allowed prior to precipitation that could facilitate rapid leaching of herbicide to the water table. At a minimum, herbicide(s) shall not be applied when the forecast indicates a high probability of significant precipitation during the next 24 hours. The Contracting Officer shall have the right to make these determinations and terminate any planned herbicide applications based on available weather forecasts and current conditions. Additionally, excessively dry conditions that can negatively affect herbicide performance shall also be avoided. The Contractor is to notify the Government POC of any planned herbicide applications and receive prior approval before completing the planned application.
Herbicides shall be applied to the project areas in accordance with the weed control goals stated above. The Contractor shall take particular care to not exceed per acre limits according to the product label for basal bark applications.
Licensing The Contractor, all of their employees, any subcontractors or other individuals performing herbicide work under this contract shall possess a valid state commercial herbicide applicator's license with certification in the appropriate categories for Minnesota, (or have completed requirements necessary for license reciprocity in Minnesota) and shall comply with all Federal, State, and local laws and regulations applicable to the contract work and to the products and materials used by the Contractor in performing that work. Contractors shall submit with their quote a list of anticipated pesticide applicators in their employ and a copy of the applicable credentials for each individual. Additional individuals may be added to this list after contract award upon receipt of their applicator’s credential. A least one individual must be in the employ of the Contractor upon submission of quote with the proper credentials; a quote that does not include documentation of a licensed applicator will not be considered a complete quote.
Department of Labor as well as state regulations regarding employment of youth shall be observed.
EPA Registration Label All work shall be performed in accordance with the instructions on the EPA registration label of the chemical herbicide used. All safety instructions featured on the label shall be strictly adhered to.
2.1. Post-Application Documentation
The Contractor shall submit completed copies of the ‘Post-Application Documentation Form’ for each day’s herbicide work and for each herbicide used. A sample form is provided in Attachment 03 and may be reproduced. The Contractor may use his or her own form if it contains all information included on the Corps form. Scanned or digital copies of this form may be submitted electronically or hard copies may be mailed to the address of the government POC within five working days of each application or at the time of invoice submission, whichever is earlier. No payment will be made for services until post-application documentation has been supplied to the Government POC.
2.2. Herbicide Warranty
The Contractor shall exercise his/her professional judgment as to the application rate, time and extent of application of the herbicides. The Contractor warrants that:
Should the desired results not be achieved, the Contractor will, at no additional cost to the Government, reapply the herbicide to those areas where targeted vegetative growth continues or recurs. The determination as to the acceptable performance of the Contractor and the need to reapply the herbicides will rest solely with the Contracting Officer. If performance is determined to be unacceptable, the Government may require re-treatment of an area. If the Government determines that re-treatment will be required, written notice will be provided to the contractor by email. Treatments will be considered effective if 90% of stems in Government Quality
Assurance (QA) plots show evidence of the treatment prescribed for the area in section 0 above.
2.3. Site Restoration
The Contractor shall be responsible for restoring any area that does not satisfy the warranty requirements at no additional cost to the Government. Areas will be retreated within the time specified by the Contracting Officer’s or Government POC’s notice to the Contractor. The Contractor is responsible for damages to persons or property, including unreasonable or unnecessary damages to non-target vegetation, within and outside the treatment areas resulting from the performance of the contract work. Reseeding of non-target native vegetation damaged in this way may be necessary and will be at the Contractor’s expense. Excess and waste material shall be removed and properly disposed of off-site. Areas that have been damaged by spraying operations shall be restored to original condition at the Contractor’s expense.
Material Safety Data Sheets The Contractor shall make MSDSs for all herbicides, adjuvants and other products used at the site readily available to all affected contract employees.
ENVIRONMENTAL PROTECTION
Should a spill of petroleum, pesticide, or other contaminant occur, the Contractor's immediate response shall be to proceed with measures to limit the further spread of contamination.
Immediately following this initial response, the Contractor shall notify the local Fire Department, Contracting Officer, and appropriate local, state, and federal officials. This may include the National Response Center (1-800-424-8802) if a reportable quantity is released to the environment. The appropriate state official is the Department of Public Safety Duty Officer. The Minnesota Duty Officer can be reached at 1-800-422-0798. There is someone on duty at this number 24 hours a day.
Subsequent to these actions, the Contractor shall take actions to clean up the spill as recommended by the Contracting Officer and at no cost to the government. Should a personnel contamination occur, the Contractor shall take immediate actions as prescribed by chemical manufacturer so as to protect the safety and health of the contaminated individual(s).
SAFETY
Notwithstanding any other provisions of this contract, the Contractor shall comply with all safety and health requirements as outlined in the Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1) and OSHA Safety Standards to ensure the safe working conditions for his employees and government workers. CLAUSES INCORPORATED BY FULL TEXT
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JUN 2020)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.
Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids).
