About this file
This is a Justification and Approval for Other Than Full and Open Competition (JOFOC) form issued by the U.S. Fish and Wildlife Service (FWS) for a sole source procurement action exceeding the Simplified Acquisition Threshold (SAT). The contracting activity is the U.S. Department of the Interior, FWS, Joint Administrative Operations, Acquisition & Property Operations, Fish and Aquatic Conservation, Midwest Region. The procurement seeks a new fixed-price contract valued at $269,302.00 (including shipping and handling) for 350 acoustic telemetry tags with predation sensors operating on a 69 kHz frequency using proprietary Innovasea receivers, along with consumable hardware for receiver deployments and recovery. The tags are intended for three offices conducting a single-year study to monitor survival and movement of stocked fish, including predation by other fish throughout the Great Lakes, with delivery scheduled for April 1st, May 1st, and requests from the contracting office. The statutory authority cited is 41 U.S.C. 3304(a)(1) under FAR 6.302-1, identifying this as a "only one responsible source and no other supplies or services will satisfy agency requirements" scenario.
The justification asserts that due to the proprietary nature of acoustic telemetry equipment and compatibility constraints with existing FWS deployments, no other companies can provide equivalent equipment without interfering with already-deployed field work. The document notes that efforts to maximize competition were limited by equipment incompatibility, and actions to remove barriers to competition acknowledge the proprietary nature of the Innovasea system. The form includes certification by Program/Project Officer Dimitry Gorsky (dated February 9, 2026) and requires approval signatures from the Contracting Officer, Chief of Contracting Office, Acquisition & Property Operations Chief, and Bureau Procurement Chief. The $269,302 value exceeds the $700,000 threshold, requiring additional approvals as specified in the form structure.

Text3: This request is for 350 acoustic telemetry tags with predation sensors. These tags operate on a 69Khz frequency using proprietary coding used by Innovasea receivers. These tags will be delivered based on requesting office, on April 1st, April 20th, and May 1st. These tags are needed to observe survival and movement of stocked fish including predation by other fish. These tags only work on receivers that are already in hand and deployed throughout the Great Lakes. IN addition to the tags, we are requesting consumable hardware for the receiver deployments and recovery.
Text4: (Include a discussion of the government’s minimum requirements and how the nature of the acquisition requires the use of the authority cited above. Also identify the unique aspects of the supply/service that necessitate a noncompetitive action. If applicable, also describe how the required delivery/performance date impacted the decision to restrict competition.)
(Identify the proposed sole source contractor and discuss the unique capabilities, experience, expertise, etc. that the contractor has that makes the firm the only one capable of performing the required work. For example, when FAR 6.302-1 is cited, identify the existence of proprietary data, copyrighted information, or a patent which restricts competition; or when FAR 6.302-1 is cited for follow-on acquisitions as described in FAR 6.302-1(a)(2)(ii), explain the solicitation history of the original order, provide an estimate of the cost to the Government that would be duplicated and how the estimate was derived, supply rationale for unacceptable delays, discuss why the requirement continues, discuss why it would be beneficial to the Government for the specific contractor to continue work, and specify how recent the previous competitive order was and the number of times this exception has been used. You must clearly show that your source is the ONLY source. When FAR 6.302-2 is cited, explain the urgent need and why the delays would be unacceptable. Include the required delivery schedule and lead-times involved. If the required delivery date could have been satisfied using competition to the maximum extent on the date the requirement first became known, an explanation for the delay in submitting the requirement should be provided. Also provide data, estimated cost or other rationale as to the nature and extent of the potential injury to the government. If normal contracting methods could not have satisfied the required delivery date, describe the circumstances that caused this emergency and how they will be mitigated in the future.)
Text5: Due to the nature of the acoustic telemetry technology and the equipment being utilized by our office, and many other FWCOs, there are no other companies capable of providing this equipment. Use of other brands of equipment would be incompatible with our existing equipment it may interfere with equipment already deployed for existing field work.
Text6: (Include a statement by the contracting officer that the anticipated cost will be considered fair and reasonable and provide the basis used for this determination. Examples may include the results of the restricted competition, comparison of proposed costs/prices with costs/prices for similar supplies or services, commercial price lists, prior acquisition history, technical evaluations, and audit of vendor costs. Cite appropriate FAR price analysis techniques at FAR 15.404-1(b)(2) and how they would be used or were used. The paragraph should being with a sentence similar to: “The contracting officer determines that the anticipated price/cost will be fair and reasonable based on…”)
Text7: (See FAR Part 10 and DIAR 1406.303-70. Research must have been meaningful and conducted within the past 12 months. Market research should answer the questions to who, what, when, where, why, and state the outcome of the market research. The discussion should include the type of market research conducted, who conducted it, when it was done, who responded and the results. The research should fully analyze the alternative strategies to a single source procurement. This analysis should indicate that a good faith effort was made to consider what could be done to increase the level of competition, if not for the current requirement, then for the future. If no market research was conducted, include a statement explaining the reasons why. Attach supporting documents of the market research performed and the data found, that is referenced in the preceding narrative.)
Text8: (Provide any other supporting facts to justify the non-competitive action. For example, if technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed, or are not available, explain why; When “only one responsible source and no other supplies or services will satisfy the agency requirements” is cited for a follow-on procurement as described in FAR 6.302-1(a)(2)(ii)(A), provide an estimate of the cost to the Government that would be duplicative and how the estimate was derived and if ‘unusual and compelling urgency’ is cited, provide data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.)
Text9: (Provide a listing of the sources, if any, which expressed, in writing, an interest in the procurement.)
Text10: The proprietary nature of acoustic telemetry equipment and the importance of compatibility with our existing equipment prevents use of other brands.
Text2: Approval is being requested for a new fixed price contract. This contract is for Innovasea acoustic telemetry tags and consumable supplies for three offices working on a single year of study. The estimated fixed price of this contract is $269,302.00. This includes shipping and handling fees.
