About this file

This justification and approval document outlines a sole source procurement by the National Park Service Pacific West Region for 292 VHF portable land mobile radios from an incumbent vendor. The radios are needed to support existing P25 land mobile radio systems used by individuals to communicate. Maintaining the existing vendor avoids additional technical training and support costs given past investments. The anticipated $499,328.76 contract also ensures cloning compatibility with radios used by the National Interagency Fire Center for wildland fire operations. Market research found the incumbent's price to be 36% below GSA schedule. Approval was granted on September 14, 2022.

The related federal contract opportunity shows a contract was awarded on September 20, 2022 to an unknown vendor for an unknown amount under solicitation 140P8422Q0161 for the portable radio replacement requirement. The sole source justification was cited. The Department of the Interior National Park Service Pacific West Region is the contracting agency.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

Over SAT (FAR 6.303-2)

PR Number: 40596424

1. Identification of the Agency and the Contracting Activity: NPS-PWR-PORE MABO

2. Nature and/or Description of the Action Being Approved: Sole Source Justification

3. A Description of the Supplies or Services Required to Meet the Agency’s Needs, Including the Estimated Value: Purchase of 292 VHF Portable Land Mobile Radios for users/individuals to utilize for communicating on existing P25 Land Mobile Radio Systems. This procurement has an estimated value of $499,328.76.

4. An Identification of the Statutory Authority Permitting Other Than Full and Open Competition:

FAR 13.501(a)(ii) sole source justification, prepared using the format at FAR 6.303-2, modified to reflect that the procedures in FAR 13.5 were used in accordance with 41 U.S.C 1901 and 41 USC 3304(a)(1).

5. A Demonstration That the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited: The Telecommunications Shops at Olympic, Sequoia, and Kings Canyon National Parks are responsible for performing maintenance, repair, and programming of all park radios. As such, a substantial commitment to BK TECHNOLOGIES KNG series product has occurred over the last decade by various park units supported by the SEKI Telecommunications Shop.

In keeping with the procurement of a brand that the PWR Telecommunications Shops are already set up to maintain this purchase avoids additional costs for technical training, spare parts, or programming software/cables required to support the BK TECHNOLOGIES brand of radios.

The National Park Service (NPS) also requires the ability to “clone” or field program LMR equipment from other field equipment during incident response scenarios. This requirement comes from a need to rapidly change radio programming during emergency and non-emergency situations where qualified technical personnel may not be available to program a non-clone able radio. Other vendors either do not support this requirement or do so at far greater cost, therefore BK TECHNOLOGIES remains the most cost-effective vendor to meet this requirement.

Additionally, due to Wildland Fire operational needs, NPS requires cloning compatibility with the radio cache maintained by the National Interagency Fire Center (NIFC) based in Boise, ID. This radio cache consists exclusively of BK TECHNOLOGIES products. Radio programming methods and data are unique to a given suppliers product line. At present it is not possible to clone radios between multiple manufacturers. Therefore, the NPS requires the product of a single manufacturer.

6. A Description of Efforts Made to Ensure That Offers Are Solicited From as Many Potential Sources as is Practicable, Including Whether a Notice Was or Will Be Publicized as Required by FAR Subpart 5.2 and, If Not, Which Exception Under FAR 5.202 Applies: A notice will be publicized using the GPE.

7. A Determination By the contracting officer That the Anticipated Cost to the Government Will Be Fair and Reasonable: The DOI pricing for the BKR5000-T3BS-0 radio, purchased directly from the manufacturer, is 36% less than GSA. In accordance with FAR 8.404(d), GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable.

8. A Description of the Market Research Conducted (see FAR Part 10) and the Results or a Statement of the Reason Market Research Was Not Conducted: Market research was conducted only for purposes of price comparison.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition (see FAR 6.302- 2 (9) (i) – (iii) for some examples): n/a

10. A Listing of the Sources, If Any, That Expressed in Writing, an Interest in the Acquisition: n/a

11. A Statement of the Actions, If Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required: NPS radio managers perform ongoing market research to determine the capabilities of the products from various radio manufacturers.
