Test Well

Offerors are required to submit an offer that conforms to the Solicitation with pricing for Contract Price Schedule’s Base Line Items and all Option line items - failure to do so may render the offer non-responsive.

On lump-sum price items, provide total cost only; on unit price items, provide the unit price and the extended amount of total price for the item. If no price item exists for a portion of the work, include the costs in a related price item. In case of error in extension of prices, unit price governs. In case of error in summation, the total of the corrected price item amount governs. Round totals and extend prices to whole dollars. The Government reserves the right to award any or no options at or after the time of the award as detailed in the Solicitation. Pricing will be evaluated based on what is determined to be the best value to the Government. Options may be exercised in any combination, order, or grouping deemed in the judgement of the Contracting Officer to offer the best value to the Government.

Price award will be made based upon the following equation.

SUMMARY OF WORK

SECTION 01 11 00

PART 1 GENERAL

1 .1 DESCRIPTION

A. The work of this contract consists of, in general, the construction of a test well. The work related to this test well will be comprised of drilling for and setting temporary conductor casing; drilling a borehole to an anticipated depth of approximately 260 feet below land surface; installing 40 lineal feet of nominal 8-inch stainless steel shutter well screen (to include a 10-foot sump section for a total length of approximately 50 feet) with gravel-pack; installing approximately 190 lineal feet of nominal 8-inch diameter PVC water well casing with formation stabilizer; installing approximately13 lineal feet of nominal 8-inch steel water well casing; installing 60 linear feet of surface seal material in the annular space around the permanent well casing; well development, conducting a step-drawdown pumping test consisting of three steps (anticipated total duration 16 hours with the maximum pumping rate at 150 gpm); conducting recovery test; conducting a video inspection log of the completed test well, disinfecting the completed test well, and securing the well head at the completion of the work.

B. The description of the work of this contract in 1.1.A above is a summary of the work and is not intended to provide a detailed and exhaustive description of all aspects of the entirety of the work.

For the complete and comprehensive description of the work all documents pertaining to the Contract Documents must be collectively taken into account.

C. All work will be performed under a single contract.

1 .2 LOCATION

A. The test well will be constructed on BLM land at a location approximately 1,000 lineal feet west of the northwest boundary of Manzanar National Historic Site located in Inyo County, California.

Manzanar National Historic Site is located on the west side of California State Highway 395 and is approximately 6 miles southeast of Independence, California.

B. Access to the project coming off of HWY 395 will be on unimproved road surfaces on BLM land.

At the exit from HWY 395 to the paved frontage road to the west side of HWY 395 the access route follows this paved frontage road to the northwest approximately two tenths of a mile where there is an intersection with an unimproved road (i.e. dirt road) that runs to the southwest from the paved frontage road providing access to the BLM land. The access route follows this unimproved road to the west approximately nine tenths of a mile at which point the access route crosses a cattleguard and follows the unimproved road continuing in a general westerly direction until this unimproved road tees into an unimproved road running generally along a north-south alignment.

At this tee the access route follows the unimproved road going in a generally southward direction approximately three tenths of a mile until reaching an intersection with a another unimproved road running generally along an east-west alignment. At this intersection the access route follows the unimproved road in the general easterly direction approximately 180 feet to the location where the test well will be drilled. The specific location where the test well is to be drilled will be marked by the NPS as well as the limits of the work site.

1 .3 CONTRACTOR'S USE OF PREMISES

A. Construction Camp: Establishment of a camp within the park will not be permitted.

B. Contractor must at all times conduct their operations to ensure the least inconvenience to the public.

C. Confine storage of materials and equipment to areas designated by the Contracting Officer within the limits of the designated area for materials and equipment storage within the project site.

D. Preservation of Natural Features: Confine all work operations to within the work limits of the project that consist of previously disturbed areas that the government will delineate. Prevent damage to natural surroundings of the BLM designated Area of Critical Environmental Concern (ACEC.) The contractor will be held responsible for Restoring and damaged areas of the ACEC outside of the delineated work limits, repairing or replacing damaged plants and terrain, at no additional expense to the Government.

1. Provide temporary barriers to protect existing plants and undisturbed terrain pertaining to the BLM’s ACEC bordering the designated work limits of the project.

2. Do not remove, injure, or destroy plants outside of the delineated work limits. The contractor must limit their movement to only those previously disturbed areas within the delineated work limits of the project.

3. Contain all work materials to prevent their release onto the ground. Contain all fuel and lubricants to prevent their release onto the ground. The contractor will be responsible for restoring any ground where work materials (drilling mud, surfactants, drilling cuttings) or fuel, oil, or lubricants are released onto and/or into the ground.

E. Existing Utilities: There are no active existing utilities (neither above ground or below ground) located within the work site.

F. Hauling Restrictions: Comply with all legal load restrictions in the hauling of materials. Load restrictions on BLM and NPS (aka Park) roads are identical to the state load restrictions with such additional regulations as may be imposed by the BLM and/or Park Superintendent. Information regarding rules and regulations for vehicular traffic on BLM and Park roads may be obtained from the BLM and/or Office of the Park Superintendent. A special permit will not relieve Contractor of liability for damage which may result from moving of equipment.

1 .4 SPECIAL CONSTRUCTION REQUIREMENTS

A. Because the test well work site (aka project site or work site) is situated within a BLM designated Area of Critical Environmental Concern (ACEC) the following are not available at the project site: water service, sewer service, electrical service, land line telephone service. The availability of cellular telephone service at the project site is unknown. The contractor is responsible for making the necessary arrangements to have drinking water, construction water, electrical power, toilet facilities, communication services available at the project site.

B. Holiday Work Restrictions: No on-site work will be performed during weekends (Saturday and Sunday) and federal holidays unless otherwise approved by the Contracting Officer. The

MANZ 216059 Test Well 01 11 00-3 contractor must submit a written request to the Contracting Office a minimum of 10 work days in advance of the date(s) for which the contractor is seeking approval to work on.

1 .5 FIELD VERIFICATION

A. Field verify all new and existing dimensions affecting the work of this contract before ordering products.

1 .6 CONSTRUCTION MATERIALS

A. The Government will furnish:

1. Water level transducer for use during the pumping test

2. Data logger and associated connectors for use during the pumping test

B. All other materials will be Contractor-furnished and installed.

CONTRACT MODIFICATION PROCEDURES

SECTION 01 26 01

PART 1 - GENERAL

1.1 SUMMARY

A. The work of this section consists of administrative and procedural requirements for contract modifications.

1.2 DEFINITIONS AND ALLOWANCES

A. Home Office Overhead: Those costs incurred in support of all of a contractor’s projects and not attributable to a specific job. The cost for home office overhead is only allowed as a percentage of all direct work excluding profit. The following items represent allowable home office overhead costs identified in Part 31 of the Federal Acquisition Regulation (FAR):

1. Rent

2. Utilities

3. Furnishings

4. Office equipment

5. Executive and management staff not exclusively assigned to the project

6. Support, accounting, and administrative staff

7. Preparation of cost proposals, estimating, and schedule analyses connected with

11. Automobile maintenance and travel costs for home office personnel

B. General Conditions (Field Office Overhead): Management and administrative costs incurred on site for the designated project. Costs associated with the preparation of modifications will not be allowed. The costs for these items are to be included only in the general conditions of the modification estimate. Only in the case of a contract time extension are additional general conditions included in modifications. The following items, if applicable, are considered allowable costs for calculating General Conditions:

C. General Requirements: These are costs directly associated with the project and are necessary to perform the actual work of the modification. These costs must be shown as direct costs in the estimate. The following items, if applicable, are considered allowable costs for calculating General Requirements:

4. Port-a-lets

5. Trash removal, dumpsters

6. Barricades

7. Small tools

8. Safety supplies

D. Personnel Costs: Costs included in the modification must only be for General Conditions, staff and workers actually present and working on the project site. Modification costs for salaried workers are only allowed within the structure of a forty (40) hour week and no overtime or holiday pay will be allowed.

1. Worker Hourly Rates are costs directly associated with the individual worker and consist of the following:

a. Base Rate: This is the hourly rate paid directly to the worker

b. Labor Burden: Employer payments of all applicable burdens, this includes insurance and taxes that the business must pay on behalf of the worker to government entities and educational forums, such as:

1) Social Security

2) Medicare

3) Workers Compensation– Policy and company calculation to be made available.

4) FUTA– Cap Rate and percentage to be proportionally allocated over one year.

5) SUTA– Cap Rate and percentage to be proportionally allocated over one year.

6) Union agreement costs – Other costs required under an enforceable collective bargaining agreement.

c. Fringe Benefits: Various non-wage compensations provided to employees such as:

1) Health Care Insurance Premiums

2) Cell Phone

3) Clothing

4) 401K and Pensions

5) Vehicle allowances

6) Gas allowance

7) Life insurance premiums

8) Disability insurance

9) Other Fringe Benefits required under an enforceable collective bargaining agreement

E. Bonuses or Deferred Compensation: No Bonus or Deferred Compensation will be allowed within any components of pricing including Home Office Overhead, General Conditions, General Requirements, Hourly Worker Rates, or the direct costs of work.

F. General Liability Insurance: An insurance policy that protects the contractor from claims resulting from bodily injury or property damage to a third party. Include this as a separate line item within all modification proposals and provide a current insurance quote upon request.

G. Performance and Payment Bonds: A performance bond is a surety bond issued by an insurance company or bank to guarantee satisfactory completion of a project. The Payment Bond guarantees that the contractor will pay the labor and material costs they have incurred. Banks and Insurance companies charge a premium for each individual project based on a sliding scale which relates to the size of the project. Include this as a separate line item in modification proposals and provide current company bonding rates upon request.

H. Builder’s Risk Insurance: This covers the contractor’s loss due to fire, high winds, or other natural forces. This is not reimbursed by the National Park Service (NPS) and will not be included in modification proposals.

1.3 MODIFICATION PROPOSAL PRICING REQUIREMENTS

A. General:

1. Your proposal must be received in the format and within the time frame specified in the Request for Proposal letter. Costs or delays resulting from failure of contractor to submit within the time frame specified will not be compensable.

2. The proposal must be detailed with itemized lists of equipment, materials, labor, production rates, overhead, profit, and bond markup for each item. Labor costs must be itemized by craft and hourly rate, including Fringe Benefits and Labor Burden. If the costs of Fringe Benefits and Labor Burden are not itemized, it is assumed that that they are included in the hourly rate shown, or contractor is not requesting reimbursement.

Contractor may utilize the government provided Contractor Estimate Form or their own form, provided that it contains the same information and level of detail as the Government provided form.

3. Requests for extensions of contract time as a result of this change must be justified with a Time Impact Analysis (TIA). Refer to Division 01 Specification, “Construction Schedule”, for time impact analysis requirements. TIA and associated costs must be received with the proposal by the date shown within the Request for Proposal letter.

Contractor’s failure to submit within the specified time frame will be construed as the Contractor waiving the right for additional time and no time extension will be allowed.

4. All supporting documentation used to justify the proposed modification will be made available to the Contracting Officer upon request.

5. Contractor must review and approve all subcontractor/supplier pricing in detail for proper format, scope, production rates, and pricing prior to submission to the NPS. All delay costs associated with not reviewing and approving subcontractor/supplier pricing will be borne by the Contractor.

6. All pricing and production rates within the estimate must be based on fair and reasonable pricing and cannot include built-in contingency.

B. Labor:

1. Contractor must estimate the cost of labor by itemizing each craft involved, indicating worker hourly rate (base rate + labor burden + fringe benefits) for each and itemizing the hours required for each craft that will be directly engaged in modification work. Any work proposed that will require overtime work or premium pay must be itemized separately. All rates must be in accordance with the Davis-Bacon Act as incorporated herein. Labor Burden may include payroll taxes, Social Security, unemployment insurances, workers compensation insurance, FICA, FUTA, and other direct costs resulting from Federal, State or local laws.

2. Itemize labor costs for equipment operators separate from equipment costs.

3. The labor cost for foremen can only be costs for related work required for the modification.

C. Materials:

1. The estimated cost for materials must include quotes from multiple sources. Material prices must include all applicable fees and credits, including but not limited to, sales tax, freight and delivery charges, and tax rebates.

2. No markup will be applied to any material provided by the NPS.

D. Equipment:

1. Equipment used for the project must be appropriately sized for the work being performed.

2. Do not include costs for “miscellaneous tools and equipment”, in your proposal for a replacement value of five hundred dollars ($500) or less. Costs shown in excess of five hundred dollars ($500) must be broken out separately.

3. Regardless of ownership, the rates to be used in determining equipment rental costs must be the lowest cost from one of the following sources:

a. U.S. Army Corps of Engineers, Ownership and Operating Expense Schedule (use latest edition and applicable region)

b. Construction Blue Book

c. Local equipment rental rates, documented by actual invoice charges, or itemized vendor quotes.

4. The estimated rental rates must include the cost of all fuel, oil, lubrication, supplies, small tools, necessary attachments, ground engaging components, tires & tracks, routine repairs and maintenance (cost of major overhaul is not included), depreciation, storage, insurance, and all incidentals. Mobilization, if applicable, may be included for equipment solely used on the modification work but must be listed separately.

5. Estimate the full rate for equipment only for the duration that the equipment will be utilized to accomplish the work of the modification.

6. Standby unit rates used are to be in accordance with paragraph 1.3, D, 2, above. If the US Army Corp of Engineers is utilized then their standby rates prevail. If Bluebook or local equipment pricing is accepted, then one half (½) of the equipment costs minus any operating costs will be accepted.

7. If equipment is in standby mode due solely to a documented NPS delay, the established standby rate must apply from the first day of the delay.

8. Equipment that is not used and on the jobsite for up to five consecutive days may be classified at standby rates, provided that the equipment is or has been used solely to perform work on the modification and will be necessary to complete additional modification work.

Equipment that is still on the jobsite but not in use after five consecutive days will not be considered in the modification pricing.

9. Requests for compensation for equipment stand by time must be justified, documented and itemized separately.

10. The estimated timeframe (daily, weekly, monthly) for use of the equipment must reflect the lowest cost to the Government.

E. Establishment and Application of Overhead and Profit Percentages:

1. Home Office Overhead and Profit (OH&P) must be applied to direct costs only. Profit must not be applied to overhead amounts; and overhead must not be applied to profit. Home office overhead must contain only allowable, allocable, and reasonable costs per the contract documents and FAR Part 31. Profit percentages are based on risk factors found in FAR Part 31which have been applied to the specific type of work included in this project.

The following percentages establish the maximum allowable markups (OH&P) for contractor self-performed work:

2. Total aggregate limit of markup (OH&P) for contractor and subcontractors on modification work must not exceed twenty percent (20%). The NPS will not be responsible for allocation of percentages between contractor and subcontractors at any tier.

3. If contractors form a partnership, then the partnership may only receive home office overhead and profit in the same amount as an individual contractor (refer to par 1.3,E,1 above). It is the responsibility of the partners to decide on the division of revenue.

4. Combined Increases and Decreases: On proposals involving both increases and decreases in the Contract Price, the overhead and profit mark-ups are required on the net increases and deducted on net decreases.

5. At no time can profit be calculated on Overhead or itself, it must be calculated on direct costs of work only.

SECTION 01 27 00

1.1 DESCRIPTION

A. General:

1. The intent of this section is to explain, in general, what is and what is not included in a Contract Price Schedule Line Items, and the limits where one Contract Price schedule Line Item ends and another begins.

2. The total contract price must cover all work required by the Contract Documents. All costs in connection with the proper and successful completion of the work, including furnishing all materials, equipment, supplies, and appurtenances; providing all construction equipment and tools; and performing all necessary labor and supervision to fully complete the work, must be included in the unit and lump sum prices of the Contract Price Schedule Line Items.

All work not specifically set forth as a pay item in the Contract Price Schedule Line Items must be considered subsidiary obligations of the Contractor and all costs in connection therewith must be included in the prices submitted for the Contract Price Schedule Line Items.

3. If no Contract Price Schedule Line Item exists for a portion of the work, include the costs in a related Contract Price Schedule Line Item.

4. The description of the work of this section constitutes a summary of the work for the purpose of defining the Base Contract Price Schedule Line Items and Contract Price Schedule Option Items and is not intended to provide a detailed and exhaustive description of all aspects of the entirety of the work. For the complete and comprehensive description of the work all documents pertaining to the Contract Documents must be collectively taken into account.

B. Estimated Quantities:

1. All estimated quantities stipulated in the Contract Price Schedule or other Contact Documents are approximate and are to be used only:

a. As a basis for estimating the probable cost of the work.

b. For the purpose of comparing the Contract Price Schedules submitted for the work.

2. The basis of payment for unit price work and materials will be the actual amount of work done and materials furnished up to the not-to-exceed quantity.

3. Except where otherwise specified the unit or lump sum price for each item of work that involves boring, drilling, excavation or trenching, backfilling, drilling mud containment and removal, borehole cuttings containment and removal must include all costs for such work.

1.2 BASE CONTRACT PRICE SCHEDULE LINE ITEMS

A. Contract Line Item Number (CLIN) 1 – MOBILIZATION AND DEMOBILIZATION - This line item consists of mobilizing and demobilizing all required equipment and construction materials to the site along with preparation of the site in order to initiate work and then site clean up at the end of the work. Measurement will be by lump sum. Multiple drilling attempts on the same project site will not constitute a new unit. This item will be paid on a lump sum item basis.

B. CLIN 2 – DRILL AND SET TEMPORARY CONDUCTOR CASING – This line item consists of furnishing all material, equipment, and labor for the completion of a bore hole to a sufficient depth to then install a temporary conductor casing to facilitate drilling the test well borehole to depth and allow for the placement of the sanitary seal while withdrawing this temporary conductor casing from the test wellbore hole. This work includes but is not limited to all construction aides related to installing the temporary conductor casing. This item will be paid on a lump sum item basis.

C. CLIN 3 – DRILL TEST WELL - This line item consists of furnishing all materials, equipment, and labor for the completion of a borehole for a test water well to a depth of 260 feet below land surface (BLS.) The work also includes any reaming, under-reaming, and/or casing advancement operations that are required to complete the test well borehole. This line item will be paid on a unit price item basis up to the not-to-exceed quantity.

D. CLIN 4 – FURNISH 8-INCH WELL CASING – This bid item consists of furnishing all materials, equipment, and labor necessary to furnish well casing and associated appurtenances for connecting it together at the project site. This line item will be paid on a unit price item basis up to the not-to-exceed quantity.

E. CLIN 5 – INSTALL 8- INCH WELL CASING - This line item consists of furnishing all materials, equipment, and labor necessary to make a complete installation of the well casing into the test well borehole to allow for an operational well. The work also includes any reaming, under-reaming, and/or casing advancement operations that are required to allow installation of the well casing.

This line item will be paid on a unit price item basis up to the not-to-exceed quantity.

F. CLIN 6 – FURNISH 8-INCH WELL SCREEN- This line item consists of furnishing all materials, equipment, and labor necessary to furnish well screen and associated appurtenances for connecting it together at the project site. This line item will be paid on a unit price item basis up to the not-to-exceed quantity.

G. CLIN 7 – INSTALL 8- INCH WELL SCREEN - This line item consists of furnishing all materials, equipment, and labor necessary to make a complete installation of the well screen into the test well borehole for an operational well. The work also includes any reaming, under-reaming, and/or casing advancement operations that are required to the test well borehole to allow installation of the well screen. This line item will be paid on a unit price item basis up to the not-to-exceed quantity.

H. CLIN 8 – GRAVEL PACK MATERIAL - This line item consists of furnishing all materials, equipment, and labor necessary to make a complete installation of the gravel pack material, including but not limited to under-reaming, gravel pack material, formation stabilization, placement of the gravel pack material in the annular space between the well casing and the drilled test well borehole wall, disinfection and other related work. This line item will be paid on a unit price item basis up to the not-to-exceed quantity.

I. CLIN 9 – FORMATION STABILIZER MATERIAL- This line item consists of furnishing all materials, equipment, and labor necessary to make a complete installation of the formation stabilizer material, including but not limited to under-reaming, formation stabilizer material, MANZ 216059 012700-3 formation stabilization, placement of the formation stabilizer material in the annular space between the well screen and the drilled test well borehole wall, disinfection and other related work. This line item will be paid on a unit price item basis up to the not-to-exceed quantity.

J. CLIN 10 – GROUT SURFACE SEAL - This line item consists of furnishing all materials, equipment, and labor necessary to construct the surface (aka sanitary) seal by placement of impervious material in the annular space between the exterior of the permanent well casing and the wall of the drilled test well borehole. This line item will be paid on a unit price item basis up to the not-to-exceed quantity.

K. CLIN 11 – WELL DEVELOPMENT - This line item consists of furnishing all materials, equipment, and labor necessary to develop the test well to achieve sand-free water at an acceptable specific capacity. This includes but is not limited to the time required for piping or hauling water, rigging up, running tools, to erosion protections of the ACEC from discharged pumped water, and other preparatory and disassembly work. This item will be paid on a lump sum item basis.

L. CLIN 12 – PUMPING TEST- This line item consists of furnishing all necessary labor, equipment, tools, materials, and pumping equipment capable of pumping at the various discharge rates specified. This line item also includes all setup and disassembly activities required to perform the work, to include erosion protections of the ACEC from discharged pumped water and coordinate with the NPS geologist responsible for collecting the data from the pumping test. The pumping unit must be complete with ample power source, controls and appurtenances. This line item will be paid on a lump sum item basis.

M. CLIN 13 – RECOVERY TEST - This line item consists of furnishing all necessary labor, equipment, and tools to enable the NPS geologist to record test well water levels during the recovery period. This line item will be paid on a lump sum item basis.

N. CLIN 14 – DISINFECTION OF TEST WELL - This line item consists of furnishing all materials, equipment, and labor necessary to disinfect and keep disinfected the test well up through and including Final Inspection. This line item will be paid on a lump sum item basis.

O. CLIN 15 – VIDEO INSPECTION LOGGING OF COMPLETED TEST WELL - This line item consists of furnishing all materials, equipment, and labor necessary to carry out the video inspection logging of the completed test well. This line item will be paid on a lump sum item basis.

A. The work of this section consists of schedule requirements before and during construction.

1 .2 SCHEDULES

A. After issuance of the Notice of Award and before the Preconstruction Conference, submit the Project Schedule and Schedule of Values as a package. The Contracting Officer will review the Project Schedule and the Schedule of Values for format and content.

a. Project Schedule: Submit the Project Schedule in Gantt format. Show each bid item as a milestone and use activities to for the breakdown of work elements related to each milestone. The schedule must identify the critical path of the project.

b. Updates to Project Schedule: As requested by the Contracting Officer provide updated project schedules.

2. Schedule of Values:

a. Submit a schedule of dollar values based on the Contract Price Schedule. Include bond costs, mobilization, general condition costs, overhead, and profit in the total dollar value of unit price items and in the component parts of work for each lump-sum item, as described below. Do not include bond premiums, mobilization, general condition costs, overhead, or profit as separate items; however, payment for bond premiums can be made based upon evidence of payment to the surety. Bond premiums may be shown as a separate item.

b. Break down each lump-sum Price Schedule Line Item into component parts of work for which progress payments may be requested. The total costs for the component parts of work must equal the bid amount for that lump-sum item. The Contracting Officer may request data to verify accuracy of dollar values.

c. Do not break down unit price Contract Price Schedule Line Items. Use only the Contract Price Schedule Line Item amount for unit price items.

d. The total cost of all items must equal the total contract price. The Schedule of Values will form the basis for progress payments as provided for in the terms of the contract.

1 .1 DESCRIPTION

A. The work of this section consists of submittal requirements before and during construction.

1 .2 RELATED REQUIREMENTS

A. TEST WELLS - Section 33 11 11.

1 .3 SUBMITTAL AND APPROVAL PROCEDURES

A. All submittals must be transmitted using National Park Service form DSC-1(CS), most recent version. (A copy of the form is included at the end of this section.) No action will be taken on a submittal item unless accompanied by the transmittal form. This form in informally referred to as the NPS Transmittal form.

B. As specified in the individual sections, forward submittals to Contracting Officer at least 30 days before need for approval. Unless a different number is specified, submit transmittal form with required submittal information electronically in PDF by email. Make arrangements with the Contracting Officer for the method of submitting submittals that cannot be made by PDF or are of a file size greater than 25 MB – the size limit for attachments to email sent to NPS staff.

1. Shop Drawings: Include the following information with each copy of shop drawings:

a. Date.

b. Date of revisions (when applicable).

c. Contractor's certification that shop drawing has been checked for compliance with contract documents.

d. Details of fabrication, assembly and erection including connections and engagement to contiguous work.

e. Materials used.

f. All required dimensions.

g. The term "by others" must not be used. All work to be performed by others must be identified by Contractor or subcontractor name, discipline, or trade.

2. Samples: Samples must be large enough to illustrate clearly the functional characteristics and full range of color, texture, or pattern.

3. Manufacturers' Catalog Sheets: Submit only pertinent pages; mark each copy of standard printed data to identify specific products proposed for use.

4. Manufacturer's Installation Instructions: When contract documents require compliance with manufacturer's printed instructions, provide one complete set of instructions for Contracting Officer and keep another complete set of instructions at the project site until substantial completion.

C. Contracting Officer reserves the right to require submittals in addition to those called for in individual sections.

D. Approved Equals:

1. For each item proposed as an "approved equal," submit supporting data, including:

a. Drawings and samples as appropriate.

b. Comparison of the characteristics of the proposed item with that specified.

c. Changes required in other elements of the work because of the substitution.

d. Name, address, and telephone number of vendor.

e. Manufacturer's literature regarding installation, operation, and maintenance, including schematics for electrical and hydraulic systems, lubrication requirements, and parts lists. Describe availability of maintenance service, and state source of replacement materials.

2. A request for approval constitutes a representation that Contractor:

a. Has investigated the proposed item and determined that it is equal or superior in all respects to that specified.

b. Will provide the same warranties for the proposed item as for the item specified.

c. Has determined that the proposed item is compatible with interfacing items.

d. Will coordinate the installation of an approved item and make all changes required in other elements of the work because of the substitution.

e. Waives all claims for additional expenses that may be incurred as a result of the substitution.

3. Construction Materials: The Contractor is encouraged to submit for approval products made out of recycled or environmentally responsible material. Every effort will be made by the National Park Service to approve these materials.

E. Coordinate all submittals and review them for legibility, accuracy, completeness, and compliance with contract requirements. Forward submittals that are related to or affect one another as a package to facilitate coordinated review. Each transmittal must contain only data specific to that individual submittal.

F. Submittal Identification:

1. Contractor must provide required information called for on the NPS Transmittal form.

2. All sets of shop drawings, manufacturer's catalog sheets, samples, and other documents submitted to the Contracting Officer must include the NPS Transmittal form.

G. Submittal Numbering:

1. Number each submittal consecutively as called for on the NPS Transmittal form.

2. For re-submittals use the original submittal number, plus a letter suffix beginning with A.

3. Additional re-submittals of the same item must contain the original number with the next consecutive letter.

H. Contracting Officer's Review:

1. Submittals will be returned disapproved without technical review if identification information is missing, not filled in, or if placed on the back of the submittal; an incorrect number or format of submittals is provided; the transmittal form is incorrectly filled out;

submittals are not coordinated; or submittals do not show evidence of Contractor's approval.

2. Any work done or orders for materials or services placed before approval will be at the Contractor's own risk.

3. After reviewing submittals, the Contracting Officer will return an electronic PDF copy of form DSC-1(CS) along with the submittal sheets to the Contractor. Shop drawing review notations will be returned on a PDF of original shop drawing. All other submitted items will be retained. The Contractor is responsible for producing additional copies for his/her own use.

4. The returned submittal will be marked in one of three ways as defined below:

a. APPROVED: Acceptable with no corrections.

b. APPROVED WITH NOTATIONS: Minor corrections or clarifications required.

All comments are clear and no further review is required. The Contractor must address all review comments when proceeding with the work.

c. DISAPPROVED - RESUBMIT: Rejected as not in accordance with the contract or as requiring major corrections or clarifications. The Contracting Officer will identify the reasons for disapproval. The Contractor must revise and resubmit with changes clearly identified.

ARCHEOLOGICAL PROTECTION

1 .1 DESCRIPTION

A. The work of this section consists of protecting archeological resources contained in soil deposits in the first twenty feet of the test well.

1 .2 DEFINITIONS

A. Resources: Prehistoric, historic, and early 20th century artifacts, including charcoal, human bones, ash, fire rocks, and building materials that indicate the presence of past human occupation.

B. Archeologically Sensitive Areas: Areas that have been determined to have a probability of buried archeological materials.

C. Nonsensitive Areas: Areas that have a low likelihood of containing significant in-the-ground archeological resources. The test well project site is considered a nonsensitive area.

D. Archeological Monitor: Representative of the Government designated to record and collect cultural resources for compliance with Government regulations to protect in-the-ground resources.

SAFETY REQUIREMENTS

A. The work of this section consists of establishing an effective safety program and providing a safe environment for all personnel and visitors.

1 .2 SUBMITTALS

A. Safety Program: Before on-site work begins, submit for approval a safety program. The Contracting Officer will review the proposed program for appropriate content relative to OSHA and project requirements. If the program requires any revisions or corrections, the Contractor must resubmit the program within 10 days. No progress payments will be made until the program is approved. The program must include:

1. Name of responsible supervisor to carry out the program.

2. Daily, Weekly and monthly safety meetings.

3. First aid procedures.

4. Outline of each phase of the work, the hazards associated with each major phase, and the methods proposed to ensure property protection and safety of the public, National Park Service personnel, and Contractor's employees. Identify the work included under each phase by reference to specification section or division numbers.

5. Training, both initial and continuing.

6. Planning for possible emergency situations, such as floods, fires, cave-ins, slides, explosions, power outages, and wind storms. Such planning must take into consideration the nature of construction, site conditions, and degree of exposure of persons and property.

7. Housekeeping procedures.

8. Fire Protection procedures and protocols.

9. Additional subjects the Contractor deems necessary for a safe work site.

B. Certificates: Provide certificates from a mechanic that all mechanical equipment has been inspected and meets OSHA requirements.

C. Submit a copy of test reports, as required by OSHA, for personnel working with hazardous materials.

D. Submit a report of safety meetings and of inspections.

E. Upon request, submit proof of employees' qualifications to perform assigned duties in a safe manner.

1 .3 QUALITY ASSURANCE

A. Clauses entitled "Accident Prevention" and "Permits and Responsibilities" of the contract. In case of conflicts between Federal, state, and local safety and health requirements, the most stringent will apply. Equipment or tools not meeting OSHA requirements will not be allowed on the project sites. Failure to comply with the requirements of this section and related sections may result in suspension of work.

B. Qualifications of Employees:

1. Ensure that employees are physically qualified to perform their assigned duties in a safe manner.

2. Do not allow employees to work whose ability or alertness is impaired because of drugs, fatigue, illness, intoxication, or other conditions that may expose themselves or others to injury.

3. Operators of vehicles, mobile equipment, hoisting equipment, and hazardous plant equipment shall be able to understand signs, signals, and operating instructions, and be capable of operating such equipment. Provide operating instructions for all equipment.

Newly hired operators must be individually tested by an experienced operator or supervisor to determine if they are capable of safely operating equipment.

1 .4 ACCIDENT REPORTING

A. Reportable Accidents: A reportable accident is defined as death, occupational disease, traumatic injury to employees or the public, property damage by accident in excess of $100, and fires.

Notify Contracting Officer immediately in the event of a reportable accident. Within 7 days of a reportable accident, fill out and forward to Contracting Officer an Accident/Property Damage Report (Form CM-22). Form may be obtained from the Contracting Officer.

B. All Other Accidents: The Contractor must report all other accidents…
