Any information (classified or unclassified) pertaining to this contract shall not be released for public dissemination except as provided by the National Industrial Security Program Operating Manual (NISPOM) or unless it has been approved for public release by appropriate U.S. Government authority. Proposed public releases shall be submitted for review and approval prior to release to the appropriate government approval authority identified here with at least office and phone contact information and if available, an e-mail address. The security classification guidance for classified information needed for this effort is identified below. If any difficulty is encountered in applying this guidance or if any other contributing factor indicates a need for changes in this guidance, the contractor is authorized and encouraged to provide recommended changes; to challenge the guidance or the classification assigned to any information or material furnished or generated under this contract; and to submit any questions for interpretation of this guidance to the official identified below. Pending final decision, the information involved shall be handled and protected at the highest level of classification assigned or recommended.

| text: 10.b and d. The contractor will access RD (less CNWDI) and FRD under the same conditions as for all other classified information, based on the appropriate security clearance and access, need-to-know for the information, and IAW DoD 5210.2. Access to restricted data requires a FINAL US Government clearance at the appropriate level. The Contracting Officer/Contracting Officer's Representative and CCDC Chemical Biological Center Security Office will make interim access determinations. |
10.e.2. Non-SCI Information is not releasable to contractor employees who have not received a clearance at the appropriate security level. The contractor shall access ONLY CUI/FOUO and classified information related to the subject matter of this contract up to the SECRET level. Contract employees accessing classified information shall be US citizens and have a validated security clearance in place prior to accessing classified information. Contractor may require access to non-SCI information at the SECRET Level ONLY.
10.g. Personnel not assigned to a NATO staff position, but requiring access to NATO classified information, or documents belonging to NATO or containing NATO classified information or access to the NATO accredited SIPRNET terminals, must possess Government Clearance at the appropriate level and a NATO access briefing/debriefing, based upon the appropriate personnel security investigation required. Personnel with access to NATO ATOMAL information must have the appropriate level FINAL U.S. Security Clearance. The government program/project manager is the designated representative that will ensure the contractor security manager and concerned employees are NATO briefed prior to access being granted. The contractor will maintain strict compliance in regards to NATO information JAW NISPOM Ch. 10, Section 7. Prior approval from the GCA is required for subcontracting. Contractor will require access to NATO information to conduct modeling and simulation research and development on the subject matter related to this contract.
10.h. Foreign Government Information (FGI) is not releasable to contractor employees who have not received a FINAL clearance at the appropriate security level. Contractor may require access to Foreign Government Information to conduct research in support of the Cooperative Biological Engagement Support (CBES) to conduct research for bio-safety, bio-security, bio-surveillance, and cooperative research capacity building throughout collaborative engagements in all Areas of Operation (AOR) listed within the Performance Work Statements for this contract effort. Written concurrence of the GCA is required prior to subcontracting.
10.j Controlled Unclassified Information (CUI) Information generated and/or provided under this contract shall be safeguarded and marked as specified in DoDM 5200.1, Volume 4, "DoD Information Security Program: Controlled Unclassified Information (CUI)," available at http://www.esd.whs.mil/DDDoD-Issuances. The contractor shall access only Controlled Unclassified Information (CUI) related to the subject matter of this contract.
10.k.(1) Access to Automated Information Systems IAW AR25-2, AR 380-67 and affiliated regulations, if access to AIS is a requirement a favorable investigation is required to access the RDECOM mainframe systems and all Local Area Network Server Accounts. Interim access prior to the completion of the investigations will be considered on a case by case basis. The Contracting Officer's Representative and CCDC CBC Security Office will make interim access determinations.
10.k.(2) Use of computer equipment for classified processing shall be approved by the Defense Security Service and/or the CCDC CBC Security Office.
11.a. The contractor is authorized to access classified information ONLY at another contractor's facility or a government activity. Contract employees requiring access to classified information related to this contract are approved/authorized access only up to the SECRET level. Contract employees accessing classified information shall be US citizens and have a valid security clearance in place prior to access of Classified Information.
11.f.(1) For U.S. contractors performing on contracts requiring access to classified information outside of the U.S., Puerto Rico, U.S. Possessions, and Trust Territories, provide a copy of the DD 254 to the appropriate CSO. DSS Field Office locations can be found by going to the DSS website at https://www.dss.mil/isp/dss_oper_loc.html or from the FSO at the U.S. Contractor facility.
11.f.(2) Access to Classified Information may occur within any of the following listed locations, or within an unnamed country, depending on the need for unannounced bio-safety, bio-security, bio-surveillance, or cooperative research capacity building throughout collaborative engagements IAW this contract effort. Named and identified countries currently listed within the Performance Work Statement are: India, Indonesia, Laos, Malaysia, Thailand, Uganda, Vietnam and the National Capitol region of the United States. This listing is subject to change upon need and request. Contract employees will have appropriate security clearances verified prior to access to Classified Information.
11.g. The contractor will prepare DD Forms 1540 and 2345 for authorized access to DTIC and provide them to the Contracting Officer for processing.
11.j. The contractor shall prepare, obtain approval for, execute and maintain an OPSEC plan IAW contract terms and CDRLs. The Contractor shall comply with OPSEC requirements in AR 530-1 and/or local User Agency policies and programs (unclassified technology). The Contracting Officer Representative will provide an example OPSEC Plan within 30 days of contract award. A copy of the approved OPSEC Plan will be provided to the CCDC CBC Security Office and ACWA Security Personnel.
11.l. Contractor is authorized to receive, store, or generate CUI in the performance of this contract. Information designated as CUI, e.g., FOUO generated under this contract shall be controlled, handled, stored, marked, safeguarded, transmitted and destroyed IAW DoDM 5200.01, DoDM 5400.07, AR 380-5, AR 25-2, AR 25-55, and the following guidance:
• Electronically transmitted CUI shall be sent via: 1) encrypted email, 2) password protected/encrypted document, 3) AMRDEC Safe Access File Exchange at https://safe.amrdec.army.mil/safe/Welcome.aspx, or 4) an accredited information system with proper security controls.
• The contractor may disseminate CUI to their employees and subcontractors that have a need-to know.
• Disposal/destruction shall be by means of shredding when no longer needed. If shredding capabilities are unavailable on contractor site – contractor may coordinate with government representative for shredding services.
• The contractor shall report any unauthorized disclosure of CUI to the KO/COR, CM, or ISS.
11.m.(1) The contractor shall not use foreign nationals on this contract unless approved by the Procuring Contracting Officer with CCDC CBC Security Office/ACWA concurrence. Any foreign nationals must be approved prior to initiating work under this project or subcontract. The following information is required when requesting approval for foreign national support: full name, date of birth, place of birth, citizenship, registration number, port of entry, and description of position in which employee will be utilized, photo copy of the work visa, permanent resident card or green card, abbreviated Curriculum Vitae, and a sole source justification. These documents will be submitted to the CCDC CBC Security Office for approval. Previously approved foreign nationals must be re-approved if the nature of their work under this contract differs from that performed under the prior year's contract.
11.m.(2) In accordance with Block 12 above, the contract shall ensure that prior to the release of any information outside the Government, that a request for release is submitted through the Procuring Contracting Officer to the CCDC CBC Security Office/ACWA for review and approval.
11.m.(3) The contractor shall return all classified/sensitive material, to include program material, to the Government at the completion of this contract.
11.m.(4) Contract personnel working on this contract are required to take the following training as defined in the Performance Work Statement not later than 30 days after contract award: AT Level 1 Training; iWatch Training; Army Training Certification Tracking System DoD Information Assurance Awareness Training before issuance of network access to Government Information Systems; Level I OPSEC Awareness training; and Threat Awareness and Reporting Program (TARP) training.
