About this file

This is a Request for Bid (RFB CKS-9192) issued by the Wisconsin Department of Corrections (DOC) on April 22, 2024, with responses due May 22, 2024, for data cabling and equipment installation services. The procurement is open to cooperative purchasing by Wisconsin municipalities under state statute authority, allowing local governments to utilize the resulting contracts at the same negotiated rates.

The contract covers installation of data cabling and equipment at DOC facilities throughout Wisconsin, with the DOC providing equipment (cameras, wireless access points, TVs, monitors) while contractors supply all labor, materials, and installation services. Awards will be made to multiple contractors based on lowest total bid price, creating a ranked vendor list that DOC will use sequentially when services are needed. The initial contract term is one year with options for up to four additional one-year renewals. Bidders must have minimum five years' experience and meet all technical specifications including compliance with National Fire Protection Association standards, Wisconsin Electrical Code, and various TIA/ANSI standards for structured cabling. The state offers 5% price preferences for certified Minority-Owned Business Enterprises (MBE), Disabled Veteran-Owned Businesses (DVB), and Woman-Owned Business Enterprises (WBE). No guaranteed minimum purchase quantities or dollar amounts are specified, and contractors may decline jobs but risk removal from the vendor list for repeated non-participation.

PURPOSE AND SCOPE OF THE REQUEST FOR BID

The Department of Corrections (DOC) requests Bids for the installation of data cabling and equipment. The installation may occur in any DOC leased or owned building, located throughout the State of Wisconsin.

DOC intends to use the results of this process to create a Contractor list. The list will be ranked based on the results of this RFB process (lowest to highest cost). When a DOC location requires cabling and equipment installation, DOC will contact the first Contractor on the list. If that vendor is unable to provide the service, DOC will move on to the next Contractor on the list. Contractors are not required to serve all locations within the State. However, repeated inability to respond to DOC requests for jobs will be grounds for DOC to take Contractor off the list and/or to “skip” the Contractor when going down the list.

The DOC does not guarantee it will purchase any specific quantity or dollar amount of services, or to pay any minimum Contract price during the term of the Contract.

Other State agencies may use the resulting Contract(s), if agreeable to both the DOC and the Contractor(s), to obtain the benefits of volume purchases and/or reduction in administrative expenses.

CONTRACT TERM

The resulting Contract(s) will be in effect for an initial one (1) year period. The DOC and the Contractor(s), upon written mutual agreement, may renew the Contract for up to an additional four (4) 1-year periods. The Contract(s) shall be effective on the date indicated in the award letter or Contract(s). All Contracts will start and end on the same dates, regardless of when they are executed, for consistency.

The RFB documents, the awarded Bidder's response as accepted by the DOC, and any purchase order(s) related to this RFB shall become the Contract between the parties, unless separate Contract(s) are executed.

MODIFICATION OF CONTRACT

The Contract shall not be used for purchasing Services outside of the general scope and intent of the original Request for Bid. Any modifications made to the Contract shall fall within the scope of the Bid. Modifications must be rendered in writing and signed by both parties, or they will be void.

DOC reserves the right to use the results of this RFB for services at any DOC locations specified on the map (Attachment B), or any new DOC locations. Services shall be provided at the Contractor’s current or lower contracted rate.

ORDER OF PRECEDENCE

In the event of Contract award, the contents of this RFB (including all attachments), RFB addenda and revisions, the Bid response from the successful Bidder as accepted by the DOC, and any additional terms agreed to in writing by the parties shall be incorporated into the Contract. Failure of the successful Bidder to accept these elements into the Contract will result in the cancellation of the Contract award.

In the event of a conflict with the incorporated elements of the Contract, the following order of precedence will prevail:

· Final Signed Contract with clarifications included;

· Bid response as accepted by the DOC;

· Request for Bid.

If the Official State Purchase Order serves as the final Contract, in the event of a conflict with the incorporated elements of the Contract, the following order of precedence will prevail:

· Official State Purchase Order;

· Bid response as accepted by the DOC;

· Request for Bid.

COOPERATIVE PURCHASING SERVICES

Services procured through this Bid may be made available to municipalities upon agreement of the Contractor. Where requested by the State, and agreed to by the Contractor(s), municipalities shall be able to obtain the services procured under the Contract at the same rates agreed to by the DOC and the Contractor. The Contractor shall be responsible for confirming the status of potential municipalities with the DOC and providing appropriate documentation and support and reporting Contract usage by municipalities.

RESPONDING TO BID REQUIREMENTS

Mandatory Bidder qualifications and/or requirements in this RFB document must be minimally met without exception; failure to meet such will disqualify the Bid. Before the award of any Contract, the DOC shall be satisfied that the Bidder has sufficient qualified resources available for performing the work described in this Bid. It is the Bidder's responsibility to acquaint the DOC with these qualifications by submitting appropriate or supporting documentation.

Certain qualifications/specifications will be presented by the DOC as itemized questions that require an affirmative response from the Bidder that they can meet them (e.g., "yes/no" prompt, dropdown menu, required attachment). Other requirements may be presented in a grouped manner (e.g., "Does your company meet requirements 2.1-2.8?"). For any itemized or grouped requirements that the Bidder cannot meet, the Bidder must check "no" and provide a supplemental document as an attachment to explain.

Failure to meet a qualification will disqualify the Bid. However, in the event that no Bidder is able to meet an individual mandatory requirement, the DOC reserves the right to continue the review of Bids, waiving that requirement.

BIDDER QUALIFICATIONS AND REQUIREMENTS

All Bidder qualifications in this section are mandatory and shall be met at no additional cost above the pricing provided in the Bid response.

EXPERIENCE

The Bidder must have experience doing the type of work being procured in this RFB for a minimum of five (5) years. Bidder must be able to provide documentation of this experience if requested by DOC.

However, if a Contractor repeatedly turns down requests for jobs, DOC reserves the right to take the Contractor off the list or to “skip” the Contractor when requesting installation services.

PROJECT RESPONSE AND PROJECT TIMELINES

When a Contractor is contacted for an installation job, the Contractor will be given a timeline to respond to the request, and a deadline for the job to be completed. If the Contractor does not respond to DOC within the allocated time, DOC will move on to the next Contractor on the list. Additionally, if the Contractor is not able to guarantee that the job will be completed in the timeframe required by DOC, DOC reserves the right to contact the next Contractor on the list.

Please note, Bidders must click "Submit" in the Wisconsin eSupplier Portal to have their response received. Only clicking "Save" does not submit the Bidder’s response; therefore, it shall not be received or reviewed. Bidders will receive verification that a response has been submitted.
