About this file
This is a Schedule D Federal Provisions Addendum for a Michigan state and local contract opportunity for a Respiratory Protection Program at MVH (presumably a Michigan state facility), outlining mandatory federal compliance requirements applicable to purchases paid in whole or in part with federal government funds.
The addendum establishes non-negotiable federal provisions that take precedence over state contract terms and conditions when conflicts arise with federal law requirements. Key federal compliance obligations include: adherence to the Byrd Anti-Lobbying Amendment for contracts exceeding $100,000, requiring contractor certification that no federal appropriated funds will be used for lobbying activities; compliance with procurement of recovered materials under EPA guidelines when purchasing designated items; prohibition on contracting for covered telecommunications equipment or services as defined under the McCain Act, with mandatory reporting requirements within one business day of identifying non-compliant equipment; domestic preference requirements favoring United States-produced goods, products, and materials; and affirmative steps to ensure small and minority businesses, women's business enterprises, and labor surplus area firms are used as subcontractors when possible. The contract does not trigger applicability of Davis-Bacon prevailing wage requirements, the Contract Work Hours and Safety Standards Act, the Clean Air Act, or FEMA-specific provisions, as it is neither a federally assisted construction contract nor involves mechanics, laborers, or purchases exceeding specified thresholds. Contractors must accept these federal provisions as presented or risk ineligibility for award.
