(f) Receiving Inspection Systems
The Contractor must maintain a Receiving Inspection System which ensures that all procured materials and equipment are inspected and tested as prescribed by the applicable specifications and drawings, and the approved submittal documents (SD's).
A Receiving Inspection Record will accompany each materials/equipment delivery to the construction site. Records of all receiving inspections/tests and nonconformance records must be maintained at the construction site by the Contractor.
These records must include documentation of any defects, discrepancies, disposition and/or waivers, including evidence of Government source inspection when required.
(g) Nonconforming Articles and Material Control

(v) Remedial actions taken or recommended.
(vi) Disposition of the nonconforming article or material.
(2) The Contractor must identify and tag the nonconforming article and segregate/remove it from the work area.
(3) The Contractors must establish a system for monitoring and correcting deficient procedures and operations.
(h) Responsibility for Inspection
The Contractor is responsible for the performance, on a one hundred percent (100%) basis of all inspections and tests and record requirements specified in the contract. Unless otherwise specified in the contract, the Contractor may utilize independent inspection and testing laboratories or services that are acceptable to the Government.
(i) Fabrication, Process, and Work Control
(1) The Contractor's procedures and operations controls must be derived from the Quality requirements and work execution standards required by each section of the contract specification and drawings.
(2) The Contractor must establish those in-process inspection points and controls over the work as necessary to ensure compliance with quality requirements and work standards which are not readily detectable, sealed, or measurable by inspection and test of a finished article or work element. When approval or certification of special processes, operating personnel, special equipment or procedures, is required by the specifications, the Contractor must obtain necessary approvals or certification prior to starting the work/process.
(3) These special processes may include but are not limited to plating, anodizing, nondestructive testing, welding, soldering, etc. Records of in-process inspections and control away from the job site may be used as evidence of quality of materials/work and may reduce, but not eliminate further inspection or testing when delivery is made to the job site or during final testing and acceptance.
(j) Quality Control Records
(1) All quality control records must be maintained in a central on-site location by the
Contractor. These records must include all quality control data; factory tests or manufacturer's certification, quality control coordinating actions; records of quality control training/certifications as well as routine hydrostatic, electrical continuity, grounding, welding, and line cleaning, and similar tests. The quality records must be available for examination by the Contracting Officer and the Contractor must provide copies of tests and data to the Contracting Officer's on-site representative(s).
(2) The requirements to maintain quality control records, as described above, will not be construed to relieve the Contractor of submitting samples, test data, shop drawings, material certificates, or other information required by the submittal documents (SD's) called out in the specification.
(3) The Contractor must assure that each record of inspection, test, nonconformance and corrective action is identified and traceable to the specific requirement of the specifications and drawings.
(k) Inspection and Test Records
The Contractor must maintain current records on site of each inspection and test performed, on appropriate form(s) throughout the life of the contract. These records must include but not be limited to, factual evidence that the required inspections or tests have been performed, including type and number of inspections or tests involved, identification of operators and inspectors, result of inspections or tests, nature of defects, causes for rejection, proposed remedial action, and corrective actions taken.
All inspection records, test procedures, test results, and associated forms must contain a place/space to indicate verification or witness by Government Inspectors or Representatives.
Legible copies of these records must be furnished to the Contracting Officer and his on-site representative. The records must cover all work placements, traceable to the contract schedule, specifications, and drawings, and must be verified by the Prime Contractor's designated Quality Program on-site representative.
(l) Drawing and Change Control
A drawing-control system must be maintained to provide for timely drawing and change distribution to all work locations and subcontractors and prompt removal of obsolete drawings from work areas. The system must provide for timely initiation of drawings change requests.
Changes which involve interface with other work areas or that affect articles or materials controlled by others must be numbered, logged, and controlled by the Prime Contractor. This system must be effectively integrated with other document control requirements of the contract. Drawing-change affectivity must be clearly specified. Accomplished changes must be appropriately and clearly marked or identified and associated drawings must be revised accordingly. Only shop drawings that have been approved or approved as noted by the Contracting Officer shall be used for fabrication and inspection.
(m) Inspection, Measuring and Test Equipment - Calibration
(1) The Contractor must provide and maintain currently calibrated gages and other measuring and testing devices necessary to assure that the work conforms to contract requirements.
These devices must be calibrated against certified measurement standards which are traceable to national standards, as required by individual sections of the specification.
(2) Calibration records must be maintained for each item of test/measuring equipment. Any equipment exceeding its required due date or tolerance must be isolated, tagged, or otherwise marked to prevent its use.
(3) The Contractor may utilize his own certified test facilities or those of an independent testing laboratory acceptable to the Contracting Officer.
(n) Government Property Control
The Contractor must establish property controls, inspections, and records as required by the provisions of the Contract Schedule.
(o) Handling, Storage, Preservation, and Shipping
(1) The Contractor must establish a control system and appropriate procedures consistent with the requirements of each section of the Specifications.

The contractor shall coordinate work hours with the Contracting Officer prior to implementation. All mandatory inspections by the Government are to be scheduled during normal work hours (7:00AM to 3:30PM, on Monday through Friday). Any other work period outside the coordinated work hours will require special/written approval from the Contracting Officer seven (7) days in advance of the proposed change in work periods.
F. 3 PLACE OF PERFORMANCE (JAN 2018)
This is a firm-fixed price construction contract for Emergency Egress System Installation for
Artemis II on Launch Complex 39B (LC39B) at Kennedy Space Center, FL.
F. 4 DOWNTIME AND EXCAVATION HOLDS (JAN 2018)
For the purposes of this contract, the Contractor must assume a maximum of 15 days during which all construction activities will be prohibited for Segment 2 work. In addition, the Contractor must assume a maximum of 5 days during which all excavation and other subsurface activities will be prohibited but other construction activities will be allowed.
F. 5 OPERATIONAL WORK AREA ACCESS CONSTRAINTS (JAN 2018)
Access to the ML-1 and Launch Complex 39B (LC-39B) construction sites will be limited due to ongoing operational requirements. No work will be allowed on the work site(s) except during assigned work windows.
(a) DEFINITIONS:
Work Window: A block of time, established by the Government, during which it is anticipated that scheduled launch or payload processing operations will permit on-site construction. The Contractor is responsible for completing construction tasks, including punch list items, within established work windows.
Downtime: A period of time within a work window when the Government must temporarily deny the Contractor access to the work site. The Government will provide twenty-four hour notice each time these restrictions are invoked. (Requests to excavate on days designated as “no dig days” must be submitted on KSC Form 50-1, Excavation Category Waiver, 7-10 days in advance of the designated “no dig days”.) Downtime days will be assessed when (1) a work window is active, and (2) the Government requires the Contractor to temporarily vacate the work site.
Days: Any reference to “days” must be construed to mean calendar days.
(b) CONSTRAINTS:
(1) Access to the work sites for pre-construction activities occurring before the construction work window, such as field measurements and field investigations, must be coordinated with the Contracting Officer at least 7 days prior to desired access date.
(2) The Government will notify the Contractor at least 7 days in advance of a work window. Multiple work windows may occur. Each work window will be broken into work segments, seen below. If the project involves work in more than one operational area, the contractor must schedule all work activities in each area independently. The minimum time that will be made available for completing all on-site construction is 90 days. The total of all work windows combined will be 406 days.
Work window milestone requirements, the project will be broken down in segments:
Segment 1: a notice to proceed (NTP) limited to submittals and off-site fabrications and testing (from NTP until the day after ML-1 move to LC-39B, (currently scheduled for July 1, 2022).
During Segment 1, after the launch of Artemis I (Currently scheduled for the end of November 2021), the contractor will be allowed to perform limited work on LC-39B without ML-1 such as set up of trailers and staging material in designated laydown areas shown on the drawings. (Note: The Crawler path will need to remain clear for the Crawler to bring ML-1 to LC-39B.)
Segment 2: a second NTP will be provided for work performed at the LC-39B. The work in Segment 2 must include installation and commissioning of all activities on site.
(3) Work windows may occur any time during the contract performance period. The
Government will schedule each work window depending on the availability of access to the areas affected.
(c) ADDITIONAL REQUIREMENT TO WORK WITHIN THE ML1 AND LC-39B:
(1) ML-1 (all locations)
Due to COVID restrictions, the elevators on ML-1 will be limited to 4 people at a time.
The contractor shall remove or secure all contractor equipment and debris for each movement of ML-1.
(2) ML Access
ML-1 is an Access Controlled Area within KSC. In addition to the security requirements in FAR 52.204-9, the following security controls apply:
All contractor personnel shall request a personal orange safety badge at the badging station located on SR 405 when receiving their initial KSC access/identification badges. If previously badged, the employee shall request a personal orange safety badge from the badging station. This orange safety badge may be required to be deposited in a badge board to facilitate an active headcount of personnel on site after entering ML-1.
In order to receive “unescorted temporary area access” overlay to ML-1 and be able to escort up to five (5) personnel, at a minimum a person must take and pass the following training courses in SATERN (https://satern.nasa.gov) or live (as applicable), and retaken at the intervals noted in parentheses:
(i) QG014KSC CLASS 1, DIVISION 2 FAMILIARIZATION SATERN Training
(ii) QG07CKSC- ELSA TRAINING SATERN Training
(iii) QG015KSC FLIGHT HARDWARE AWARENESS FOR VEHICLE PROXIMITY SATERN Training
(iv) QF135KSC ML AREA ACCESS ORIENTATION SATERN Training
(v) QG012KSC GENERAL PSM SATERN Training
(vi) KSC-QE-WBT-243: CLEANLINESS & CONTAMINATION CONTROL OVERVIEW SATERN Training
(vii) KSC-QE-WBT-244: CONTROL OF FOREIGN OBJECT DEBRIS SATERN Training
The above training applies to all personnel (civil servant and contractor) at KSC requiring unescorted access to ML-1. Lack of completion of the above training at the required intervals prior to badge expiration will result in denial of unescorted access to ML-1. As noted in KSC 52.204-9, it is the contractor’s responsibility to keep training records of all personnel and have required training completed prior to expiration for each person.
PLEASE NOTE: It typically takes 48-hours for training to update in the area access system, which may result in temporary revocation of access.
(3) Launch Complex 39B Access
LC-39B is an Access Controlled Area within KSC.
This orange safety badge may be required to be deposited in a badge board to facilitate an active headcount of personnel on site after entering the LC-39B perimeter.
In order to receive “unescorted temporary area access” to the LC-39B perimeter and be able to escort up to five (5) personnel, at a minimum a person must take and pass the following training courses in SATERN (https://satern.nasa.gov) or live (as applicable), and retaken at the intervals noted in parentheses:
(i) QF110KSC, KSC General Hazards Familiarization (3-years)
(ii) QF130KSC, Pad 39B Area Access Orientation (3-years)
(iii) QG012KSC, General PSM - Process Safety Management (1-year)
(iv) QE-WBT-244, Control of Foreign Object Debris (1-year)
(v) QG07CKSC, ELSA Training (1-year, Live Training Only—Schedule through COR)
The above training applies to all personnel (civil servant and contractor) at KSC requiring unescorted access to LC-39B. Lack of completion of the above training at the required intervals prior to badge expiration will result in denial of unescorted access to LC-39B. As noted in KSC 52.204-9, it is the contractor’s responsibility to keep training records of all personnel and have required training completed prior to expiration for each person.
PLEASE NOTE: It typically takes 48-hours for training to update in the area access system, which may result in temporary revocation of access.
The government does not provide escorts for contractor personnel. The contractor is responsible for properly escorting personnel in compliance with security procedures. As noted above, a person granted “unescorted temporary area access” may escort up to five
(5) personnel who have been issued “to be escorted temporary area access.” The escorted personnel must remain in visual contact with the escort at all times, within reason (for example, the escorted personnel may use a restroom or work in a confined space with single entry like an electrical manhole, while the escort remains directly outside). Repeated reports of improperly escorted personnel by security personnel typically results in revocation of “unescorted temporary area access” for the escort and possible disciplinary actions.
(4) Entering Launch Complex 39B
All personnel entering Launch Complex 39B are required to be processed through LC-39B main gate. Personnel will be required to have approved access through the KSC NASA Access Management System (NAMS) prior to entry and coordinated with the COR.
Personnel will be approved for either unescorted or escorted access. Any personnel approved for escorted access must have an escort with unescorted access approval.
All personnel approved for escorted access must be escorted at all times by personnel approved for unescorted access. Personnel approved for unescorted access may escort up to 5 personnel at any time unless specifically directed otherwise by the Contracting Officer.
Escorted personnel must remain within sight of the escort at all times.
In addition to being properly badged and having access approved, all personnel entering the Pad are required to have a Lenel PIN programmed onto their badge. This can be accomplished at the Badging Office at Gate 3.
(5) Driving within Launch Complex 39B Perimeter – Official Business Only
LC 39B has limitations on vehicle access. The contractor and subcontractors will use their privately owned vehicles (POVs) to access LC 39B. POVs include those vehicles owned by a company or corporation (i.e. contractor or subcontractor owned), and those owned by an individual. Vehicles must be licensed, registered, and insured within the requirements of applicable laws. Drivers must be licensed for the vehicle they drive. In order to have vehicle access to LC 39B, POVs are required to be issued a hang tag from the Pad Leader’s Office in the LC 39B Operations Building, J7-0689 (located east of LC 39B entry gate). Vehicles requiring temporary access to LC 39B will be issued a hang tag daily, picked up after 7:00AM and returned before 5:00PM, except where a special request to the CO for extended work hours has been approved. A process also exists for the contractor to request longer term hang tags for vehicles regularly requiring access to the LC 39B for the entire contract duration or extended periods within the contract that do not require daily return. The quantity of longer-term hang tags that can be issued is limited.
