14. The purpose of this amendment is to answer Contractor questions, change three (3) contract clauses, change two (2) Drawing sheet notes, and change one (1) Specification requirement.
1. Answers to Contractor Questions, 2 pages.
2. Change the following contract clauses in Section I.2 as follows:
a. FAR 52.219-6, Notice of Total Small Business Set-Aside (Nov 2011) is changed to read FAR 52.219-6, Notice of Total Small Business Set-Aside (Deviation 19- 02).
b. FAR 52.219-14, Limitations on Subcontracting (Jan 2017) is changed to read
FAR 52.219-14, Limitations on Subcontracting (Deviation 19-02).
3. Change contract clause I.7, Physical Data, sub-paragraph (c)(1)A.i. to read as follows:
i. The use of the Indian River Bridge (SR 405/NASA Causeway) is permitted. The Indian River Bridge (SR 405/NASA Causeway) has been permanently reduced to 35 mph for both spans (both directions). New weight restrictions for commercial trucks crossing the Indian River Bridge have been determined as follows: single unit truck (SU) — 10 tons, truck tractor semi-trailer (C) — 14 tons, single unit truck with one trailer (ST) — 16 tons. Vehicular use of the Indian River Bridge shall comply with the current posted weight limits.
4. Change Drawing 79K40776, Sheet D1, Demolition Notes, Note 15 - Add the following:
Use a screener size of ¾ inch opening. Fines passing through the screener shall stay onsite and can be use as sand dune fill material.
5. Change Drawing 79K40776, Sheet D6, Specific Notes, Flag Note D - Replace the word
GRUB with SHRUB.
6. Change Specifications 79K40711, Section 01 35 26 1.4.1.1. Site Safety and Health Officer (SSHO) - Replace the last sentence with the following: The SSHO or an equally-qualified alternate SSHO shall be at the work site at a minimum of 2-hours/work day during sand delivery, dune shaping, road resurfacing, implementation and administration of the Contractor’s safety programs and government accepted SSSP schedules only.

SF 1442 - Block 10 Block 10 - SF 1442 states that this procurement is a small business set-aside. Our understanding of the small business standard is a 3-year average of revenues that do not exceed $36.5 million/ year, or $109.5 of total revenues over a 3-year period. Further, as this is a construction project, it does not appear that having less than 500 employees serves to qualifiy an entity as being a small business. In order to avoid any potential size standard protest, will NASA perform any determination that a potential awardee actually is a small business prior to award regardless of their SAM profile?
Your understanding of the small business size standard is correct. The number of employees is not applicable in determining small business size. The size standard determination will be done in accordance with FAR 19.301-1.
Page 3 of Solicitation, SF 1442, Block 17 - Bid Form. Pages 5-6 of the Solicitation, Paragraph B.1.
Spec. Section 01 11 00 - Summary of Work, CLIN 7 of the Bid Form requires a unit price for 1 mile of "Additional Road Repairs."
Paragraph B.1 on Page 6 of the Solicitation further clarifies that this unit price is to "repair" one lane of additional road, but does not define the extent of the "repair."
Section 01 11 00 - Summary of Work provides varying definitions of "repair" for the various bid options, but does not define the extent of the repair required under CLIN 7, (i.e. mill and resurfacing only, full pavement reconstruction, etc.). Please clarify the extent of repair work for CLIN 7.
CLIN 7 refers to Heavy Mill and Resurface repairs per Option 3 of the contract documents. See 79K40777, C3 and C4 detail 2.
Page 14 of the Solicitation, Paragraph F.1
The paragraph immediately below the completion chart states "no road repair work shall begin until completion of all sand deliveries to the work site. Does this mean that second NTP would be issued prior to the final grading, planting, and any other activities that would occur after the sand is delivered, or is it intended to convey that the road repair NTP will not be issued until the Base Bid and Option 1 work is totally complete?
The second NTP will be issued at the completion of all sand deliveries to the work site.
Page 37 of the Solicitation, Paragraph I.7 (c) (1) - ROAD
This paragraph prohibits the use of the SR405/NASA Causeway bridge and any gates through Cape Canaveral Air Force Station for truck delivery of sand. With those restrictions, it would appear that the only approved gates for sand delivery would be South Highway 3 (Gate 2) and North Highway 3 (Gate 4). Please confirm that this is correct.
Access through Cape Canaveral Air Force Station is not permitted. However, use of the Indian River Bridge in permitted. See change to the Solicitation, Section I, I.7.(c)(1)A.i. included within this Amendment 2.
Page 64 of the Solicitation, Paragraph L.18, (c) (1) (i). Block 13.a of the SF 1442
This paragraph states to submit "one original and two copies" of the SF 1442 with our proposal. Block 13.a of the SF 1442 refers to an original and "1 copy." Please clarify this discrepancy.
Change the SF 1442, Block 13.a. to read 2 copies.
6 Attachment J-B, Paragraph J-B-20 (b), Page 11 - Permit Requirements
The referenced paragraph states that the contractor is responsible for a number of permits, "if required." Please clarify which of these permits will be required.
Depending on the contractor's means, methods, and controls, additional permitting may be required as listed.
Section 01 35 26 - Governmental Safety Requirements, Paragraph 1.4.1.1
The referenced paragraph states that a Site Safety and Health Officer (SSHO) is required to be at the work site at all times. Can the SSHO also serve as the Project Superintendent or does this need to be a separate person?
Project Superintendent shall be 100 percent committed to superintending the work required by this contract. The project superintendent shall not fill any other positions in performance of this contract or any other concurrent contract.
Section 01 35 26 - Governmental Safety Requirements, Paragraph 1.4.2.1, Page 26
The 4th paragraph on Page 26 refers to a Superintendent, "Q.C. Manager", and SSHO.
We have been unable to find any other reference or requirement for a Q.C. Manager other than in this paragraph. Please clarify any requirement for a Q.C. Manager.
Section 01 33 00 Paragraph 1.1.2.
Section 01 57 19 - Temporary Environmental Controls, Paragraph 1.5.4, Pages 43 & 44
This referenced paragraph requires an Environmental Manager and states that it can be a "collateral position" as long as the person is adequately trained. Please confirm that the term "collateral" means that the Environmental Manger can have other duties, such as Project Superintendent.
The Environmental Manager can have other duties but not as Project Superintendent.
Section 32 13 13.06 - Portland Cement Concrete Pavement for Roads and Site Facilities, Paragraph
1.4.2 - Contractor Qualifications, Pages 94 & 95
Paragraph 1.4.2 requires certified concrete craftsmen, certified concrete installers, and certified flatwork finishers. Given the relative small quantity of concrete flatwork on this project and the cost of complying with this requirement, can this requirement be waived?
For quality of work purposes - no.

The referenced paragraph states that the contractor shall have on-site personnel to visually monitor the sand being stockpiled at the sand mine for dune template placement. Is this person required to be employed directly by the contractor, or can it be an employee of the mine or an employee of an independent testing lab?
For ensuring the sand meets the physical requirements, the on -site personnel cannot be an employee of the mine and shall be employed by the contractor and under the direct charge of the contractor.
Section 35 30 00 - Beach and Dune Template Fill, Paragraph 3.4.3, Page 119.
The referenced paragraph states that the contractor shall have dedicated safety and flag persons on site at all time, whose sole responsibility is preventing unauthorized personnel from entering the work area. It is assumed that since this requirement is included in Section 35 30 00 it only applies to the dune fill. Please confirm that this assumption is correct. Also, does "at all time" intended to apply only to the periods when sand is being delivered to the site, or does it mean during all work activities related to the dune work, excluding planting?
The contractor is required to have one or more safety and flag persons depending on how the work zone is established. If the zone is controlled with one entrance and exit, only one is necessary. The safety and flag person is required whenever haul operations or dune work is taking place, excluding planting.
Section 35 30 00 - Beach and Dune Template Fill, Paragraph 3.7.1, Page 125.
This paragraph refers to a Quality Assurance Representative (QAR). IS the QAR a Government representative?
Correct
14 Demolition Note - "Remove railroad tracks, ties….."
Are the railroad ties creosote treated wood Or are they concrete. If a combination of both, can the quantity of each be confirmed?
The railroad ties are a combination of wood and concrete. The quantity of each was not determined.
15 Demolition Note - "Remove railroad tracks, ties….."
Will the wood ties be required to be brought to the Darcy disposal site? Will the concrete ties be required to be brought to the Darcy disposal site?
The railroad ties can not be disposed of at the KSC Schwartz Road Landfill. Yes, the clean concrete ties are required to be delivered to DARCY.
16 Demolition Note - "Remove railroad tracks, ties….."
Will the Contractor have salvage rights to the railroad tracks? Yes.
17 D1 Note 16 What are the hours and days of operation for Darcy at the KSC Landfill? DARCY is opened Tuesday and Thursday from 7:30am-3:00pm and closed for lunch 11:00-12:00nn.
D7 Do the concrete railroad ties get delivered to Darcy? Or is it contractors responsibility to dispose of railroad ties offsite from KSC?
There are two types of railroad ties - wood and concrete. The clean concrete ties shall be delivered to DARCY. The wood ties cannot be disposed off at the Schwartz Road Landfill and shall be disposed offsite from KSC.
D7 Do the wood railroad ties get delivered to Darcy? Or is it contractors responsibility to dispose of railroad ties offsite from KSC?
Do they contain hazardous materials such as creosote?
No. The wood railroad ties shall be disposed of offsite from KSC. The railroad ties were not sampled and it is unknown if they are coated.
EN1 If contractor is ahead of clearing and grubbing schedule, and the Gov't does not get the full four weeks in advance to relocate T&E species, will down days be issued for days that the contractor cannot continue clearing and grubbing?
Yes.
Task 1 shows that there are 264 calendar days stated for completion. F4 of section F calls out that contractor shall assume 50 days of down time. Is contractor expected to complete the scope of work in 214 days? If the Gov't only uses 20 of the down days, does the contractor have 234 days to complete the scope of work?
Yes, that is correct.
22 Can the contractor expect any of the trucks delivering sand to have be inspected at the badging station on SR 405? If so, how often will this happen?
KSC Security performs random inspections, typically twice in a given week.
23 Is clearing and grubbing restricted during the 15 days where all excavation and other sub surface activities are prohibited?
Any above surface activities are allowed during the "No-Dig days" period.
Sea Turtle season on KSC goes from 3/1 through 10/31. What are the restrictions that come with doing a beach restoration project during sea turtle season? If contractor cannot work because of Sea Turtle season, will down days be issued?
During Sea Turtle season, contractors are not allowed to drive along the beach shoreline. Down day/s will be issued if contractor cannot perform any work due to Sea Turtle season. We do not expect any restrictions on this project as Task 1 is 40 feet from beach shoreline and option 1 is on the west side of the completed dune.
