About this file
This document is a justification for other than full and open competition prepared by the National Aeronautics and Space Administration (NASA) Johnson Space Center (JSC). The justification provides rationale for awarding a sole-source purchase order to Sanmina Corporation for one Volatiles Investigating Polar Exploration Rover (VIPER) mission Camera Control Unit (CCU) for $114,000. Sanmina Corporation produced and tested the flight unit CCUs under a previous contract and is the only source capable of delivering an identical additional unit by November 2023 to reduce mission risk and support testing. Market research found no other sources able to meet the schedule and cost constraints for this specialized equipment required to meet the Agency's needs and launch date of November 2024 for the VIPER program mission.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
(JOFOC)
For 80JSC024PA003 – Sanmina Corporation
1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”
This document is a justification for other than full and open competition prepared by National Aeronautics and Space Administration (NASA), Johnson Space Center (JSC).
The procuring agency is the National Aeronautics and Space Administration (NASA) and the contracting activity is Johnson Space Center (JSC).
2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:
This justification provides the rationale for contracting by other than full and open competition to award a sole-source purchase order to Sanmina Corporation for 1 (one) Volatiles Investigating Polar Exploration Rover (VIPER) mission Camera Control Unit
(CCU).
3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the Agency’s needs (including the estimated value):
1 (one) assembled flight Camera Control Unit (CCU) is being procured to support the VIPER mission. The CCU is an electronic interface equipment that enables the VIPER rover avionics to communicate with the VIPER Visible Imaging System (VIS) at a higher level than would be possible if there was a direct connection between rover avionics and VIS cameras. It also allows a reduction in cabling between rover avionics and the VIS. The VIPER CCU being procured was manufactured to the same specifications as VIPER’s current flight unit CCUs and will be used as a flight spare to reduce mission risk.
The following equipment is being procured:
Item Part Number Quantity Estimated Cost Micro Camera Main Mechanical Assembly
MCSEVIPER-
FU-CCU-PT-
34000
1 $114,000.00
Total Estimated Cost $114,000.00
In order to meet the VIPER program schedule and reduce risk to the mission, the required delivery date for the CCU is November 13, 2023.
4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:
The statutory authority permitting other than full and open competition is 10 U.S.C.
3204(a)(2), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.
5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
Under 80JSC021P0006, the NASA VIPER Program developed, produced, and tested Flight Unit (FU) Camera Control Units (CCU), to implement the VIPER Visible Imaging Subsystem (VIS). Due to the increasing maturity of VIPER’s schedule and to mitigate risks during flight, the Government has a requirement to procure one additional CCU directly from the Sanmina Corporation, the vendor responsible for the production of the hardware.
Only one responsible source and no other sources are capable of delivering this unique hardware in the time frame required, and without substantial duplicative costs, to meet the Agency’s needs. Sanmina has produced and tested all CCU flight units and can quickly deliver an additional flight unit that would be identical to the flight units that will be used to assess in-flight anomalies and ground testing. Procuring a CCU from another source could create issues with assessing in-flight anomalies and testing since it would come from a different source than the original equipment manufacturer. The variances within the hardware produced by a different manufacturer would introduce additional risk when performing ground assessments or in being utilized as a drop-in replacement for flight units as needed by VIPER. Most importantly, failing to procure this highly specialized equipment directly from Sanmina Corporation substantially increases the risk of delaying the entire VIPER program mission and launch date, currently scheduled for November 2024.
6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
The Contracting Officer has determined that this action is exempt from the notice required in FAR 5.202(a)(11), because the proposed contract action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of FAR 5.207 with respect to the current contract action. Processing a notice would delay the procurement action, and the extent and nature of the harm to the Government would be of great financial injury and injury to the VIPER mission by delaying the scheduled launch date by minimum of 1 (one) year. The costs associated with such a delay could jeopardize the entire mission.
7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. For an acquisition less than the simplified acquisition threshold, certified cost or pricing data is not required. Using price analysis, the Government shall compare the proposed price to historical prices paid for the same or similar items, and shall use expert technical advice when analyzing similar items. The Government has similar items to compare to the price of the subject item.
8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons market research was not conducted:
This action is to procure an additional CCU recently produced under 80JSC021P0006. Prior to award of 80JSC021P0006, market research included publication of a formal RFI. No other sources were identified as possessing the capabilities to meet the Government’s requirements under the schedule and cost constraints needed to meet the Agency’s mission.
9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:
None.
10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:
This action is to procure an additional CCU recently produced under 80JSC021P0006. Prior to award of 80JSC021P0006, market research included publication of a formal RFI. No other sources were identified as possessing the capabilities to meet the Government’s requirements under the schedule and cost constraints needed to meet the Agency’s mission.
11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
The Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
