About this file

This is a Justification for Other than Full and Open Competition document submitted by the U.S. Coast Guard for a simplified acquisition threshold procurement.

The Coast Guard seeks to purchase two heating elements (NSN: 4410-01-483-2598, P/N: 5636) from Cummins Wagner, located at 10901 Pump House Road, Annapolis Junction, MD 20701, with a point of contact of Josh Andrucyk at (410)-792-4230. The total estimated procurement value is $20,312.00, with each unit estimated at $10,156.00. The heating elements are flanged immersion heaters rated at 480V, 36KW, 3-phase, 60Hz with Monel sheath elements and 6-inch 150-pound steel flanges, required for repair and restoration of hot water storage tanks aboard 210-foot WMEC Class Coast Guard Cutters. These elements provide heating to the potable water system used throughout the vessels for sanitary needs in galleys and berthing areas. The single-source justification is based on the determination that only one responsible source is available, citing proprietary data limitations. The Coast Guard did not purchase the original equipment manufacturer's proprietary data rights, specifications, or manufacturing drawings, making it impossible to determine with certainty whether alternative part numbers would mount to, interface with, or operate effectively with Coast Guard vessels. The original equipment manufacturer (identified as Cummins) is the only known source possessing the necessary techniques, design specifications, testing, quality assurance capability, and documentation to manufacture compliant parts. The Coast Guard Contracting Officer and Technical Representative have authorized proceeding with the single-source procurement while committing to continue market research efforts.

Justification for Other than Full and Open Competition Simplified Acquisition Threshold

1. Vessel: WMEC 210’

2. PR# 2126406B4500AF054

3. Description of Supplies or Services: Purchase 2 each, Heating Element, NSN:

4410-01-483-2598, P/N: 5636, estimated cost each, $10,156.00

Estimated Value of Procurement: $20,312.00

4. Source Available:

Name: Cummins Wagner.

Address: 10901 Pump House Road Annapolis Junction MD 20701 Phone: (410)-792-4230 POC: Josh Andrucyk

5. Pursuant to FAR Subpart 13.106-1 (b), the Contracting Officer may solicit from one source if they determine that the circumstances of contract action deem only one source reasonably available:

Check the appropriate reason below:

X - Only one responsible source and no other supplies or services will satisfy agency requirements, i.e. Unique capabilities, Limited number of sources, Proprietary data or

- Brand Name Mandatory

- Unusual & Compelling Urgency

- Exclusive Licensing Agreements

- Industrial Mobilization/Standardization

6. These items are needed for the repair and restoration of Hot Water Storage Tank used onboard 210’ WMEC Class Cutters. The Heating Element, Electrical is a flanged immersion heater that is 480 V, 36 KW, 3 phase, 60 Hz, Monel sheath element and 6”

– 150 lb steel flange. The Heating Element is the source to provide heating to the potable water system. The hot potable water is provided throughout the ship for sanitary need in the galley and berthing areas. The Coast Guard did not purchase the manufacturer's proprietary data rights, and therefore, cannot determine with certainty that an alternative part number would mount to, interface with, or operate effectively with Coast Guard Cutters. Failure of an alternative part, not conforming to the OEM's specifications, could create a situation that would cause the loss to ship’s operational mission. The manufacturing drawing and specifications have not been purchased by the Coast Guard.

8. When Coast Guard purchased the original equipment there were no requirements for manufacturer’s drawings, detailed parts lists, design or testing procedures. OEM is the only known manufacturer that has the techniques, design specifications, testing, quality assurance capability, and documentation necessary to manufacture these parts as used onboard Coast Guard Cutters.

9. COR will continue to conduct market research with a focus on locating vendors that are able to meet requirements, however without technical data described above obtaining full and open competition will be very difficult. The Coast Guard cannot require any vendor to release proprietary information.
