About this file

This document is a Justification for Other than Full and Open Competition for the U.S. Coast Guard. The procurement involves purchasing one hundred and thirty (130) Immersion Thermocouples (NSN: 6685-01-273-7708, P/N: 2342057) from Fairbanks Morse Defense at $618.52 per unit, with a total estimated procurement value of $80,407.60. The thermocouples are specifically needed for repairing and restoring Main Diesel Engines on 210' WMEC Class Cutters, with the purpose of measuring exhaust temperatures.

The justification for sole-source procurement stems from the Coast Guard's lack of proprietary manufacturing data rights, which prevents them from confidently using alternative part numbers. The original equipment manufacturer (OEM) is the only known source with the necessary technical specifications, design capabilities, testing procedures, and quality assurance documentation to manufacture these parts for Coast Guard vessels. The Contracting Officer has determined that Fairbanks Morse Defense is the only responsible source that can satisfy the agency's requirements, and the Contracting Officer's Representative (COR) will continue to conduct market research to potentially identify alternative vendors in the future.

Justification for Other than Full and Open Competition

Simplified Acquisition Threshold

1. Vessel: 210’ WMEC

2. PR# 2125405B4500AG273

3. Description of Supplies:

Purchase one hundred and thirty (130) each Thermocouple, Immersion, NSN: 6685-

01-273-7708, P/N: 2342057, Unit Price: $618.52 ea.

4. Estimated Value of Procurement: $80,407.60

5. Source Available:

Name: Fairbanks Morse Defense

Address: 701 White Ave., Beloit, WI. 53511-5492

Phone: (608) 364-8101

POC: Lynne Arnold

6. Pursuant to FAR Subpart 13.106-1 (b), the Contracting Officer may solicit from one source if they determine that the circumstances of contract action deem only one source reasonably available:

Check the appropriate reason below:

X- Only one responsible source and no other supplies or services will satisfy agency requirements, i.e. Unique capabilities, Limited number of sources, Proprietary data or

- Brand Name Mandatory

- Unusual & Compelling Urgency

- Exclusive Licensing Agreements

- Industrial Mobilization/Standardization

7. These immersion thermocouples are needed for the repair and restoration of the existing Main Diesel Engine used onboard 210’ WMEC Class Cutters. The

Thermocouple, Immersion is used to measure the exhaust temperatures of the main diesel engine. The Coast Guard did not purchase the manufacturer's proprietary data rights, and therefore, cannot determine with certainty that an alternative part number would mount to, interface with, or operate effectively with Coast Guard Cutters.

Failure of an alternative part, not conforming to the OEM's specifications, could create a situation that would cause the loss to ship’s operational mission. The manufacturing drawing and specifications have not been purchased by the Coast

Guard.

8. When Coast Guard purchased the original equipment there were no requirements for manufacturer’s drawings, detailed parts lists, design or testing procedures. OEM is the only known manufacturer that has the techniques, design specifications, testing, quality assurance capability, and documentation necessary to manufacture these parts as used onboard Coast Guard Cutters.

9. COR will continue to conduct market research with a focus on locating vendors that are able to meet requirements, however without technical data described above obtaining full and open competition will be very difficult. The Coast Guard cannot require any vendor to release proprietary information.
