The purpose of this Request for Proposal (RFP) solicitation is to provide the Transportation Security Administration (TSA) with Computed Tomography (CT) systems and all associated services and supplies to support the Checkpoint Property Screening System (CPSS) Program outlined under Qualification Product List (QPL) window 70T04019CPSSQPL-2, Full-size Window-2 Increment-1.

The proposed CT system must be qualified under the associated QPL in accordance with FAR 52.209-1 -- Qualification Requirements.

This RFP is issued as an Order under the CPSS Basic Ordering Agreement (BOA), where all BOA terms and conditions remain in full force and effect unless otherwise stated. Terms and conditions supplemental to those outlined in the BOA are addressed below.

In the event no proposed products or systems are successfully on the associated QPL by October 31, 2021, no BOAs for the subject technology shall be issued. In this instance, the TSA reserves the right to cancel this BOA Order solicitation or seek approval to continue the award process per FAR 52.209-1 -- Qualification Requirements. If the TSA determines to proceed with an award, the resulting contract action(s) of this RFP shall be a “C” type contract rather than a BOA Order. All applicable terms and conditions of the BOA shall be included in addition to the terms outlined in the RFP. All references to a “BOA Order” shall be replaced with “Contract”.

Upon approval, the TSA will electronically route the invoices back to FinCen. Upon receipt of certified invoices from an Authorized Certifying Official, FinCen will initiate payment of the invoices.

The Contractor should clearly indicate the contract number, invoice number and date, and the specific terms of the discount offered. Contractors should not structure terms for net amount payments any sooner than the standard period required under FAR Subpart

32.9 regarding prompt payments for the specified deliverables under contract.

2. Via the Payment Inquiry Form: https://www.fincen.uscg.mil/secure/payment.htm

Invoice Elements: Invoices will automatically be rejected if the information required in subparagraph (a)(2) of the Prompt Payment Clause, contained in this Section of the Contract, including EFT banking information, Taxpayer Identification Number (TIN), and DUNS number are not included in the invoice.

All invoices must clearly correlate invoiced amounts to the corresponding contract line item number and funding citation. The Contractor shall work with the Government to mutually refine the format, content and method of delivery for all invoice submissions during the performance of the Contract.

Supplemental Invoice Documentation: Contractors shall submit all supplemental invoice documentation (e.g. copies of subcontractor invoices, travel vouchers, etc.) necessary to approve an invoice along with the original invoice. The Contractor invoice must contain the information stated in the Prompt Payment Clause in order to be received and processed by FinCen. Supplemental invoice documentation required for review and approval of invoices may, at the written direction of the Contracting Officer, be submitted directly to either the Contracting Officer, or the Contracting Officer’s Representative. Note for “time-and-material” type contracts: The Contractor must submit the following statement with each invoice for labor hours invoiced under a “time-and-materials” type contract, order, or contract line item: “The Contractor hereby certifies in accordance with paragraph (c) of FAR 52.232-7, that each labor hour has been performed by an employee (prime or subcontractor) who meets the contract’s specified requirements for the labor category invoiced.”

If a mitigation plan is approved, the restrictions of this provision do not apply to the extent defined in the mitigation plan.

(e) Other Relevant Information: In addition to the mitigation plan, the Contracting Officer may require further relevant information from the offeror. The Contracting Officer will use all information submitted by the offeror, and any other relevant information known to DHS, to determine whether an award to the offeror may take place, and whether the mitigation plan adequately neutralizes or mitigates the conflict.

(f) Corporation Change. The successful offeror shall inform the Contracting Officer within thirty (30) calendar days of the effective date of any corporate mergers, acquisitions, and/or divestures that may affect this provision.
