MSEDS Competition Questions

Question Amendment 0001 Responses

XX designs handheld XXX analyzers designed for the rapid identification of unknown substances and explosives. May our product be somehow included in this solicitation?

The requirements of this solicitation shall not be revised.

Quoter shall provide evidence of product qualification via a copy of a letter issued by TSA adding the Offeror's product to the Qualified Procurement List for Tier 1 of the Electronic

Baggage Screening Program Requirements for Automated

Detection of Explosives, as this requirements must meet a

Qualificiation Requirement IAW FAR 52.209‐1, Qualification

Requirements.

Is # HSTS0412DCT1200 with L3 and # HSTS0412DCT1173 with Morpho Detection, Inc. were the incumbent contracts for this effort?

The only airport that has an incumbent Contractor that provided MSEDS products is AMA; TSA purchased one MSED for AMA. The incumbent is Smiths Detection who provided its CTX‐9400 EDS. All other airport locations are new inlines, and therefore have no incumbents.

Please confirm that the payment terms for the CLINs in solicitation 70T04019Q9CAP1002 follow the agreements set forth in the vendors current IDIQ for similar CLINs?

Payment terms under this solicitation shall be IAW RFQ

Section G.0.242.003, Submission of Invoices.

Are the systems listed in Table 3-1: Type 1 EDS in the PGDS (rev6

– 9/29/17) the only systems qualified to respond to this RFP?

The Version of the PGDS document has been updated in the

RFQ Section 3.0 Medium Speed Explosive Detection System

(MSEDs) Equipment, on page 14.

The following questions pertain to the Unit and Max Qty. listed in Sections 1.1, 1.2 and 1.4.

CLIN 0001: Project Coordination – Is the Project defined as each airport project or the total effort for all 21 systems at all 8 locations?

CLIN 0001, Project Coordination, as well as CLIN 0002, Design and Preplanning, will be CLINs executed at award, as they are not optional CLINs. These CLINs will be billed on a monthly basis. using the RFQ Attachment C ‐ Pricing

Template, the Contractor is to submit a quote for these base year CLINs and their corresponding Option Period

CLINs that have the capability to support the yearly Optimal

Timelines found in RFQ Section 1.6, Projected Milestones.

CLIN 0003 through CLIN 0006, CLIN 0008 and CLIN 0018:

Should the Unit be per MSEDS? If not, please define “Job” which is currently listed in the RFP.

The terms "JOB" is the only feasible option found in TSA's automatic contract writing system. Yes these CLINs are per

MSEDS.

RFQ pages 7-8, section I.1.6, provides that “The COR will notify the contractor of the finalized schedule within 10 business days after receipt of final schedule.” Does this mean that the finalized schedule will constitute a firm delivery date?

Please see the updated language in RFQ Section 1.6

Projected Milestones on pages 7‐8, and updated language in

RFQ Section 4.1.1, Pre‐Plannign Communications / Third

Party Coordination, on pages 17‐18.

RFQ pages 19-20, section II.4.2.2 SAT Procedures and Reports, third paragraph provides that “If the Government has required services requiring permits, companies with special qualifications and licenses, etc., Contractor shall provide such requirements.” Which permits, special qualifications, etc. does this RFQ require?

During SAT, the Contractor shall be responsible for acquiring airport badges (SIDA) and ensuring that its personal that do not have badges are escorted by their badged contractors to support SAT activities.

Amendment 0001

RFQ page 28, section II.7.4.1 Logistics Support Service Level Requirements specifies required Ao at the airport, machine and multiplex server level. Past experience shows that measures of performance are not statistically reliable for new operations and for small quantities of EDS. Would the Government add the following provision: “New site installations are exempt from RMA Metric SLA for the first 6 months of live operations due to stakeholders (TSOs, FSTs, BHS interface, logistics, etc.) learning curve. The Airport Level Ao requires a minimum of three (3) EDS units at an airport for the Values Operational Availability During Airport Operating Hours Ao to count.”

The Government will allow new site installations to be exempt from RMA Metric SLA for the first 6 months of live operatons. Please see updated language in RFQ Section

II.7.4.1, Logistics Support Service Level Requirements.

The Government does not accept the vendor's recommendation to include the following langauge in the

RFQ, "The Airport Level Ao requires a minimum of three (3)

EDS units at an airport for the Values Operational

Availability During Airport Operating Hours Ao to count.”

RFQ page 29, section II.7.5 Preventative Maintenance, last paragraph, provides that “The Government reserves the right for consideration if Level II PM is not completed as defined in the Level

II PM requirements above.” What are the limitations on the consideration the Government reserves the right to receive?

Would the Government remove this provision?

The Government will consider up to a 20% equitable price reduction of payment from the price of the purchased MSED if the PM Level II requirement is not completed as defined per the SOW.

RFQ page 50, section III.2.0, FAR 52.246‐17 Warranty for Supplies of a Noncomplex Nature, provides for a warranty of “24 months beyond successful SAT of an individual unit.” Shouldn’t the warranty period be “1 year beginning upon installation” as specified in RFQ page 26, section II.7.1 Equipment under Warranty, last paragraph?

Please see the revised language in FAR 52.246‐17, Warranty of Supplies of a Noncomplex Nature on pages 49‐50.

RFQ page 52, Section III.2.0, FAR 52.246‐19 Warranty for Systems and Equipment under Performance Specifications or Design Criteria

– TSA, paragraph (b)(1) provides that the warranties applies “only to those defects discovered … 30 days after discovery of the defect.”

Shouldn’t the warranty period be “2 years beginning at SAT” as specified in RFQ page 26, section II.7.1 Equipment under Warranty, last paragraph?

Please see the revised language in FAR 52.246‐19, Warranty of Systems and Equipment under Performance

Specifications or Design Criteria in page 52.

RFQ page 65, section III.4.0, TSA Special Contract Clauses H.

provides a payment milestone for CLIN 0009 MSEDS of “100%

Upon Successful Completion of SAT.” This is inconsistent with other EDS contracts and imposes a very large financial burden on the Contractor due to the long time from production to SAT and the lack of a firm delivery date. Would the Government revise the payment milestone to be “60% upon receipt of gantry from supplier, 20% upon successful completion of FAT and 20% upon successful completion of SAT?”

Payment terms under this solicitation shall be IAW RFQ

Section G.0.242.003, Submission of Invoices. No revisions to these instructions were made under this Amendment.

Table 3.1.2 on page 15 of 110 refers to the inclusion of a two‐year warranty in the MSEDS Scanner CLIN 0009. Separately CLIN 00018 calls for a two‐year Warranty. Does CLIN 0018 refer to a prospective following, Year 3‐4 Warranty, or should the two year

Warranty not be included within CLIN 0009?

CLIN 0018 does refer to a prospective following after the initial two (2) year warranty period that is included in the

MSED Scanner CLIN 0009.
