1) Is imported 9mm Luger acceptable for contract RFP70CMSW18R00000005?
Per Section 3.1 of the revised Attachment 1 – Statement of Work, the Offeror shall be the manufacturer of the ammunition and the ammunition shall be manufactured in the United States.
2) A quick question: EMG manufactures its US Made Ammunition but we are also a distributor for other manufacturers. Would you be open to accepting two manufacturers for the ammo? EMG Ammo and Fiocchi to supply the potential 18M rounds?
No, Section 3.1 of the revised Attachment 1 – Statement of Work states the Quoter must be the manufacture of the ammunition. Additionally, the ammunition must be manufactured in the United States. The is clarified in the updated SOW.
3) I need some guidance in filling out this document. I am a small business by definition and I will be subcontracting this sourcing to a distributor who will in turn be working with a large manufacturer. My biggest question is that within the document I am not allowed to put 0 or N/A vaules in certain graphs of information. How do I not put these values in if I am not working with a setaside like 8a, hubzone, etc.? My answer for these questions will include 0 or n/a values.
Per section (a) of FAR clause 52.219-9 – Small Business Subcontracting Plan, small business concerns are not required to complete small business subcontracting plans. This requirement only applies to large businesses. If your company plans on subcontracting some of the work, you are not required complete the plan if you are a small business.
However, please note, per Attachment 1
– Statement of Work, the Offeror shall be the manufacturer of the ammunition
4) What are the requirements for a manufacturing Quality Manual?
The Offeror shall have a QMS in place that enables the organization to identify, measure, control and improve key manufacturing processes. The Offeror shall provide a current QC/QA process synopsis with their solicitation sample including examples of its quality plans for the manufacturing of DHS ammunition. Submission of a complete copy of the manufacturing Quality Manual or a copy of the manufacturing facility ISO certification would fulfill this requirement.
5) Do we need to provide the purple case boxes or are the renderings sufficient for the sample?
Per Section 3.6.2 of Attachment 1 – Statement of Work: The 1,000-round shipping case and cartridge box/shipping case color requirements will be waived for the solicitation test sample if the Offeror provides a drawing with the solicitation documentation detailing the design of the cartridge box and shipping case that fulfills the above requirement and a statement that the First Article Test sample will be packaged in accordance with the design submitted.
6) Do we need ISO certification? In 3.3.1 it states "Submission of a complete copy of the manufacturing Quality Manual or a copy of the manufacturing facility ISO certification would fulfill this requirement" and in 4.2 it states that "we must submit written proof of manufacturing facility ISO".
Section 4.2 of the SOW reads: NOTE:
ISO 9001:2008/2015 certification is not required, but will suffice for compliance with Section 3.3.
In the absence of ISO compliance, the Offeror shall have a QMS in place that enables the organization to identify, measure, control and improve key manufacturing processes. 7) Is this a new requirement? if so who is the predecessor to this award?
This is a new requirement.
8) Will there be a separate CLIN for delivery or does delivery need to be included in price per round?
There will not be a separate CLIN for delivery. Delivery needs to be included in the fixed per case price.
9) Do we need 8000 rounds total or 8000 rounds for the FAT & solicitation sample test totaling 16,000 rounds?
Per Section 3.4.1 of the SOW, “Solicitation Sample Test. The sample size, per part number, for the solicitation submittal shall be 8,000 rounds.” Once the contract is awarded to an Offeror, per section 3.4.2 of the SOW, “First Article Test (FAT). The sample size for FAT shall be 8,000 rounds.”
10) The Statement of Work makes reference to ballistic equivalency to current Speer Duty 124+P load; Section 3.11 Ballistic Match, (page 7 of 9), lists a product symbol of #53927; while Section 4.10 Ballistic Match, (page 9 of 9) lists a product symbol of #35927.

The SOW has been updated to correct this error.
11) Attachment 2, (Page 3 of 8), 52.209-1 QUALIFICATION REQUIREMENTS; Section (b) makes reference to .223 duty rifle solicitation. We assume this is a misprint.
Attachment 2, page 3 has been updated.
12) Attachment 6, (Page 3 of 6), Delivery, Section 2) makes reference Lot Acceptance Testing (LAT) procedures. It was our understanding that LAT testing would not be a requirement for this RFQ/tender. Please confirm/deny/clarify.
There will not be Lot Acceptance Testing for this requirement, please the updated attachment 6.
13) Attachment 4, Pricing Schedule, ALL pricing pages indicate 2,700 rounds Lot Acceptance Test Samples-Not Separately Priced. As stated above, it was our understanding that LAT testing would not be a requirement for this RFQ/tender.
Lot Acceptance Test Samples have been removed. Please see revised Attachment 4 Pricing Schedule.
14) Can they proposal due date be extended by 45 days?
Due to time constraints, and testing requirements, an extension of 45 days is not possible. The quote response date has been extended by 4 days. Quote are now due on August 24, 2018.
15) Please clarify the instructions for submitting offers. The
Cover Letter states to submit the volumes via e-mail, but the Instructions to Offers (page 3) states to submit hard copies and CD.
The Quoter shall provide the following:
1) Emailed submission of Volumes I, II, III to the ian.somppi@ice.dhs.gov and muharrem.sayan@ice.dhs.gov (this must be received before the closing deadline)
2) A CD version of Volumes I, II, and III to the following address (this does not need to be received before the deadline, due to ICE mail processing requirements)

16) Instructions to Offers (page 2 and 3) states the volumes shall be submitted on a CD. Can the electronic versions be submitted on a CD or thumb drive?
They must be submitted on CD. The Government cannot accept thumb drives due to security concerns.
17) Attachment 1 (page 9) 4.10: SPEER PN should be corrected to 53927.

18) Attachment 2 (page 4), 52.209-4 states the FAT sample of 8,000 rds shall be delivered 60 calendar days after award. Can it be updated to 90 days after
No, it cannot be extended.
19) Attachment 2 (page 3), 52.209-1 references the SOW for .223. Please update to reference Attachment 1 SOW for 9mm RITA.

20) Attachment 1 (page 8), 4.6 specifies a random sample will be taken for cartridge visual and dimensional inspection. Is this sample size per ANSI/ASQ Z1.4-2008? Can any guidance be given between a “major” visual or dimensional defect versus a “minor” visual or dimensional defect?
The SOW has been updated to clarify major defects and sampling procedures.
OFTP shall inspect a subset of the submission cartridges (up to and including the sample in its entirety) using visible inspection and standard measuring equipment.
21) By what date would you need the 8,000 rounds delivered for testing purposes?
Delivery of FAT samples shall occur not more than 60 days after the date of award on this contract.
