U.S. Immigration and Customs Enforcement Florence Detention Center

1.0 Scope:
The scope of this task order is for preparation and painting of the several buildings at the Florence Detention Center located in Florence Arizona.
This Statement of Work is provided to ensure that the supplied goods and services adequately meet the need for which they were intended. The purpose is to support the Department of Homeland Security, Immigration & Customs Enforcement, Office of Asset and Facility Management, in meeting their mission requirements. This work will be done on a Monday thru Friday basis unless by mutual agreement between ICE and the contractor.
2.0 Info on Facility:
The Florence Detention Center is on 20.5 acres of land and is located two miles north of the Town of Florence, Arizona. The mission of the Florence Detention Center is to:
protect the public by detaining and removing those aliens who enter or remain illegally in the United States and whose stay is not in the public interest; provide a safe and humane environment for staff and detainees. The Florence Detention Center Facility is a minimum-security Facility and detainees are detained inside the secure area of the Facility.
The buildings required to be painted are;
The Operations Building (648) (Approx. 3,280 sq. ft.)
Fox Staging Facility (Approx. 20,560 sq. ft.)
Support Service Building (Approx. 13,781 sq. ft.)
Detention Housing Pods (qty. 5) (Approx. 23,880 sq. ft.)
Pod control (Approx. 215 sq. ft.)
Fox Housing Trailers #4 & #5 (Approx. 1,440 sq. ft.)
3.0 Locations:

The required work is located inside the secure area of the Facility.
4.0 Tasks
Overview:
The contractor will be preparing and painting buildings throughout the facility. The contractor shall furnish all paints, labor, tools, equipment and other necessary equipment, services, and supplies for painting. The contractor shall be responsible for protecting all curbing, cars, pavement, landscaping, and any other out of scope items from paint drips or splatter using plastic/cloth drop cloths, caution tape, or cones as appropriate. The contractor shall be responsible for the immediate cleanup of all accidental splatter, spillage, overspray, or misplaced paint.
The paint shall be applied uniformly with a combination of airless spray gun, rollers, and brushes and shall be free from runs, sags, wrinkles, streaks, shines, or brush marks.
Primer will be applied to all bare concrete block, wood, and metal as appropriate and small holes shall be filled prior to being painted.
The contractor will be responsible for painting all concrete block, all metal trim/flashing, all metal doors/frames (they will be sanded down as much as possible), permanent metal hand rails and the roofs of Ops and Pod Control will also be painted. The colors of the paint have yet to be discussed. Prior to any work being completed, a meeting be held and the colors will be discussed between the COR and the vendor. The contractor will be responsible for removing all debris and trash from the site on a daily basis. All tools and equipment will be removed from the site on a daily basis, also. Unless otherwise authorized by ICE Management.
The type of paint to be used is Dunn Edwards Evershield exterior paint or equivalent.
Velvet sheen paint is to be used for the block and metal trim, semi-gloss for the doors and hand rails.
Prep of Painted Surfaces:
The contractor shall prepare all surfaces that require painting to manufactures specifications. This includes, but is not limited to:
Utilization of pressure between 2,500-3,500 psi at a flow of 3-3.5 gallons per minute Removal of dirt, oil, grease, loose mill scale, mildew and loose paint from the surface area, using a 3-1 water and bleach solution.
Removal of dirt, dust, loose paint with a metal bristle brush as necessary Priming all bare metal and rust spots prior to top coat application, per manufacturer’s instructions.
5.0 Facility Access Requirements
The Contractor shall provide a list of all personnel that will require site access. After award, for each individual, the contractor shall provide, with their full name, date of birth and social security numbers. The Government will run a background check on these individuals prior to approving them access to the facility.
Contractors upon entering the facility will have to inventory all tools and equipment on a daily basis and also will have to self-inventory their tools and equipment before leaving the actual job site and will be inventoried at the facility sally port before leaving.
All vehicles entering the facility will be required to have all tools on an inventory sheet that will be provided to them prior to entry. To expedite entering the facility and not cause interruptions to the operation the contractor shall have all vehicle tools required kept to the minimum needed to complete the required work. Additionally, vehicles will not be permitted to enter the facility without a company logo/sign placed on both sides of the vehicle.
6.0 Facility Hours.
This is a 24/7 working facility. The actual hours that the contractor will be working will be determined post award. Normal working hours are from 0700 to 1700 (7am to 5pm).

52.211-12 LIQUIDATED DAMAGES—CONSTRUCTION. (SEPT 2000)
(a) If the Contractor fails to complete the work within the time specified in the contract, the
Contractor shall pay liquidated damages to the Government in the amount of $250.00 for each calendar day of delay until the work is completed or accepted.
(b) If the Government terminates the Contractor’s right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.228-5 Insurance—Work on a Government Installation. (JAN 1997)
(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract. The minimum amount of insurance shall correspond to the standard minimums associated with construction work with similar size and scope.
(b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government’s interest shall not be effective—
(1) For such period as the laws of the State in which this contract is to be performed prescribe; or
(2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.

3052.209-70 Prohibition on Contracts with Corporate Expatriates (JUN 2006)
(a) Prohibitions.
Section 835 of the Homeland Security Act, 6 U.S.C. 395, prohibits the Department of Homeland Security from entering into any contract with a foreign incorporated entity which is treated as an inverted domestic corporation as defined in this clause, or with any subsidiary of such an entity. The Secretary shall waive the prohibition with respect to any specific contract if the Secretary determines that the waiver is required in the interest of national security.
(b) Definitions. As used in this clause:
Expanded Affiliated Group means an affiliated group as defined in section 1504(a) of the Internal Revenue Code of 1986 (without regard to section 1504(b) of such Code), except that section 1504 of such Code shall be applied by substituting `more than 50 percent' for `at least 80 percent' each place it appears.
Foreign Incorporated Entity means any entity which is, or but for subsection (b) of section 835 of the Homeland Security Act, 6 U.S.C. 395, would be, treated as a foreign corporation for purposes of the Internal Revenue Code of 1986.
Inverted Domestic Corporation. A foreign incorporated entity shall be treated as an inverted domestic corporation if, pursuant to a plan (or a series of related transactions)—
(1) The entity completes the direct or indirect acquisition of substantially all of the properties held directly or indirectly by a domestic corporation or substantially all of the properties constituting a trade or business of a domestic partnership;
(2) After the acquisition at least 80 percent of the stock (by vote or value) of the entity is held—
(i) In the case of an acquisition with respect to a domestic corporation, by former shareholders of the domestic corporation by reason of holding stock in the domestic corporation; or
(ii) In the case of an acquisition with respect to a domestic partnership, by former partners of the domestic partnership
9 | P a g e by reason of holding a capital or profits interest in the domestic partnership; and
(3) The expanded affiliated group which after the acquisition includes the entity does not have substantial business activities in the foreign country in which or under the law of which the entity is created or organized when compared to the total business activities of such expanded affiliated group.
Person, domestic, and foreign have the meanings given such terms by paragraphs (1), (4), and
(5) of section 7701(a) of the Internal Revenue Code of 1986, respectively.
(c) Special rules. The following definitions and special rules shall apply when determining whether a foreign incorporated entity should be treated as an inverted domestic corporation.
(1) Certain stock disregarded. For the purpose of treating a foreign incorporated entity as an inverted domestic corporation these shall not be taken into account in determining ownership:
(i) Stock held by members of the expanded affiliated group which includes the foreign incorporated entity; or
(ii) Stock of such entity which is sold in a public offering related to an acquisition described in section 835(b)(1) of the Homeland Security Act, 6 U.S.C. 395(b)(1).
(2) Plan deemed in certain cases. If a foreign incorporated entity acquires directly or indirectly substantially all of the properties of a domestic corporation or partnership during the 4-year period beginning on the date which is 2 years before the ownership requirements of subsection (b)(2) are met, such actions shall be treated as pursuant to a plan.
(3) Certain transfers disregarded. The transfer of properties or liabilities (including by contribution or distribution) shall be disregarded if such transfers are part of a plan a principal purpose of which is to avoid the purposes of this section.
(d) Special rule for related partnerships. For purposes of applying section 835(b) of the Homeland Security Act, 6 U.S.C. 395(b) to the acquisition of a domestic partnership, except as provided in regulations, all domestic partnerships which are under common control (within the meaning of section 482 of the Internal Revenue Code of 1986) shall be treated as a partnership.
