STATEMENT OF WORK (SOW)

Law Enforcement Safety and Compliance– Duty Holster Purchase Requisition Number 20109473

March 2019

1.0 BACKGROUND

1.1 This requirement is for the procurement of duty holsters in support of US Customs and Border Protection’s (CBP’s) duty handgun. This effort is integral to providing effective Use of Force equipment to officers and agents within US Customs and Border Protection.

2.0 SCOPE

2.1 The intent of CBP is to contract for a duty handgun holster. This statement of work delineates the required performance and technical specifications for this contract.

2.2 Holsters shall be available for both left and right handed shooters.

2.3 Holsters shall be available for both light bearing and non-light bearing pistols.

2.4 Light bearing holsters shall be available for both optics mounted handguns and non-optics mounted handguns.

2.5 Holsters shall be available for a wide variety of polymer framed pistols, make/models with specific pistol fitment identified at the time of delivery order placement.

2.6 Additional administrative support shall be required, including but not limited to customer service support and invoicing/payment support.

2.7 The holsters will be issued to current officers and agents in the field, as well as to students at the various academies within CBP.

2.8 All vendors shall be either the manufacturer, or a manufacturer authorized distributor/retailer.

2.9 Holsters and accessories may be listed as separate contract line items, or combined into a group (i.e. holster + belt loop) listed as a single contract line item.

3.0 APPLICABLE DOCUMENTS/STANDARDS:

4.0 TECHNICAL AND ADMINISTRATIVE REQUIREMENTS:

4.1 GENERAL REQUIREMENTS

The following requirements apply to all holsters unless noted.

4.1.1 Holster - every holster, including all components, shall be new.

4.1.1.1 Construction Material

4.1.1.1.1 Shall be one-piece, mold-injected, rigid synthetic type material, black in color. Thermo-molded plastic will not be accepted.

4.1.1.1.2 Shall not be constructed of leather, nylon, or other fabric material.

4.1.1.1.3 The trigger guard of the handgun shall be encased within the holster when the handgun is secured in place.

4.1.1.1.4 Shall be impervious to liquid penetration or blood borne pathogens.

4.1.1.1.5 Shall maintain structural integrity from -50 degrees to 300 degrees Fahrenheit.

4.1.1.1.6 Shall have a low Infra-red (IR) Signature.

4.1.1.1.7 Shall meet flame resistance to Underwriters Laboratory UL 94 H-B standard (slow burning on a horizontal specimen less than 76 mm/min for thickness less than 3mm).

4.1.1.1.8 Shall meet flame resistance to Underwriters Laboratory UL 94 V-0 standard (vertical burn; burning stops within 10 seconds, NO flaming drips are allowed).

4.1.1.2 Retention Mechanism

4.1.1.2.1 Shall be self-locking upon holstering the weapon.

4.1.1.2.2 Locking mechanism shall not utilize any of the handguns polymer parts to secure the weapon.

4.1.1.2.3 Retention device shall not involve movement external to the holster, except for the actual retention release button or lever.

4.1.1.2.4 Shall allow for a straight up draw once released.

4.1.1.3 Retention Release Mechanism

4.1.1.3.1 Shall be a Level II Retention holster that can be easily converted to a Level I.

4.1.1.3.2 Shall be operated by the thumb, accessible to the user while maintaining a firing grip on the holstered weapon.

4.1.1.3.3 Shall not utilize a trigger finger actuated release.

4.1.1.3.4 Retention release mechanism shall be capable of withstanding a minimum of 250 lbs. pull rate (static force applied in 6 pulling directions).

4.1.1.4 Environmental Conditions

4.1.1.4.1 Shall function in all CBP environments to include; sand, dust, snow, ice, and salt water.

4.1.1.4.2 Shall allow the immediate release of water and debris.

4.1.1.5 Mounting Platform

4.1.1.5.1 Shall include two (2) belt loop mounting platforms (mid ride and low ride) designed for use on 2 ¼” or 2” belt.

4.1.1.5.2 The shank of the holster shall be one-piece, injection molded, rigid synthetic type material, and black in color. The holster or quick detach mechanism shall attach to the belt loop platform (shank) by means of bolts, machine screws or wide head rivets.

4.1.1.5.3 Shall include a quick detach mounting device to mount holster to either of the belt loop platforms.

4.1.1.5.4 Shall have the modularity of mounting holster to multiple platforms.

4.1.1.5.5 Once the initial configuration is complete, no tools shall be necessary to move the holsters between different platforms.

4.1.1.5.6 Quick detach interface shall be capable of withstanding a minimum of 250 lbs. pull rate (static force applied in 6 pulling directions).

4.2 PERFORMANCE AND TESTING REQUIREMENTS

4.2.1 All pull testing shall take place at an independent National Institute of Justice (NIJ) laboratory approved for Auto Loading Pistols to CBP specifications.

4.2.2 Pull test shall first be completed on the holsters weapon retention capabilities.

4.2.2.1 Setup

A Holster Holding Fixture will be rigidly mounted to the bed of the Instron 3366 tension/compression machine. The Holster Holding Fixture will have at minimum the following properties and characteristics:

4.2.2.1.1 The fixture will engage the holster using the factory bolt/screws that would mount the holster to a belt loop mount

4.2.2.1.2 The fixture will be made of steel or a similar rigid material will neither positively nor negatively affect the retention strength rating of the holster in any direction.

4.2.2.1.3 The fixture will allow for the holster to be positioned such that all six (6) pull directions can be achieved.

4.2.2.1.4 The fixture will be rigidly mounted to the bed of the tension/compression machine.

4.2.2.1.5 The mounting conditions of the Holster Holding Fixture will be such that when the head of tension/compression machine moves vertically, either in tension of compression, the holster and fixture will remain static. A modified Ransom Rest Grip will be attached to the grip of the duty weapon. Any area of the unmodified ransom rest that interferes with the holster will be removed so that the Ransom Rest Grip will not impede the removal of the duty weapon from the holster. Holding the two sides of the Ransom Rest Grip together will be a clamping system. The clamping system will have the following properties and characteristics:

4.2.2.1.6 The clamping system will ensure that the Ransom Rest Grips do not slip on the duty weapon during testing.

4.2.2.1.7 The clamping system will have a design that will facilitate testing in all six (6) pull directions.

4.2.2.1.8 The clamping system will allow for the tension/compression machine to be directly attached to it through the use of a rigid connecting rod, or similar method.

4.2.3 Attached to the load cell of the tension/compression machine will be a receiving chuck that is compatible with the rigid connecting rod. Figure 4.1 details the six (6) pull directions:

4.2.3.1 The six (6) pull directions will be as follows:

4.2.3.1.1 Vertical Pull: Out of the holster, parallel to the bore axis of the duty weapon.

4.2.3.1.2 Vertical Pull: Into the holster, parallel to the bore axis of the duty weapon.

4.2.3.1.3 Rear Pull: Normal to the bore axis, and along the central axis of the weapon.

4.2.3.1.4 Forward Pull: Normal to the bore axis, and along the central axis of the weapon.

4.2.3.1.5 Away from Body Pull: Normal to the bore axis, and normal to the central axis of the weapon.

4.2.3.1.6 Into the Body Pull: Normal to the bore axis, and normal to the central axis of the weapon.

4.2.3.2 Pull Testing

4.2.3.2.1 The holster and test equipment will be setup as described in section 4.2.2.1. All testing will be performed with a magazine in the duty weapon. Both the magazine and the weapon chamber will be free of any rounds. The same holster will be used for testing in all six (6) pull directions. Once the duty weapon, holster and fixture are positioned for the applicable pull, the technician will ensure that there is no load bearing applied to the fixture. At this point the software will be “zeroed”. This will “zero” both the load and extension readings in the software. The tension/compression machine will load the holster at 1,500-lbf/min until the load reaches 250-lbf. Once 250-lbf is reached, this load will be maintained for 30-seconds. After the holding period, or if the holster fails, the final load applied and total vertical displacement will be recorded. A graph showing Force vs. Vertical Displacement shall be produced and reported. Following each pull, the retention device will be operated to ensure holster operability.

4.3 QUALITY CONTROL and QUALITY ASSURANCE

4.3.1 The manufacturer shall be certified by an authorized registrar that offers third-party audit services to the ISO 900X series standards, namely the International Standards of Quality Control as described in International Standard ISO 900X (Quality Systems – Models of quality assurance in design, development, production, installation and servicing). This does not apply to distributor/retailer.

4.3.2 No changes in design of any holster/part contained within this contract shall take place without the prior approval of the COR and CO.

4.3.3 Holsters which fail any portion of the vendor’s (including manufacturer’s) QC testing shall be rejected and not shipped. No further attempts shall be made to correct or otherwise remediate a holster (or part) which has failed any portion of the QC testing, for purposes of delivery under this contract.

4.3.4 The Government may conduct periodic random Quality Assurance (QA) testing of holsters and/or parts produced under this contract, to ensure items meet performance requirements for which the contract was awarded.

4.3.5 QA testing may be conducted by government personnel at a government owned facility, or may be conducted by a NIJ Certified Laboratory.

4.3.6 Holsters and/or parts which fail QA testing may be returned to the vendor, at no cost to the Government, and replaced with an equal amount of new supplies. The Vendor shall be notified by the COR, in writing, of the nature of the failure, defect, or deficiency.

4.3.7 Vendor shall take corrective action within seven (7) calendar days of written notification of any contract non-conformance. Corrective action shall include shipping of replacements for all defective, deficient, or suspect holsters and/or parts. The vendor shall also provide a written failure analysis plan to the COR, within seven (7) calendar days. A completed failure analysis report, to include preventative measures, shall be submitted to the COR within 60 calendar days of notification from CBP.

4.4 WARRANTIES

4.4.1 Vendor shall warrant all products contained in this contract to be free of defects and of merchantable quality within the meaning of the Uniform Commercial Code. Vendor further warrants that the product conforms to all applicable requirement as outlined within this Statement of Work, and guarantees that the product will maintain a useful shelf life under reasonable storage conditions (both CONUS and OCONUS) for a period of ten (10) years from the date of purchase.

4.4.2 The vendor shall provide to the COR a single point of contact (including name, phone number, and email address) who will handle all warranty claims occurring under this contract.

4.4.3 The vendor shall utilize FEDEX, UPS overnight, or other trackable next day service for all warranty shipments to the government. Ground service may be used for return shipping. Exemptions may be authorized by the COR on a case by case basis. All shipping charges associated with warranty claims (both to and from the government) shall be the vendor’s responsibility.

4.4.4 The vendor shall replace any holster that has a gross failure due to workmanship or material defect with a new complete replacement holster. In cases of broad based systemic issues that may be corrected by the vendor more efficiently in the field, at no cost to the government, the COR may authorize an alternative plan of corrective action.

4.4.5 Due to operational needs, all defective holsters shall be retained by the government until a replacement holster has been received and issued to the end user. At this time, the defective holster(s) shall be returned to the vendor.

4.4.6 The vendor shall complete and ship to the government all warranty claims within seven (7) calendar days of notification by the COR (or COR authorized designate). Exceptions may be made by the COR for broad based systemic issues requiring high volume returns.

4.4.7 Should any new or modified part be manufactured or recommended by the vendor to rectify any unforeseen defect, deficiency or performance issue, the contractor shall provide the government with the "upgraded" part for every holster purchased during the warranty period.

4.5 GOVERNMENT ACCESS OF CONTRACTOR'S FACILITY:

4.5.1 The vendor shall permit the government to conduct quality control inspections of the vendor’s facility (including production facility) to ensure consistency of manufacture and quality of products ordered and delivered.

4.5.2 The authorized inspection team shall be identified in writing by the COR or the CO.

4.5.3 The minimum advance notice of inspection shall be three business days.

4.5.4 Inspections may include all aspects of manufacturing, testing, quality control, packaging and delivery.

4.6 PRODUCTION CAPACITY

4.6.1 The Government requires that a vendor have capacity to manufacture a minimum of 3,500 holsters per month.

4.6.2 Orders in excess of the minimum monthly requirements must be shipped in accordance with instructions in any resultant delivery order.

4.7 DISTRIBUTION AUTHORIZATION

4.7.1 Vendor (if not the manufacturer) shall provide a letter from the manufacturer, indicating that they are an authorized distributor/retailer of the proposed holster. Unauthorized distributor/retailers are not acceptable.

4.8 SHIPPING

4.8.1 Shipping locations may be centralized, or may include individual locations throughout the CONUS, Alaska, Hawaii, and Puerto Rico.

4.8.2 All items are to be shipped FOB destination.

4.8.3 Holsters shall be shipped by either Common Carrier Freight or Express Overnight Shipping (i.e. FedEx Express Overnight).

4.8.4 Holsters shipping method for each location may be specified by the ordering agency at the delivery order level and may vary depending on location, quantity of holsters, and receiver’s ability to handle freight shipments.

4.8.5 All shipments shall be trackable. Tracking information shall be provided to the COR (or their designate) upon request.

4.8.6 The vendor shall provide advanced notice of shipping via email, two (2) business prior to each shipment. Notification shall be sent to the COR or COR’s designate, and to the local recipient for each shipping location.

4.9 PACKAGING

4.9.1 Preservation, packaging, and packing for all items delivered shall be in accordance with commercial practice and adequate to ensure acceptance by common carrier and safe arrival at destination.

4.9.2 Pallets and associated packaging, when used for shipping, shall be fully enclosed, and shall be stackable allowing for a second complete pallet to be placed on top of a first complete pallet, without structural problems or damage to the contents of either pallet.

4.9.3 Vendor shall place the contract and delivery order number on or adjacent to the exterior shipping label.

4.9.4 For delivery order locations receiving greater than 5 (qty.) units, holsters shall be packaged in bulk and shall not contain individual packaging. Effort shall be made to minimize packing material, including selection of an appropriate size box or pallet container for the quantity being shipped.

4.10 VENDOR PERFORMANCE CONFERENCES

4.10.1 Within 30 days of contract award, the vendor shall host a pre-production meeting at a location of the government’s choosing.

4.10.2 CBP and the vendor may meet in person once per year, commencing six months after production begins and continuing approximately every year thereafter. These performance conferences are to discuss contract issues, review the technical and financial status of the contract, discuss vendor and Government performance, and to resolve any problems or other issues as they may arise. Each year, the meeting location shall be at the discretion of the Government.

4.10.3 Government attendees may include, at a minimum, the Contracting Officer and/or the Contract Specialist, and the Contracting Officer’s Representative. Other attendees may include but are not limited to representatives from the various DHS components.

4.11 REPORTING REQUIREMENTS

4.11.1 Delivery schedule of reports.

4.11.1.1 Reports identified below in Sections 4.11.2, and 4.11.3 shall be provided to the Contracting Officer, COR, or his designated representative at the request of the Contracting Officer, COR, or his/her designated representative.

4.11.1.2 Reports shall be provided in electronic format, and shall be cumulative throughout the contract.

4.11.2 Warranty Work Reports

4.11.2.1 The Warranty Work Report shall include a line item summary of all warranty activity; as well as the numerical totals of claims received, total completed, and the average number of days required for completion.

4.11.2.2 Each line in the report shall contain the following information: agency; purchasing group; returned merchandise authorization (RMA) number, date vendor was notified; date corrected holster was shipped to vendor; brief statement of the problem; brief statement of the solution, date shipped back to the government.

4.11.2.3 The Warranty Work Report shall be categorized by agency, purchasing group and ordered chronologically by the date the vendor received notification.

4.11.3 Delivery Order (DO) Report

4.11.3.1 The Delivery Order Report shall include a cumulative line item excel spreadsheet of all delivery orders.

4.11.3.2 Each line in the report shall contain the following information: the name of the purchasing agency/group; delivery order (DO) number, unit cost, quantity of units on DO, value of DO, current quantity of units shipped, the current number of units remaining to be shipped, and the total dollar amount spent against the contract up to that point.

4.12 MEDIA STATEMENTS

4.12.1 All press statements and releases related to the contract shall receive advanced written approval by the Contracting Officer (CO) and Contracting Officers Representative (COR).

5. DELIVERABLES AND DELIVERY SCHEDULE:

5.1. Deliverables and delivery schedule will be provided per each individual delivery order.

6. PLACE OF PERFORMANCE:

6.1. Place of performance shall be CONUS, Alaska, Hawaii, and Puerto Rico.

7. PERIOD OF PERFORMANCE:

7.1. The contract will have a five year period of performance from date of award of the contract.

8. SECURITY:

8.1. All work under this SOW is UNCLASSIFIED, but may require secure handling of information designated as for official use only (FOUO) and/or personally identifiable information (PII).

8.2. Vendor personnel who will perform work on the contract may be required to execute a non-disclosure agreement (NDAs), which must be delivered to the COR prior to commencing work in accordance with DHS policy for safeguarding FOUO information.

8.3. Vendor will be responsible for ensuring that, if required, its personnel adhere at all stages of performance of the contract to the dictates of DHS policy for safeguarding PII.
