SECTION M – EVALUATION FACTORS FOR AWARD
CBP intends to award one or more contracts resulting from this solicitation to the responsible Offeror(s) whose offer conforming to the solicitation will be most advantageous to CBP, price and other factors considered. The following factors, listed in descending order of importance, shall be used to evaluate offers:
Factor 1: Technical capability
Factor 2: Past performance
Factor 3: Price
Factor 1, Technical capability, is the most important factor.
Factor 2, Past Performance, is the second most important factor.
Factor 3, Price, is the least important factor.
Factors 1 and 2, when combined, are more important than Factor 3, Price.
M.1.0 Evaluation Factor 1 – Technical Capability
Mere restatement of the requirements or statements from the Offeror that the offer is compliant with the solicitation without containing a description of the approaches, techniques, solutions, and/or processes proposed to satisfy the technical requirements, will be grounds for CBP to assign a very low rating for those criteria. Generally speaking, "generic" information may rate lower than information "well-tailored" to the CBP requirement. The Government will evaluate the extent to which the Offerors’ proposed approach demonstrates an understanding and meets all specifications and requirements of each task identified in the Statement of Work (Sections C.5.1 through C.5.7). As part of this evaluation, risk will be assessed. Risk is the degree to which an offeror’s approach to achieving the technical factor may involve risk of disruption of schedule, increase in cost, degradation of performance, the need for increased Government oversight, and/or the likelihood of unsuccessful contract performance.
Government will then, based on criteria stated herein, assign a Confidence Level presented in the table below.
Table 1. Technical Capability Confidence Levels
Rating Definition
High Confidence The Government has high confidence that the Offeror understands the requirement, proposes a sound approach, and will be successful in performing the contract..
Some Confidence
The Government has some confidence that the Offeror understands the requirement, proposes a sound approach, and will be successful in performing the contract.
No Confidence The Government has no confidence that the Offeror understands the requirement, proposes a sound approach, or will be successful in performing the contract.
Table 2. Technical Capability Risk Ratings
M.2.0 Evaluation Factor 2 – Past Performance
Past Performance will be evaluated and assigned a single level of confidence based on two aspects:
1. Offerors’ stated past performance will be evaluated to determine the relevance of recent completed contracts of similar size, scope, and complexity to the solicitation requirements.
2. Past Performance Questionnaires will be evaluated based responses submitted by previous Government or Municipal customer entities. These past performance examples will be evaluated based on their scores as well as whether or not the work was of similar size, scope, and complexity.
The Government will then, based on criteria stated herein, assign a Confidence Level presented in the table below.
Table 3. Past Performance Confidence Levels
Rating Definition
High Confidence Based on the Offeror’s past performance record, CBP has a high expectation that the Offeror will successfully perform the required effort.
Some Confidence Based on the Offeror’s past performance record, CBP has an expectation that the Offeror will successfully perform the required effort.
No Confidence Based on the Offeror's past performance record, CBP has no expectation that the Offeror will be able to successfully perform the required effort.
Unknown Confidence (Neutral)
No past performance record is available, or the Offeror’s past performance record is so sparse or is determined to be not relevant to the requirements set forth in this RFP that no meaningful confidence assessment rating can be reasonably assigned.
CBP reserves the right to consider past-performance information not included or mentioned in an Offerors’ proposal, including information on contracts not submitted, mentioned in an Offerors’ proposal, or by any other sources available to the Government.
If a lack of past performance history exists or it is determined to be not relevant, CBP will rate the proposal with Neutral Confidence.
M.3.0 Evaluation Factor 3 – Price
While price will not be assigned a rating during the evaluation, the Government will evaluate to determine price reasonableness and make an overall best value determination. In conducting the price evaluation, CBP will evaluate only the information contained in the Offeror’s Price Proposal (and, if requested, submitted supporting information). Offerors’ are encouraged to provide their best prices as CBP reserves the right to award without discussions. Any quote with pricing determined not fair and reasonable may be determined unacceptable. A Price Proposal found to be unrealistically low or unrealistically high may be considered to reflect a lack of understanding of the requirements. Offerors are cautioned that unreasonably high or unrealistically low proposed prices may be grounds for eliminating a Proposal from consideration for award.
M.4.0 Basis for Award
CBP intends to award one or more contracts on a best value basis to the Offeror(s) that are determined to be the most advantageous to the CBP, price and other factors considered. Offerors are cautioned that an award may not necessarily be made to the lowest priced Offeror. However, if non-price factors are evaluated as comparatively equal between two or more Offerors, price may become a determining factor.
