The requested services include provision of the Clarity Cycle Framework Intensive Training, Better Data Meetings Tomorrow Training, and delivery of programs that develop leadership skills in clarity, accountability, and facilitation. The contract term runs from December 1, 2026 through December 1, 2027, with services targeted at leadership teams and instructional coaches to enhance their understanding and application of the Professional Learning Community (PLC) framework, data analysis capabilities, and facilitation skills.

The prospective contract amount is $62,550.00 before tax, with estimated taxes of $3,803.60. The contractor's SHARE Vendor Number is 325665, and the primary contact is Casey Watts at 936-433-2522. The scope of work includes: Provision of the Clarity Cycle Framework Intensive Training Provision of the Better Data Meetings Tomorrow Training Utilization of the exclusive "Clarity precedes capacity™" methodology mailto:alvaradoj@hobbsschools.net mailto:casey@clarity-driven.com

Delivery of programs that develop leadership skills in clarity, accountability, and facilitation Assurance that these offerings are the only ones authorized to deliver these proprietary programs, with no third-party resellers involved

V. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

For this project, HMS is looking for a contractor who can provide professional development for leadership teams and instructional coaches. The focus will be on helping these teams understand and apply the Professional Learning Community (PLC) framework better, especially during team meetings. The contractor should also be able to support content and grade-level teams in analyzing data, making decisions based on that data, and communicating their findings clearly to the team.

Additionally, the criteria specify that the contractor must be able to clarify the roles and goals of team members, train leaders on how to facilitate effective data meetings, and help staff set clear, high-quality goals. The contractor should also promote high standards of accountability and teach strong facilitation skills.

In reviewing available sources, the agency considered the contractor’s experience and ability to deliver training in these specific areas, ensuring they can help improve team collaboration, data use, and leadership practices across the district. The criteria are designed to ensure that the selected contractor can effectively support the district’s efforts to improve teaching and learning through clear, practical professional development.

VI. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

The prospective contractor, Casey Watts, Coaching & Consulting, LLC, is uniquely qualified to provide these leadership development programs because they are the sole developer and owner of the proprietary content and methodology. The "Clarity precedes capacity™" methodology, which underpins the training programs, is a trademarked and legally protected process. No other vendor or professional development provider has the legal rights or credentials to deliver, replicate, or adapt this framework.

Furthermore, the company possesses specialized expertise and exclusive capabilities that are critical for delivering the programs effectively. These include:

● Proprietary Ownership Transfer: The ability to develop leaders' skills in clarifying goals, roles, and action plans, which enables leaders to transfer psychological ownership of initiatives to teachers—a capability not available elsewhere.

● Autonomous Accountability: Training leaders to hold teams accountable without micromanagement, a core feature of the proprietary framework that cannot be matched by other providers.

● Facilitator vs. Manager Paradigm Shift: Transforming leaders into effective facilitators rather than traditional managers, ensuring meetings drive actionable outcomes and collaboration.

These unique capabilities, combined with the company's exclusive rights to the content, make Casey Watts, Coaching & Consulting, LLC, the only source capable of providing these specific programs. Their proprietary rights, expertise, and the specialized nature of the methodology are essential for achieving the intended leadership development outcomes, and no other organization possesses these qualifications or rights.

VII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

The professional services provided by Casey Watts, Coaching & Consulting, LLC are unique because they are based on an exclusive, trademarked methodology called "Clarity precedes capacity™," which the company owns and does not license or sell to any other vendor. This proprietary approach offers specialized capabilities—such as developing leadership skills in clarifying goals, fostering autonomous accountability, and transforming leaders into effective facilitators—that are not available from any other provider.

This uniqueness is directly related to the purpose of the contract, which is to develop effective leadership within educational settings. The programs are designed to create measurable improvements in leadership practices that drive student achievement and school improvement initiatives. Because these programs and the underlying methodology are protected by intellectual property rights and cannot be replicated or delivered by other organizations, this ensures that the training aligns precisely with the agency’s goals for high-quality, consistent leadership development.

In essence, the distinctiveness of these services is essential to achieving the contract’s purpose, as only these proprietary programs have been proven to develop the specific leadership capabilities required for successful implementation of educational initiatives.

The specialized nature of the content ensures that the outcomes are aligned with the agency’s strategic objectives, making this offering uniquely suited and directly related to the intended purpose of the contract.

VIII. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;

contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

HMS conducted comprehensive due diligence to establish the basis for this procurement, ensuring that the selected provider is uniquely qualified and capable of fulfilling the contract requirements. The process included researching industry resources such as trade publications, industry newsletters, and online platforms to identify potential vendors offering leadership development programs similar to those required.

HMS also contacted several professional development service providers to inquire about their offerings, capabilities, and rights to deliver proprietary leadership training programs.

These contacts were made via telephone between June 22, 2026 and July 10, 2026, with detailed records maintained of each communication. The providers contacted included:

● Solution Tree – contacted via telephone on July 6, 2026

● CES – contacted via telephone July 6, 2026

● WestEd– contacted via telephone on June 29, 2026

Each provider was asked about their ability to deliver proprietary, trademarked leadership programs similar to the "Clarity precedes capacity™" methodology. Documentation from these communications indicates that these organizations either lack the legal rights to deliver or replicate the proprietary content, or do not possess the specialized expertise or exclusive rights necessary to meet the unique capabilities requested by HMS.

Additionally, HMS reviewed the State Purchasing Division’s Statewide Price Agreements to identify any pre-approved vendors with relevant offerings. This review confirmed that no existing statewide contracts include the proprietary programs or methodologies required.

Based on this due diligence, HMS determined that no other businesses are capable of performing the contract because the programs are protected by intellectual property rights, and only Casey Watts, Coaching & Consulting, LLC, owns and delivers the proprietary "Clarity precedes capacity™" methodology. This proprietary nature ensures that only the designated provider can meet the specific technical and philosophical requirements of the contract, making them the sole qualified source.
