About this file

This is a Sole Source Determination Form submitted by the New Mexico Department of Transportation (NMDOT) requesting approval to add additional modules to AASHTOWare Safety software from the American Association of State Highway and Transportation Officials (AASHTO). The agency seeks to expand its existing AASHTOWare Safety license by adding Intersections and Alternative Design modules to support the Roadway Safety Management Process as outlined in the Highway Safety Manual. NMDOT currently maintains licenses for the Segments and Trends modules of AASHTOWare Safety and other AASHTOWare products. The contract term is one year, with an estimated contract value of $525,000 before tax, and a tax rate of 8.1875% applicable in Santa Fe. The sole source request must be posted for thirty calendar days without protest before it becomes effective and requires written approval from the State Purchasing Agent.

AASHTO is identified as the sole source provider because AASHTOWare is a proprietary product owned exclusively by AASHTO, with source code that cannot be made available to third parties without compromising proprietary information. The agency certifies that no other vendor can provide AASHTOWare products or services, and AASHTO is the only entity authorized to perform software maintenance and support due to the proprietary nature of the code. The procurement process included review of available sources through trade publications, industry newsletters, internet research, and contact with similar service providers, with determination that no alternative businesses could perform the contract. The AASHTOWare Safety modules are specifically designed for state departments of transportation and help agencies meet federal performance management and reporting requirements.

No other company can provide AASHTOWare, it is a proprietary product of AASHTO, the source code of which cannot be made available to other parties. There is no other vendor who can provide AASHTO Product and Service Licenses.

NMDOT currently has a license for the Segments and Trends modules of AASHTOWare Safety, as well as other AASHTOWARE modules. This sole source would allow for the use of additional modules of the tool to continue to advance safety analytics capacity.

the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

The maintenance process requires that the source code for AASHTO products be manipulated or upgraded. Since this software is the proprietary product of AASHTO, the source code cannot be made available to other parties. Doing so would effectively put AASHTO proprietary code in the public domain. Therefore, AASHTO is the only company that can provide software maintenance and support for their products. In no case will parties outside the New Mexico Department of Transportation be authorized to gain access to this code, except for AASHTO personnel.
