About this file

This is a Sole Source Determination Form submitted by the New Mexico Department of Public Safety (DPS) for Support and Maintenance Services for the existing Smart Roadside Inspection System (SRIS). The procurement seeks comprehensive operations and maintenance support services from Drivewyze to ensure continued operation, reliability, and availability of the statewide SRIS platform currently deployed by DPS, the New Mexico State Police, and Commercial Vehicle Enforcement. The requested services include extended warranty support, scheduled preventive maintenance, unplanned repairs, software updates, system patches, remote system monitoring, technical support, operator training, system adjustments, calibration, and lifecycle support. The contract term is 120 months (ten years), and services must include 24-hour-per-day, 365-days-per-year monitoring and technical support with emergency response capabilities for critical system issues. The SRIS platform integrates multiple commercial vehicle enforcement technologies including Automated License Plate Recognition, Advanced Truck Identification System, Advanced Thermal Processing System, Automatic Vehicle Recognition, Overhead Vehicle Classification, Vehicle Waveform Identification, and Weigh-in-Motion systems.

The prospective contract amount is $7,205,489.00 before tax, with an estimated tax amount of $0.00. Drivewyze, located in Edmonton, Alberta, Canada (Vendor Number 0000075921), is identified as the sole source capable of providing the required services. DPS determined that Drivewyze is the only provider with specialized knowledge, authorized access to proprietary software resources, and technical capability necessary to maintain the existing SRIS environment without substantial redevelopment or system replacement. The agency's due diligence noted that while other vendors provide similar commercial vehicle enforcement systems, none can provide operational support and maintenance for the existing Smart Roadside Inspection System, as only the original developer possesses necessary access to proprietary software components and system knowledge. The sole source determination requires posting for thirty calendar days without protest and subsequent written approval by the State Purchasing Agent before becoming effective.

V. Agency is required to provide the detailed scope of work (or amendment) for this sole source. Scope of work must match the scope included in the services determination and Horizons declination.

The New Mexico Department of Public Safety (DPS), New Mexico State Police (NMSP), Commercial Vehicle Enforcement (CVE), requires Support and Maintenance Services (SMS) for the existing Smart Roadside Inspection System (SRIS), including associated hardware, software, servers, roadside equipment, and system integrations currently deployed statewide. Drivewyze shall provide operations and maintenance support necessary to ensure the continued operation, reliability, and availability of the existing SRIS platform.

The Contractor shall provide comprehensive support services necessary to maintain the SRIS system, including extended warranty support, scheduled preventive maintenance, unplanned repairs, software updates, system patches, remote system monitoring, technical support, operator training, system adjustments, calibration, operational testing, and lifecycle support. Services shall include support for SRIS integrations and associated technologies, including Automated License Plate Recognition (ALPR), Advanced Truck Identification System (ATIS), Advanced Thermal Processing System (ATPS), Automatic Vehicle Recognition (AUR), Overhead Vehicle Classification (OVC), Vehicle Waveform Identification (VWI), Weigh-in-Motion (WIM), and other Smart Roadside system components.

The Contractor shall provide 24-hour-per-day, 365-days-per-year monitoring and technical support, including emergency response for critical system issues, to address system failures, operational issues, and maintenance requirements. The purpose of this procurement is to maintain uninterrupted operation of the statewide SRIS platform, which supports commercial vehicle safety enforcement activities conducted by DPS/NMSP/CVE.

VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

DPS developed criteria necessary to ensure the contractor can maintain and support the existing SRIS system as currently configured and deployed. The contractor must have detailed knowledge of the existing SRIS system and its proprietary software, hardware, configurations, and integrations. The contractor must also have authorized access to the software updates, system information, technical documentation, and other resources necessary to troubleshoot, repair, update, and maintain the existing system.

The contractor must be capable of providing preventive maintenance, software updates, system monitoring, troubleshooting, repairs, emergency response, and technical support without requiring replacement or substantial redesign of the existing SRIS system. The contractor must also be able to maintain the existing integration of roadside technologies, including vehicle identification systems, cameras, sensors, servers, and enforcement data systems, as a single operational platform.

Although other commercial vehicle enforcement systems are available, DPS determined that alternative solutions are different proprietary systems and cannot directly maintain the existing SRIS platform and its customized integrations without significant redevelopment, replacement of equipment, or disruption to current operations.

VII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

Drivewyze is the only source capable of providing the required services because it possesses the specialized knowledge, technical resources, and authorized access necessary to maintain the existing SRIS environment currently deployed by DPS/NMSP/CVE. The SRIS platform was developed, customized, tested, and implemented to meet New Mexico's commercial vehicle enforcement requirements and incorporates proprietary Smart Roadside technology and integrations that require specialized support.

Drivewyze has the technical capability and authorized resources necessary to provide software maintenance, system updates, troubleshooting, repairs, emergency response, remote monitoring, preventive maintenance, and lifecycle support for the existing Smart Roadside platform. Its support services include maintaining the existing system configuration and the various hardware and software components that operate together as the SRIS platform.

Another contractor would not have the same authorized access to the proprietary software resources, existing system configuration, technical information, and specialized knowledge necessary to assume support of the current SRIS environment without substantial redevelopment, system reconfiguration, integration testing, or replacement of existing components. Transitioning the support function to another provider would therefore create significant cost and operational risk and could interrupt a critical public safety function.

VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

The required services are unique because DPS is seeking maintenance and support for a specific existing statewide SRIS system, rather than procuring a new commercial vehicle enforcement system. The SRIS platform integrates multiple commercial vehicle enforcement technologies into one unified system, including automated vehicle identification, license plate recognition, thermal inspection technology, weigh-in-motion, vehicle tracking, roadside monitoring, and enforcement data systems.

The SRIS system was specifically configured for DPS/NMSP/CVE operations and supports multiple fixed weigh stations, virtual inspection locations, and mobile inspection capabilities throughout New Mexico. Its hardware, software, and integrations operate together as a single platform, allowing DPS to monitor, identify, and evaluate commercial vehicles through a coordinated roadside safety system. Maintaining these existing integrations is necessary to preserve the functionality currently relied upon by

DPS/NMSP/CVE.

The uniqueness of the required services is substantially related to the purpose of this procurement because uninterrupted SRIS operation is necessary to support commercial vehicle safety enforcement and public safety operations. Replacing the existing system or requiring another provider to recreate its functionality would require significant customization, integration, testing, training, and equipment changes, creating a substantial risk of downtime, reduced functionality, and disruption to critical DPS operations.

IX. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

No other available solution can meet DPS requirements without significant customization or introducing risk to continuity of a critical public safety function. Each possible alternative uses different proprietary content and algorithms that would require significant and disruptive integration into DPS’s existing suite of authoritative data sources and equipment including its current SRIS system, Automated License Plate Reader, Hazmat Placard Identification System (HPIS), CVSA Safety Sticker Recognition (SSR), Advanced Lane Controllers, and Vehicle Waveform Identification (VWI).

DPS has determined that, while other vendors provide similar types of systems, none are able to provide operational support, maintenance, or updates for the existing Smart Roadside Inspection System. Only the original developer has the necessary access to proprietary software components and system knowledge required to perform the work.
