About this file

This is a Sole Source Determination Request and Form filed by the New Mexico Tourism Department for a four-year Information Technology Professional Service Agreement (Amendment 02) with Granicus, LLC for software licensing and support services. The procurement covers Content Management System (CMS) licensing, Customer Relationship Management (CRM) and Extranet licensing, SimpleSupport 60 and Map Publisher licensing renewal, premium Search Engine Optimization engagement, and digital asset management storage. The deliverables include maintenance of the Simpleview CMS platforms supporting NewMexico.org and NewMexicoMagazine.org websites, core CRM platform access for 15 users with 400 support hours over the contract term, 720 annual support hours at $120 per hour plus six bonus hours monthly, onsite training, API and XML feed management for visitor center kiosks, Map Publisher functionality, comprehensive SEO services including technical audits and content strategy across both websites, and one terabyte of digital asset storage with twelve hours of training. The contract term is four years with no specific award date or bidder conferences mentioned in the documentation.

The total contract value including New Mexico Gross Receipts Tax is $1,799,275.00, with annual compensation not to exceed $449,818.75. Compensation is structured by deliverable: CMS licensing at $885,406.52 total ($221,351.63 annually), CRM and Extranet licensing at $119,958.32 total ($29,989.58 annually), SimpleSupport 60 at $373,896.00 total ($93,474.00 annually), Map Publisher at $31,158.00 total ($7,789.50 annually), SEO engagement at $372,165.00 total ($93,041.25 annually), and digital asset management at $16,691.16 total ($4,172.79 annually), with invoices paid in full upon receipt. The justification for sole source determination centers on Simpleview LLC's proprietary ownership of custom-developed applications, specialized tourism industry tools, and existing integrations with the department's three websites, including custom API development for EV charging station mapping, Scenic Byways route tracing, and related listing customization that would be cost-prohibitive to redevelop with alternative vendors. The documentation notes the agency's reliance on Simpleview's proprietary licenses for continued support and maintenance rather than identifying other vendors contacted during the due diligence process.

I. Purpose:

The Purpose of this Agreement, including its goals and objectives are:

Simpleview, LLC (Contractor) is the sole proprietor from which Destination Marketing Organizations, Convention Visitors Bureaus, Chambers of Commerce, and/or other travel and tourism related marketing organizations may license the Simpleview software. Simpleview software includes Simpleview CMS, Simpleview CRM, the Destination Travel Network and several other products and services. Contractor is also the sole proprietor of support for their software, including maintenance, upgrades, and enhancements. Simpleview LLC's proprietary Customer Relationship Management (CRM) software and Content Management System (CMS) software are the tourism industry's standard for CRM and CMS Platforms.

The CRM enables multiple users and departments at the New Mexico Tourism Department (NMTD) to use one singular, integrated, web-based application to manage their data, projects, tasks, and overall workflow. This includes industry partner management, consumer marketing, media & public relations, forecasting, business analysis, reporting, as well as an included support retainer for training and technical help. It also includes many integration points with other products and services that the NMTD uses. Free upgrades and updates are included in the annual licensing costs.

The CMS platform integrates with Contractor's CRM to allow for efficient and expedient management of content on the www.newmexico.org and the www.newmexicomagazine.org websites. This allows NMTD to pull member/partner listings and amenities into their website, as well as populating offers and event calendars. Contractor's CMS platform also maximizes the data already stored in the CRM to display the best possible version of a destination.

Digital Asset Storage of Digital Assets Management Storage a) Contractor shall provide 1 TB of storage.

b) Contractor shall Provide twelve (12) hours of training and support.

IV. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources.

(Do not use "technical jargon;" use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

Simpleview is the world's leading DMO marketing organization. They provide multiple technological platforms that integrate seamlessly into the 3 websites that belong to the New Mexico Tourism Department which are NewMexico.org, NewMexicoMagazine.org and nmtourism.org (industry site). Simpleview, LLC provides a variety oftoolsets unique to their proprietary platform that are utilized by the New Mexico Tourism Department to achieve a goal to promote New Mexico as a tourism destination.

The following applications are active, customized applications developed by Simpleview LLC.

It's more cost effective to pay Simpleview LLC for continued support and maintenance of the applications listed below to ensure they are kept current and up to date. Selecting another vendor would require re-development of each application that would be expensive and difficult to replace.

• API development to provide listings for Kiosks in the Visitor Centers.

• XML Feed to provide events for Kiosks in the Visitor Centers.

• API Development to integrate the Tourism Exchange platform into the New Mexico

Tourism department websites and provide for reciprocal exchange of data between the Tourism Exchange website and NewMexico.org and NewMexicoMagazine.org websites.

• Custom API development to provide an interactive map of EV charging stations in the state of New Mexico that updates automatically.

• Custom map development to trace routes for Scenic Byways

• Related Listing Customization (the ability to display multiple listings for businesses that have additional amenities at the same location, i.e. - a hotel that has a restaurant, spa, nightclub, etc.)

V. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes the prospective contractor the one source capable of providing the required professional service, service, construction or item(s) of tangible personal property. (Please do not state the source is the "best" source or the "least costly" source.

Those factors do not justify a "sole source.")

Simpleview, LLC bas uniquely customized many tools and aspects within NewMexico.org, NewMexicoMagazine.org, and nmtourism.org to allow integration between these websites and other platforms that work in conjunction with these websites. Simpleview LLC provides industry specific tools with functions specific to the tourism industry that non-industry vendors would not readily provide. This would require non-industry vendors to research and customize at a substantial cost. The licensing for the support, maintenance, and enhancement of all 3 websites and tools that work within the 3 websites are proprietary and not available from another provider.

VI. Provide a detailed, sufficient explanation of how the professional service, service, construction, or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

To promote New Mexico as a tourism destination, it is imperative for the tourism websites to allow advertising of tourism related products such as lodging, airfare, small businesses, etc.

The website must also be interactive with travelers to allow for travel guidance and must be able to collect and share data for marketing and planning initiatives. These are just a few unique items that should be encompassed in a tourism website. Simpleview, LLC specializes in this field and has already developed the New Mexico Tourism Department's websites and customized multiple tools to integrate multiple platforms. Any support, maintenance, and enhancements to the websites and customized tools must be done by Simpleview, LLC as they are proprietary licenses.

VII. Explain why other similar professional services, services, construction, or item(s) of tangible personal property cannot meet the intended purpose of the contract.

The licensing for support, maintenance, and enhancements for NewMexico.org, NewMexicoMagazine.org, and nmtourism.org are proprietary and not available from another provider.

VIII. Provide a narrative description of the agency's due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;; contacting similar service providers; and reviewing the State Purchasing Divisions' Statewide Price Agreements.

Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.
