About this file

This is a 2026 Sole Source Request and Determination Form submitted by the State of New Mexico's Office of Broadband Access and Expansion (OBAE) for Geographic Information System (GIS) software licenses and maintenance from Environmental Systems Research Institute (Esri). The procurement includes multiple ArcGIS product subscriptions and services: ArcGIS Online Professional Plus User Type Annual Subscription, ArcGIS Online Creator User Type Annual Subscription (both with Desktop Migration options), ArcGIS Hub Premium, ArcGIS Online Community Annual Subscription, ArcGIS Enterprise Advanced Up to Four Cores with Maintenance and Staging Server Maintenance, and ArcGIS Developer Bundle Annual Subscription. The contract term is one year, with OBAE's current maintenance expiration on September 30, 2026, necessitating immediate procurement action. The sole source determination was dated September 17-18, 2026, and requires a thirty-day posting period without protest before final approval by the State Purchasing Agent.

The total contract value before tax is $48,980.00, with an estimated tax amount of $1,864.69. OBAE justifies the sole source determination based on Esri's proprietary capabilities as the industry-leading full-service GIS software provider, the organization's four-year investment in customizing Esri products for managing broadband infrastructure data for over twenty users, and the lack of viable alternatives that meet state government security, interoperability, and functionality requirements. The agency notes that New Mexico's previous statewide price agreement with Esri expired in February 2026 and has not yet been renewed. OBAE is collaborating with the Department of Information Technology (DoIT) to establish a new statewide price agreement and is investigating alternative procurement instruments through GSA, NASPO, and other state cooperative agreements, but none are currently suitable or available, making the sole source procurement necessary to maintain continuous system operation.

VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

These licenses are for the proprietary software that comprises the geographic information system (GIS) upon which OBAE depends for land-based analysis of data that is core to our mission. This COTS software is the standard used across state government which ensures interoperability, dependability, and functionality. This purchase includes software, maintenance, and term licensing that runs on OBAE’s servers, desktops, and web clients.

VII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

Esri is the established industry leader in COTS for full-service GIS software. The software provides robust data creation and analysis capabilities, a well-developed security model for multi-user editing and web hosting, and content managed in high-precision formats that are widely interoperable and stable. There is at least one somewhat comparable open-source alternative which cannot be dependably deployed in a state government environment.

VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

The Esri enterprise server and geodatabase capabilities are unique and are used daily by over twenty users at OBAE for managing and analyzing large, secure datasets related to broadband infrastructure decision support. The combined web map publication, app hosting, and analysis platform as a COTS solution is unique and is used by OBAE staff internally and public users to conduct business upon which OBAE’s grant programs depend. OBAE has invested four years into design and implementation as well as customization of the Esri COTS products.

IX. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

The State of NM usually has a statewide price agreement in place to facilitate agency purchases from Esri, but that RFP expired in February 2026 and has not yet been renewed. OBAE is contributing technical expertise in collaboration with DoIT to get this RFP published and a statewide price agreement in place as soon as possible.

Further, OBAE is coordinating with State Purchasing and Esri to find other instruments (GSA, NASPO, TX, AZ) onto which the state could contract, but so far none are suitable or available. Because OBAE’s current maintenance expires on 9/30/2026, we must pursue the sole source until another price agreement is in place.

Agency certifies this sole source submission complies with NMSA 1978, Sections 13-1-28 through 13-1-199, the New Mexico Administrative Code (NMAC) and Governmental Conduct Act, NMSA 1978, Sections 10-16-1 through 10-16-18.
