(END OF SECTION B)
SECTION C: DESCRIPTION/SPECIFICATION/STATEMENT OF WORK
C.1 BACKGROUND
The Federal Transit Administration’s (FTA) Office of Safety Review (TSO-20) within the Office of Transit Safety and Oversight (TSO) is charged with delivering programs that ensure the highest possible level of safety and security for the nation’s public transportation systems. The State Safety Oversight Program (SSOP), currently managed by TSO-20, focuses on the development of standards, criteria, plans, procedures, and processes for implementation by states and rail transit agencies (RTAs). The SSOP seeks to address minimum regulatory requirements and to enhance safety and security practices.
TSO-20 requires contractor support to perform safety oversight activities of State Safety Oversight (SSO) programs. TSO-20’s core functions are collecting safety data on rail transit agencies (RTA), conducting audits of SSO agencies State Safety Oversight Agencies (SSOA) that oversee RTAs, and providing outreach and technical assistance to those same RTAs and SSOAs. If the FTA identifies a significant level of risk to safety, they may use TSO-20 resources to perform additional interventions into the safety management or oversight activities at public transportation systems or SSOAs. The authorities for TSO-20’s program activities are found in the Public Transportation Safety Program, (49 U.S.C. § 5329) (2017).
C.2 SCOPE
The objectives of this project are to assist FTA’s Office of Safety Review with the following:
- Evaluation of the development and implementation of state oversight and rail transit agency safety and security programs as per applicable regulations, requirements and FTA guidance;
- Identification, development, and delivery of technical assistance and training to guide state and rail transit agency program development and implementation;
- Responses to industry and government inquiries and needs related to FTA’s safety and security program implementation;
- Coordination with other FTA programs to ensure a systems approach to delivery of its safety and security program.
DESCRIPTION/SPECIFICATIONS
Contract Line Item Number (CLIN) 0001: Annual Submissions to FTA
The State Safety Oversight Rule, 49 Code of Federal Regulation (CFR) § Part 674 (2016) requires SSOAs to submit information to the FTA on an annual basis:
• 674.13(a)(7) – “The SSOA [must report] the status of safety of each [RTA] to the Governor, the FTA, and the board of directors … of the [RTA]”
• 674.27(b) – “An SSOA must submit its SSO program standard … to FTA”
• 674.39 – “On or before March 15 of each year, an SSOA must submit … to FTA:”
o The SSO Program Standard o Evidence of compliance with 49 CFR Part 672 o A summary of oversight activities for the preceding 12 months o A summary of triennial audits for the preceding 12 months o Evidence of review and approval of any changes to RTA [agency safety plans] o Self-Certification of compliance with 49 CFR Part 674
To facilitate the collection of this information, TSO-20 has developed a web-based tool that SSOAs can use to make their submissions. We require contract support to evaluate and validate these submissions. Annual reports, once validated, will be reviewed and certified by the TSO-20 staff.
Anticipated Level of Effort: 2000 hours; 1 FTE.
CLIN 0002: State Safety Oversight Audits
Forty-Nine CFR Part 674.11 states that the FTA will audit each SSOA at least once every three years. TSO requires contract support to perform these audits. There are 31 SSOAs in 30 States.
All but two—Hawaii and Puerto Rico—are in the Continental United States. Audit procedures and contractor responsibilities are defined in the Audit SOP and the Auditor’s Guide (*NOTE:
Will be provided after contract award etc.)
Anticipated Level of Effort: approximately 400-500 hrs per audit; approximately 12 audits per year; 5000-6000 hrs./year; 2.5-3 FTE.
CLIN 0003: Programmatic and Technical Support
Federal public transportation law (49 USC $ 5329(e)(9)) requires the FTA to “continually evaluate the implementation of a State safety oversight program by a State safety oversight agency.” This continuous evaluation usually begins with regular phone calls with each State program. Regular calls sometimes evolve into more complex inquiries and investigations. We occasionally require a contractor to support this process by providing context, data analysis, or other forms of subject matter expertise.
TSO may occasionally undertake other finite projects that require contractor support similar to that described in the paragraph above. FTA will, from time to time, endeavor to improve the knowledge-base of the industry in various relevant fields by developing guidance, such as documents and presentations, and to provide a forum for networking and exchanging ideas. We require subject matter expert consultants to assist with developing and presenting guidance materials, and to attend and participate in workshops and other opportunities for networking and training.
TSO will require contractor support in the following task areas:
• Assist in development or improvement of procedural manuals and guidance documents
• Assist in development of presentations and training
• Assist in developing new policies, procedures, and practices
• Give presentations and training
• Attend training, workshops, and conferences
• Provide context and analysis
• Audit-related activities such as interviews and inspections
This support may be directed toward the FTA, SSOAs, RTAs, or the public transit industry at large. Anticipated Level of Effort: When awarding task orders, the Government may award hours for specific projects and may also award hours under this CLIN for un-planned assistance to be used on an ‘as-needed’ basis within scope of the SOW. The Government’s needs in this CLIN will vary from year to year. The Government anticipates needing no more than 6000 hours per year; 3 FTE.
CLIN 0004: Special Projects
The monitoring process described above will sometimes lead the FTA to intervene in the oversight program or operations of an FTA recipient, pursuant to our authority found in 49 USC 5329 and 49 CFR Part 670. Possible interventions could include:
• Investigations or inspections at RTAs
• On-site inquiries or investigations at SSOAs
• Direct administration of an SSO program
• Imposing prohibitions or restrictions on an RTA
The number, size, scope, and frequency of such interventions can’t be predicted. If such an activity is required, one or more task orders would be awarded pursuant to the FAR Subpart
16.5. For a large-scale or long-term intervention beyond the anticipated LOE for this CLIN, FTA would pursue alternate means to complete it.
Contractor requirements could include, without being limited to, the following:
• Support planning the activity
• Perform inspections of transit agency facilities and infrastructure such as track and power systems
• Conduct personnel interviews, document reviews, and analyses of data and information
• Evaluate the implementation of safety procedures in a public transit system’s operations
• Monitor and evaluate hazard and corrective action plan (CAP) identification and resolution
• Investigate accidents and incidents
• Develop and document procedures for performing safety oversight
• Ensure transition of responsibilities from FTA back to the responsible oversight agency
• Create briefings, presentations, and reports
Anticipated Level of Effort: The Government does not intend to award more than 6000 hours (3 FTE) per year on this CLIN, but there is no guarantee that we will require any work at all under this CLIN for the entire POP of resulting contracts. Because of that uncertainty, the Government does not expect the contractor to maintain personnel on staff waiting to perform this work. If the Government were to require support for such an event, we would expect the contractor to acquire the necessary expertise using existing personnel, short-term hires, subcontractors, or other means. The contractor must include in their proposal a plan for making these personnel adjustments. All personnel adjustments must be in accordance with the qualifications and experience specified in the respective approved labor categories.
CLIN 0005: Travel
Travel and Per Diem authorized under this the resulting contracts for which task orders will be issued shall be reimbursed according to the requirements of FAR 31.205-46 entitled "Travel Cost," and with the Government Travel Regulations (GTR) in effect at the time of travel. Travel by air shall be reimbursed at actual not to exceed coach fare. Travel subsistence reimbursement shall be authorized under the rates and conditions of the Federal Travel Regulations (FTR) in effect at the time of travel throughout the period of performance of this contract. The Government revises the Per Diem rates to reflect changes to these amounts or to the travel regulations. Before contractors book any travel, they must submit a travel plan to the COR, and the COR must approve that plan. Payment cannot be guaranteed for travel booked without prior approval.
CLIN 0006: Other Direct Costs (ODCs)
Occasionally, the contractor may incur other direct costs not associated with travel. This may include printing or shipping materials or paying a conference entrance fee if considered authorized, allowable and reasonable. These costs will be reimbursed directly according to the FAR and must be within scope of the base IDIQ contract and issued/awarded task orders. All ODCs must be pre-approved by the Contracting Officer’s Representative (COR) and documented as such prior to incurring costs and seeking payment for them.
(END OF SECTION C)
SECTION D: PACKAGING AND MARKING
All packing, packaging and mailing of reports or submittals shall be accomplished in the most economical and efficient manner and in accordance with the best commercial practices.
All information submitted to the Contracting Officer and the Contracting Officer's Representative shall be clearly marked with the legal name of the organization/contractor, the contract number, and/or modification number as appropriate and the identification of the submission. Additional packaging and marking requirements will be specified, as necessary, in the resulting contract.

H.6 U. S Department of Transportation (DOT) Contractor Personnel Security and Agency Access (NOV 2011)
Contractor personnel will be provided with identification badges and necessary access to facilities used to provide the services set forth in this contract based on the criterion below.
The following definitions are provided:
• "Agency Access" means access to DOT facilities, sensitive information, information systems or other DOT resources.
• "Applicant" is a contractor employee for whom the contractor submits an application for a DOT identification card.
• "Contractor Employee" means prime contractor and subcontractor employees who require agency access to perform work under a DOT contract.
• "Identification Card" (or "ID card") means a government issued or accepted identification card such as a Personal Identity Verification (PIV) card, a PIV-Interoperable (PlV-I) card from an authorized PIV-l issuer, or a non-PIV card issued by DOT, or a non- PIV card issued by another Federal agency and approved by DOT. PIV and PIV-l cards have physical and electronic attributes that other (non-PIV) ID cards do not have.
• "Issuing Office" means the DOT entity that issues identification cards to contractor employees.
• "Local Security Servicing Organization" means the DOT entity that provides security services to the DOT organization sponsoring the contract.
1. Risk and Sensitivity Level Designations — For contracts requiring access to DOT facilities, sensitive information, information systems or other DOT resources, the contractor employees will be required to complete background investigations, identity proofing, and government identification card application procedures to determine suitability for access. DOT will assign a risk and sensitivity level designation to the overall contract and/or to contractor employee positions by category, group or individual. The risk and sensitivity level designations will be the basis for determining the level of personnel security processing required for contractor employees.
IF THE DESIGNATED RISK: THE BACKGROUND INVESTIGATIONS IS: TBD
Low: National Agency Check with Written Inquiries (NACI) Moderate: Minimum Background Investigation (MBI) High: Background Investigation (BI)
Contractor employees may also be required to obtain security clearances (i.e., Confidential, Secret, or Top Secret). National Security work designated "special sensitive," "critical sensitive," or "non-critical sensitive" will determine t h e l e v e l of clearance required f o r contractor Employees. Personnel security clearances for national security contracts in DOT will be processed according to the Department of Defense National Industrial Security Program Operating Manual
(NISPOM).
2. Pre-screening o f Contractor E m p l o y e e s - The c o n t r a c t o r m u s t pre-screen i n d i v i d u a l s designated for employment under any DOT contract by verifying minimal suitability.
3. Requirements to ensure that only quality candidates are considered for contract employment, and to mitigate the burden on the Government of conducting background investigations on objectionable applicants. The contractor must exercise due diligence in pre-screening all employees prior to submission to DOT for agency access. DOT may decline to grant agency access to a contractor employee for reasons including, but not limited to:
a. Conviction of a felony, a crime of violence, or a misdemeanor involving moral turpitude.
b. Falsification of information entered on forms or of other documents submitted.
c. Improper conduct including criminal, infamous, dishonest, immoral, or notoriously disgraceful conduct or other conduct adverse to the Government regardless of whether the conduct is directly related to the contract.
d. Any behavior judged to pose a potential threat to DOT facilities, sensitive information, information systems or other resources.
Citizenship and Alien Status - The contractor must monitor an alien's continued authorization for employment in the United States. The contractor must provide documentation to the Contracting Officer or the Contracting Officer's Representative during the background investigation process that validates that the E-Verify requirement has been met for each contractor employee (see http://www.uscis.gov.
Background Investigation and Adjudication — The contractor employee must have a favorable adjudication of background investigation before DOT will issue an ID card to the contractor employee granting access to DOT facilities, sensitive information, information systems or other DOT resources. DOT may accept favorable adjudications of background investigations from other Federal agencies when applicants have held PIV cards issued by those agencies with no break in service. DOT may also accept PIV-I (interoperable) cards issued by an authorized PIV-I issuer as evidence of identity. A favorable adjudication does not preclude DOT from initiating a new investigation when deemed necessary. At a minimum, the FBI National Criminal History Check (fingerprint check) must be favorably completed before a DOT identification card can be issued. Each contractor must use the Office of Personnel Management's (OPM) e-QIP system to complete any required investigative forms. Instructions for obtaining fingerprints will be provided by the COR or CO. The DOT Office of Security, M- 40, or a DOT organization delegated authority by M-40, is responsible for adjudicating the suitability of contractor employees.
4. Agency Access Denied — Upon contract award, DOT will initiate the agency access procedure for all contractor employees requiring access to DOT facilities, sensitive information, information systems and other DOT resources for contract performance. DOT may deny agency access to any individual about whom an adverse suitability determination is made.
Failure to submit the required security information or to truthfully answer all questions shall constitute grounds for denial of access. The contractor must not provide agency access to contractor employees until the COR or CO provides notice of approval, which is authorized only by the DOT Office of Security (M-40) or a DOT organization delegated authority by M-40.
5. Identification Card Application Process - The COR will be the DOT ID card Sponsor and point of contact for the contractor's application for a DOT ID card. The COR shall review and approve the DOT ID card application before an ID card is issued to the applicant.
6. Personal Identity Verification Card - An applicant may be issued either a Personal Identity
Verification (PIV) card that meets the standards of Homeland Presidential Security Directive (HSPD-12), or an applicant may be issued a non-PIV card. Generally, a non-PIV card will be issued for contracts that expire in six months or less, including option periods. The COR may request the issuing office to waive the six-month eligibility requirement when it is in DOT's interest for contract performance.
The applicant must complete a DOT on-line application for a PIV card. For a non-PIV card, the applicant must complete and submit a hard copy of Form 1681 to the COR/Sponsor. Regardless of the type of card to be issued (PIV or non-PIV), the applicant must appear in-person to provide two forms of identity source documents in original form to DOT. The identity source documents must come from the list of acceptable documents included in Form 1-9, OMB No. 1115-0136, Employment Eligibility Verification. At least one document must be a valid State or Federal government-issued picture identification. For a PIV card, the applicant may be required to appear in-person a second time for enrollment and activation.
