The current incumbent, Deer Oaks EAP Services, LLC, has provided services since March 25, 2016, at an annual cost of $58,345.66. The contract is expiring after five years, triggering this rebid. Offerors must provide three comparable contracts of similar size and scope as references, demonstrate two years of experience in EAP services, submit staffing plans with qualified personnel, provide five current references, submit financial documentation including Form 10-K or audited financial statements, and demonstrate liability and malpractice insurance capability. Pricing must be fixed for the contract term, with quarterly billing required. The solicitation specifies service requirements including 24/7 telephone availability with Monday-Friday office hours of 8:00 a.m. to 5:00 p.m., counseling sessions of up to three hours per employee per calendar year, first appointment scheduling within 72 hours of request, ten hours of annual supervisor training, four to five hours quarterly of employee workshops, up to 15 hours for annual health/benefit fairs, and critical incident response services as needed.

SC Department of Corrections ’s overall usage of services during the period, 01 Jan 2021 to 31 Mar 2021, was 125 cases. The projected annual utilization for SC Department of Corrections is 12.00% which is greater than the Book of Business’s (BOB) benchmark of 8.76%, and is greater than the Industrial BOB benchmark of 0.01%. There were 110 EAP counseling cases, and 15 work-life cases. Usage is higher compared to the previous year during this time period where utilization was 2.87%. The sentences seem to contradict each other, with the first implying the appointment (counseling session) must be provided with 72 hours of the request. The second and third sentence seem to imply that within 72 hours of the call, the employee must be provided with names/address/numbers of counselors they can call to schedule an appointment. Answer: EAP contacts and makes appointments for employees upon referral

Also, if the first sentence is to be utilized, this can present a challenge for two reasons. While we do request that our Providers provide an appointment within this time period (actually 48) the employee/individual wanting an appointment often does not want to take an offered appointment within this timeframe. This would be a difficult requirement to manage. Also, given today’s increased demand for mental health services, counselor availability is being stretched beyond historical norms.

Offeror, by submitting an Offer, represents that it has read and understands the Solicitation and that its Offer is made in compliance with the Solicitation. Offerors are expected to examine the Solicitation thoroughly and should request an explanation of any ambiguities, discrepancies, errors, omissions, or conflicting statements in the Solicitation. Failure to do so will be at the Offeror's risk. All ambiguities, discrepancies, errors, omissions, or conflicting statements in the Solicitation shall be interpreted to require the better quality or greater quantity of work and/or materials, unless otherwise directed by amendment. Offeror assumes responsibility for any patent ambiguity in the Solicitation that Offeror does not bring to the State's attention. See clause entitled "Questions from Offerors." [02-2A070-2]
