About this file
This document comprises federal procurement regulations from Title 2, Part 200 of the Code of Federal Regulations (2 CFR Part 200) issued by the Office of Management and Budget, applicable to non-federal entities receiving federal financial assistance. The regulations establish uniform administrative requirements, cost principles, and audit requirements for federal awards, with specific provisions governing contract management and procurement standards for state and local governments. The Lancaster Recreation Center HVAC Replacement Project, a multi-prime construction contract issued by the City of Lancaster, Pennsylvania, is subject to these federal requirements as it is funded in part through a Community Development Block Grant (CDBG) from the U.S. Department of Housing and Urban Development (HUD) under the American Rescue Plan Act (ARPA). The project consists of two separate prime contracts: a Mechanical Construction contract and a General/Structural Construction contract. The Mechanical contract includes demolition of existing equipment, replacement of four rooftop units (RTUs) providing heating and cooling, and associated ductwork revisions, electrical connections, piping, and appurtenances. The General/Structural contract encompasses installation of supplemental structural steel to support new RTUs and roofing and flashing repairs for waterproofing. A non-mandatory pre-bid conference and site tour will be held on Tuesday, June 23, 2026, at 9:00 A.M. at the Lancaster Recreation Center, 525 Fairview Avenue, Lancaster, PA 17603. Sealed bids must be submitted online through PennBid's website by July 14, 2026, at 11:00 A.M.
The federal regulations mandate that all contracts funded through federal awards include specific provisions addressing remedies for contractor violations, termination for cause and convenience, equal employment opportunity compliance, prevailing wage requirements under the Davis-Bacon Act for construction contracts exceeding $2,000, contract work hours and safety standards for contracts over $100,000 involving mechanics or laborers, compliance with the Clean Air Act and Federal Water Pollution Control Act for contracts exceeding $150,000, debarment and suspension verification through the System for Award Management (SAM), anti-lobbying certifications for awards exceeding $100,000, prohibition of covered telecommunications equipment from foreign entities, and preferences for domestically produced goods and materials. Additionally, state agencies and their contractors must comply with Section 6002 of the Solid Waste Disposal Act regarding procurement of recovered materials for purchases exceeding $10,000. The City of Lancaster is required to ensure all successful bidders comply with applicable non-discrimination laws and wage and hour requirements as specified in Article 27 of the Instructions to Bidders, which incorporate these federal requirements.

(B) All contracts in excess of $10,000 must address termination for cause and for convenience by the non- Federal entity including the manner by which it will be effected and the basis for settlement.
(C) Equal Employment Opportunity. Except as otherwise provided under 41 CFR Part 60, all contracts that meet the definition of “federally assisted construction contract” in 41 CFR Part 60-1.3 must include the equal opportunity clause provided under 41 CFR 60-1.4(b), in accordance with Executive Order 11246, “Equal Employment Opportunity” (30 FR 12319, 12935, 3 CFR Part, 1964-1965 Comp., p. 339), as amended by Executive Order 11375, “Amending Executive Order 11246 Relating to Equal Employment Opportunity,” and implementing regulations at 41 CFR part 60, “Office of Federal Contract Compliance Programs, Equal Employment Opportunity, Department of Labor.”

In addition, contractors must be required to pay wages not less than once a week. The non-Federal entity must place a copy of the current prevailing wage determination issued by the Department of Labor in each solicitation. The decision to award a contract or subcontract must be conditioned upon the acceptance of the wage determination. The non-Federal entity must report all suspected or reported violations to the Federal awarding agency. Violations must be reported to the Federal awarding agency and the Regional Office of the Environmental Protection Agency (EPA).
(H) Debarment and Suspension (Executive Orders 12549 and 12689)—A contract award (see 2 CFR 180.220) must not be made to parties listed on the governmentwide exclusions in the System for Award Management (SAM), in accordance with the OMB guidelines at 2 CFR 180 that implement Executive Orders 12549 (3 CFR part 1986 Comp., p. 189) and 12689 (3 CFR part 1989 Comp., p. 235), “Debarment and Suspension.” SAM Exclusions contains the names of parties debarred, suspended, or otherwise excluded by agencies, as well as parties declared ineligible under statutory or regulatory authority other than Executive Order 12549.
(I) Byrd Anti-Lobbying Amendment (31 U.S.C. 1352)—Contractors that apply or bid for an award exceeding $100,000 must file the required certification.
