1.0 EXECUTIVE SUMMARY

Carnow, Conibear & Assoc., Ltd. (Carnow Conibear) was requested by KOO LLC to perform a pre-alteration survey for asbestos-containing materials and lead-based paint at the Minton- Capehart Federal Building located at 575 N. Pennsylvania Street, in Indianapolis, Indiana. The survey was limited to components and locations thought to be impacted by the Immigration Court renovation project on portions of the 4th, 5th, and 6th floors.

The asbestos-containing materials identified at the subject site include:

• Black floor mastic – approximately 2,000 square feet located on portions of the concrete floor under the yellow carpet adhesive in rooms 425 and 625 in the renovation areas.

The limited lead-based paint survey identified no lead-based paint as defined by the Department of Housing and Urban Development (HUD) in the survey areas.

Incorporate the data from this report into future demolition/renovation documents regarding the presence of lead-based paint. All future removal and/or demolition/renovation work involving the lead-based paint shall be conducted by a licensed contractor in accordance with Indiana Department of Environmental Management (IDEM), EPA, and OSHA regulations and requirements. Dispose of all lead-bearing waste in accordance with all applicable local, state, and federal regulations. Carnow Conibear recommends incorporating this information into renovation documents regarding the presence and location of asbestos-containing materials.

All abatement activities shall be conducted by a licensed contractor in accordance with the Indiana Department of Environmental Management (IDEM), USEPA National Emissions Standards for Hazardous Air Pollutants (NESHAPS), and Occupational Safety and Health Administration (OSHA) regulations and requirements.

2.0 INTRODUCTION

Carnow, Conibear & Assoc., Ltd. (Carnow Conibear) was retained by KOO LLC to perform a pre-alteration asbestos-containing material and lead-based paint survey at the Minton-Capehart Federal Building located at 575 N. Pennsylvania Street, in Indianapolis, Indiana. The survey was conducted on April 12, 2022, by Mr. Evan Christian of Carnow Conibear. Mr. Christian is an Indiana Department of Environmental Management (IDEM) licensed asbestos building inspector. See Appendix A for a copy of the Mr. Christian’s licenses and certificates.

2.1 Objective

2.1.1 Asbestos-Containing Material Survey

The purpose of the asbestos survey was to identify the location of asbestos-containing materials thought to be impacted by planned renovations at the subject site located at 575 N.

Pennsylvania Street, Indianapolis, Indiana. To achieve this purpose, the following procedures are performed:

• Visual Inspection – to determine the location of suspect materials.

• Sampling - to determine the type and % of asbestos in the material. Materials containing greater than 1% asbestos are considered asbestos-containing by OSHA and EPA.

• Reporting – to prepare a summary report documenting the inspection findings and providing recommendations as warranted.

2.1.2 Lead-Based Paint Survey

The objective of the lead-based paint survey was to identify painted building components thought to be impacted by planned renovations to determine the existence, condition, and location of lead-based paint as defined by HUD. To achieve this objective, the following procedures were performed:

• Visual Inspection - to determine the location of painted surfaces

• Sampling –sampling to determine the presence of lead in painted materials in concentrations greater than (>) 5,000 milligrams per kilogram (mg/Kg), which is classified as lead-based paint by HUD

• Reporting – to prepare a summary report documenting the inspection findings

2.2 General Facility Description

The subject site is located at 575 N. Pennsylvania Street, Indianapolis, Indiana. The site is a six-story building constructed in 1974. The interior space is primarily constructed of plaster walls and ceilings, and vinyl and carpet floor coverings. The subject site is conditioned by forced HVAC systems and perimeter fin-tube units.

3.0 SITE INSPECTION

3.1 Asbestos-Containing Material Survey

3.1.1 Asbestos Survey Methodology

The asbestos survey included a review of available historical asbestos related documentation and renovation documents, followed by a walkthrough inspection of each renovation area to identify materials uniform in composition, assess material condition, and collect representative bulk samples from each suspect material for asbestos content by laboratory analysis.

All bulk samples were collected according to methods described in USEPA guidelines.

The samples collected were stored in sample containers with unique sample identification numbers. A chain of custody (COC) form was signed and dated by the inspector, the delivering representative, and the laboratory representative who received the samples. The samples were submitted to STAT Analysis Corporation (STAT), Chicago, IL, for analysis.

STAT’s laboratory is accredited for bulk asbestos fiber analysis by the National Voluntary Laboratory Accreditation Program (NVLAP). STAT utilized dispersion staining and polarized light microscopy (PLM) techniques for analyzing the samples consistent with National Institute for Occupational Safety and Health (NIOSH) Methods. PLM is the EPA’s recognized method for determining bulk asbestos content.

Table I summarizes the results of the bulk sample analysis, material description, location, and estimated quantity. See Appendix B for the bulk sample laboratory report and chain of custody documentation, and Appendix C for photographic documentation.

3.2 Lead-Based Paint Survey

3.2.1 Lead-Based Paint Survey Methodology

Sampling of visible and accessible suspect lead-based painted components and/or surfaces was conducted following a protocol similar to U.S. Department of Housing and Urban Development (HUD) guidelines. A paint chip was collected from each type of painted finish that may be impacted by the proposed renovations. Visual assessments noting condition of suspect materials described in this report are representative of those conditions present at the time of the survey.

The objective of the lead-based paint survey was to test accessible painted surfaces that may be impacted by the planned renovations. To achieve this objective, the following procedures are performed:

• Visual Inspection – to determine the locations.

• Paint Chip Sampling – representative samples are taken of each suspect material.

• Sample Analysis – to determine if lead is present in the samples. The analysis was performed by an AIHA accredited laboratory.

• Reporting – to prepare a summary report documenting the inspection findings.

Table II identifies the painted components tested for lead-based paint. No building components tested positive >5,000 mg/Kg) for lead-based paint. See Appendix B for laboratory analytical results.

Based on the survey results, Carnow Conibear makes the following conclusions and recommendations:

• The pre-alteration asbestos survey was conducted to satisfy the requirements referenced in PBS 1000.1 (March 25, 2015) and to identify asbestos-containing materials associated with the planned renovation of areas located at the Minton- Capehart Federal Building.

• Results of the survey confirm asbestos-containing floor mastic is present in portions of the 4th and 6th floor renovation areas.

• Lead was not detected in the paint chip samples collected in the planned renovation areas. The tested paint was not lead-based paint as defined by HUD.

• All future asbestos removal and/or demolition/renovation work involving the asbestos-containing materials shall be conducted by a licensed contractor in accordance with IDEM, EPA, and OSHA regulations and requirements.

• Dispose of all asbestos-containing materials in accordance with all applicable local, state, and federal regulations.

• Prepare asbestos-containing material abatement design documents, including technical abatement specifications. Conduct on-site project monitoring during abatement, collect clearance samples, and develop abatement summary documentation prior to re-occupancy.

• Document all environmental work activities and retain records.

Carnow Conibear has applied prevailing industry standards and reasonable judgment and effort within the scope of work outlined in Carnow Conibear’s proposal, while conducting the asbestos-containing material and lead-based paint survey. The standards, judgment, and effort used by Carnow Conibear personnel to investigate, assess, and determine the presence of potential environmental hazards and liabilities associated with the subject building are consistent with requirements outlined in federal and state guidelines. Carnow Conibear makes no warranty, express or implied, that the findings and interpretations in this report are a complete representation hazards and liabilities, associated with the building.
