GENERAL

1.1 Scope of Services

REAL ESTATE INFORMATION LICENSES

The Public Building Service (PBS) within the General Services Administration (GSA), needs 55 user licenses for subscribers in GSA to access existing commercial real estate information including, but not limited to a full inventory (based on geography and 100% sampling) of office and industrial space available complete with property details (age of building, recent renovations, photos, floor plans, owners, how many elevators are in the building, etc). Floor plans do not need to be in a specific format but should be printable and provide a general indication of the size and layout of the available space, by floor, by location in the building. The drawings should show available space location on the floor and within the floor. Amenities, restrooms, mechanical, electrical rooms should be marked. The full inventory consists of all private sector, and if available, local, city or state government buildings and or space within a selected market.

The information tool shall provide a directory of real estate professionals in the area, alerts users to any changes in the marketplace. The marketplace can be the entire market or a sub-set of the market such as set sub-markets, markets by zip codes, and delineated areas plotted on a map.

Also provide a multitude of reports and graphs including but not limited to square feet available in the market, time on the market, class of space, rates per square foot, comparison of rates (comparisons should be among and within the selected markets) absorption rates, vacancy trends, etc. that can be used in reporting the space and allows for dynamic mapping of potential property locations. The tool allows searches for available office space by running a query based on space requirements, and prepares a brief fact sheet on the property. It should also offer space for lease, lease transactions, properties for sale, prospective buyers, sale comparables, tenants and lease expirations, property assessments, full market coverage, market conditions and analysis, directory of industry professionals.

The information tool shall provide an analytics tool to receive daily updates on changes in their respective markets, including new space that becomes available. Runs reports on historical trends such as year to year, 3 years, 5 years, 10 years, 20 years, etc. in a given community, vacant space reports and absorption data in the community. It provides access to market rates and trends for comparison with contracted rent appraisals. The above Information Services must include the following real estate markets: All of Pennsylvania, Delaware, Maryland, Virginia, West Virginia, Washington D.C.; Southern NJ, including Camden, NJ, and Trenton, NJ.

The resulting contract will include a base year of twelve (12) months and four one year (12 month) option periods with a total estimated cost for all five years between $1,000,000.00 and $1,500,000.00. This procurement is being solicited on an unrestricted basis.

The NAICS code applicable to this project is 531390.

Award will be a firm fixed price contract and the procurement method will be a competitive negotiated Request for Proposal (RFP). Source Selection Procedures as identified in FAR PART

12.206 will be utilized in the selection of a firm offering the best value to the Government in terms of price and technical merit and whose performance is expected to best meet stated Government requirements. Accordingly, award will be made using best-value procedures incorporating tradeoffs between price-related and non-price related factors. Upon receipt and evaluation of all proposals, a formal selection of a firm will be made that offers the greatest value to the Government based on a combination of technical evaluation and price factors.

Failure of offerors to submit a technical offer will preclude further participation on this acquisition.

Award may be made without discussions. The technical evaluation factor for the evaluation process is Technical Capability, demonstrated through product literature or other references.

Pursuant to FAR 52.215-1 Instructions to Offerors-Competitive Acquisition, the Government intends to evaluate proposals and award a contract without discussions with offerors. Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

Solicitation Provisions and Contract Clauses for Commercial Item Contracts

Instructions

1. Definition of a Commercial Item. See FAR 2.101 for the definition of a commercial item.

It is a rather lengthy definition; the core of it, however, is that a commercial item is:

“Any item, other than real property, that is of a type customarily used by the general public or by non-governmental entities for purposes other than governmental purposes, and ---

(i) Has been sold, leased or licensed to the general public; or

(ii) Has been offered for sale, lease or license to the general public”

The exclusion of “real property” from the definition of a commercial item currently excludes construction from being considered commercial.

2. Applicable FAR Guidance. FAR Part 12 contains basic guidance regarding commercial item acquisition.

3. Contract Form. Standard Form (SF) 1449 is used for solicitations and contracts for commercial items.

4. Clauses and Solicitation Provisions incorporated by reference:

(i) FAR 52.212-1 Instructions to Offerors --- Commercial Items This solicitation provision provides a single, streamlined set of instructions to be used for soliciting offers for commercial items. Should the contractor later request a full text version, it can be xeroxed from the FAR. Note that FAR 52.212-1, among other things, requires the submission of the contractor’s DUNS number with his offer, and requires contractors to register in the CCR.

(ii) FAR 52.212-4 Contract Terms and Conditions – Commercial Items This contract clause includes terms and conditions which are, to the maximum extent practicable, consistent with customary commercial practices. Should the contractor later request a full text version, it can be copied from the FAR.

5. The Contracting Officer incorporates these clauses by attaching this document (excluding these Instructions) as an Addendum to the SF 1449.

(i) FAR 52.212-2 Evaluation --- Commercial Items (Oct 2014)

This solicitation provision is to be used when evaluation factors are included in the solicitation for Commercial Items.

(ii) FAR 52.212-3 Offeror Representations and Certifications – Commercial Items (Jan 2017) The offeror completes this provision. Note that if the contract is for services exempt from the Service Contract Act, the Contracting Officer will check off the appropriate box in paragraph

(k) so that contractors know which part of the paragraph (k) certification applies to them.

Nevertheless, if the offeror maintains his reps & certs on at https://www.acquisition.gov, he can skip paragraphs (c) through (n) and need only complete paragraph (b) of FAR 52.212-3.

NOTE: If you are contracting for major disaster or emergency assistance activities under a Presidential declaration, and you determine that you will set-aside the procurement for concerns residing or doing business primarily within an area or areas affected by the emergency declaration, add the certification at FAR 52.226-3 (Disaster or Emergency Area Representation).

This certification does not appear in ORCA. Be sure to insert the appropriate geographic area in paragraph (a) of the certification. See FAR Subparts 6.6 and 26.2 for more guidance on this type of set-aside, conducted under the authority of the Robert T. Stafford Disaster Relief and Emergency Assistance Act.

(iii) FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders – Commercial Items This clause includes a broad list of other FAR clauses that can be incorporated by reference.

(iv) GSAM 552.212-71 Contract Terms and Conditions Applicable to GSA Acquisition of Commercial Items This clause includes a shorter list of GSAM clauses that can be incorporated by reference.

(v) GSAM 552.212-72 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to GSA Acquisition of Commercial Items.

6. Additional clauses and provisions: The Contracting Officer may include other FAR provisions/clauses when necessary, by incorporating them into the attached Addendum. For example:

a. IDIQ Contracts: A commercial item IDIQ contract should contain additional clauses, as prescribed by FAR 16.506.

b. Options: A commercial item contract that includes Options should contain additional clauses, as prescribed by FAR 17.208. Note that if FAR 52.212-2 (Evaluation --- Commercial Items) is used, it already contains language relative to the evaluation of options.

SOLICITATION PROVISIONS

1. FAR 52.212-2 EVALUATION --- COMMERCIAL ITEMS (Oct 2014)

(ii) price;

Technical capability is approximately equal in importance to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The offeror must:

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing.
