About this file
This document is a justification for a sole source award of a master indefinite delivery/indefinite quantity contract for refuse removal and recycling services at national cemeteries in the Midwest District. The National Cemetery Administration intends to award CHP Solutions LLC a contract with a value of $5 million over a five-year base period and four one-year options. CHP is the incumbent provider and has performed these services satisfactorily at several cemeteries. Individual task orders will be issued against the IDIQ as needed by each cemetery. The justification cites the statutory authority to award sole source contracts to service-disabled veteran-owned small businesses. Market research confirmed no other qualified vendors.

National Cemetery Administration Midwest District
Justification and Approval For Other Than Full and Open Competition
1. Identification of Agency and Contracting Activity Department of Veterans Affairs National Cemetery Administration (NCA) Master IDIQ for the Midwest National Cemeteries
2. Nature/Description of Action NCA intends to negotiate/award a Sole Source acquisition with CHP Solutions LLC (CHP), DUNS 968114566, under the authority of Federal Acquisition Regulation 6.302-5 Authorized or Required By Statute and VAAR 819.7007 (b) and (c).
3. Description of Supplies/Services A description of the supplies or services required to meet the agency's need (including the estimated value): Provide refuse removal and recycling services to the national cemeteries located within the Midwest District under a Master IDIQ award at an estimated cost of $5,000,000.00 for a performance period of Base plus four (4) one year options, if exercised. Each cemetery will submit a separate PR and a Task Order will be issued for services and obligation of funds.
4. Identification of Statutory Authority
The statutory authority permitting other than full and open competition is 15 U.S.C. 657f, Sole Source Awards Under the Veterans Benefits Act of 2003. This authority is implemented by FAR 6.302-5(b)(6), which permits the Contracting Officer to solicit on a sole source basis to Service Disabled Veteran Owned Small Businesses without providing for full and open competition when it is determined the contractor is a responsible and reliable source and the item and/or service will be procured at a fair and reasonable price.
VAAR 819.7007, (b) & (c), for Sole source awards to service-disabled Veteran-owned small business concern.
5. Description of contractor and or of acquisition action that demonstrates that the proposed contractor’s unique qualification or the nature of the acquisition requires use of the authority cited:
CHP is currently providing refuse removal and recycling services to several cemeteries across the NCA. They are performing the service at the sites at an exceptional level and the Master IDIQ will bring the District together working from one standardized Statement of Work. CHP has demonstrated their professionalism in similar work performed at cemetery sites across the NCA.
6. Efforts made to ensure that offers are solicited from as many potential sources as practical. A notice will not be posted in the Federal Business Opportunity website of the resulting award action.
Not Applicable
7. Determination of a Fair and Reasonable The contracting officer has previous historical contract pricing from past contract awards that will assist in determining the price to be fair and reasonable for this type of service.
8. Description of market survey and any interested sources. If no market survey was conducted, state the reason.
In the process of determining whether to solicit the services district wide via a Master IDIQ or to continue with several standalone contracts at each cemetery, I did market research by reviewing the VIP, the Dynamic Small Business Search and the SAM Registration of CHP.
FAR Subpart 6.302-2 (a) & (b) (2) and VAAR 819.7007 (b) & (c), allows the Contracting Officer to directly contract/sole source award with a verified VIP SDVOSB for purposes of meeting the Secretary’s goals to establish participation in Department contracts by small business concerns owned and controlled by veterans with service-connected disabilities.
9. Additional Support for the use of other than full and open competition:
10. Sources expressing interest:
11. Actions, if any, being taken to remove barriers to full and open competition:
12. Contracting Officer certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
I hereby certify that this request for Justification and Approval of other than Full and Open competition is made in good faith, that the supporting data and information is accurate and complete to the best of my knowledge and belief. I further certify that this request is not the result of lack of planning or desire to expend funds while those funds are still available.
The Contracting Officer has determined that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief.
