CONTINUATION PAGE

Comment 1: Subsurface/latent conditions and waste profiling are not formally addressed in the Requirements and Scope portion of Section B, Solicitation document 001. Therefore, we respectfully submit for your consideration the following suggested verbiage additions that would address this need:

Government shall provide full and complete information regarding its requirements for the Services. Government shall furnish complete information regarding the work site, surface and subsurface conditions, access, utility locations, site boundaries, and other reports, documents or information that may be reasonably requested by Contractor. Government shall communicate to Contractor all special hazards or risks known to the Government that are related to the performance of the Services pursuant to this Agreement.

Government shall provide Waste Profiles to Contractor for any work performed and Government warrants that the description of the waste materials on the Waste Profile is accurate and complete; that waste materials to be transferred to Contractor will conform to such description; that containers of waste materials transferred to Contractor will be marked, labeled and otherwise conform with all applicable federal, state and local laws, regulations, by-laws or ordinances; that it holds clear title to all waste materials to be transferred hereunder; that it is under no legal restraint or order which would prohibit transfer of possession or title to such materials to Contractor for transportation and disposal; and that it has communicated and will communicate to Contractor during the term hereof those hazards known by the Government to be associated with the handling, transportation, treatment, storage and disposal of the waste materials.

Answer 1: We do not accept the substitute language on subsurface and latent conditions provided by the respondent in the first “Government” paragraph of comment 1. With respect to subsurface/latent conditions, the VA is not incorporating your suggested verbiage additions.

The language is overly broad and prescriptive. While the Government does intend to provide access to existing site safety information to the bidders, the scope requested goes beyond reasonable expectations. The bidder is required to prepare a detailed site safety plan including standard operating procedures that will be followed during hazardous waste management activities. These conditions are given in items j on page 12 of 71 and item m on page 13 of 71 in the addressed in the Section B, Requirements and Scope portion of the Solicitation.

a) Provide a detailed site safety plan that will be used to ensure that workers and nearby population will be adequately protected during packaging and removal operations.

b) Provide a plan describing Standard Operating Procedures (SOPs) that will be followed while conducting normal hazardous waste management activities. The contractor shall describe site safety and contingency procedures (e.g. spill management We do not accept the substitute language on waste profiles recommended by the respondent in the second “Government “paragraph of comment 1. With respect to waste profiling, the VA is not incorporating your suggested verbiage additions.

This is contrary to the language given in the bid solicitation. The issue of waste profiling is formally addressed in Section B, the Requirements and Scope portion of the Solicitation. The Hazardous waste solicitation Statement of Work specifically requires the Contractor perform all waste characterization (waste profiles) as part of the contract. See the language from page 8 of 71, item E sub a. of the solicitation included below:

A. Technical expertise to categorize and profile waste and advise on federal, state, municipal and local regulatory compliance.

a. The Contractor is required to perform characterization of all waste streams identified by each facility using process knowledge, identity of the chemicals, and other types of chemical analysis including but not limited to Toxicity Characteristic Leaching Procedure (TCLP). Chemical wastes shall include but not be limited to flammables, corrosives, poisons/toxics/lethal, reactive wastes, dual and hazardous waste, and universal waste. Work shall be performed in accordance with all applicable, Federal, State, Local and all governing regulations. Work areas will be cleaned by the contractor at the end of each day.

2. The following questions are in regards to the Rate Schedule spreadsheet (36C26319Q0516-002):

a. The Solicitation states that each and every line item in the Rate Schedule must be priced. Section A item 54 is described as “Miscellaneous hazardous waste, unknown at this time, case-by-case basis” and lists Quantity as 100 lbs. “Case-by-case” implies this line item will be quoted as needed for unique circumstances. Plus, without knowing what the waste stream will be, it is impossible to quote a disposal rate. Please confirm it is acceptable for Offerors to leave item 54 blank.

Answer: We confirm that it is acceptable to leave item 54 blank in the solicitation response.

b. Section B items 17 and 19 both require Offerors to quote a single rate that applies to both poly and metal drums. Poly drums cost substantially more than metal drums. Would you consider splitting items 17 and 19 so the Government can benefit from a lower price for metal drums instead of always paying the higher poly drum rate?

Answer: We agree it is acceptable for the responder split both items 17 and 19 into an a. and b. option to reflect the price differences for supplying metal or poly drums for disposal, as appropriate to the material being removed.

3. The remaining questions are specific to Section C of the Rate Schedule spreadsheet (36C26319Q0516-002):

0. The description for Item 3 is “High Hazard Project Equipment, as needed, which can include”. Did you intend for Offerors to quote a rate per job day for Item 3 and for sub-Items a through e (which is how the spreadsheet is currently set up)? Or should this be a single rate for Item 3 that includes sub-items a through e at no additional charge?

Answer: We agree it is acceptable to offer a single lump sum day rate for item 3 rather than providing individual costs for the subitems a. through e.

0. A Remote Opening is a service performed, not a piece of equipment. Instead of bullet f to Item 3, should it be Item 4 and High Hazard Mobilization be Item 5?

Answer: We agree it is acceptable to delete item 3f, item 4 should be the remote opening charge. Item 5 should be the High Hazard mobilization charge.

0. It appears the unit of measure for Remote Opening Charge is on the incorrect line, which has caused the unit of measure space for High Hazard Mobilization to be empty. Please confirm the correct unit of measure for Remote Opening Charge is “Item” and the unit of measure for High Hazard Mobilization should be “Job Day.”

Answer: We agree that the Remote Opening Charge is on the incorrect line. The correct measure for Remote Opening is “Item” and the unit of measure for High hazard Mobilization should be “job day”
