Solicitation Questions and Answers

Administrative Medical Support Assistant (MSA) Staffing

1. Reference PWS Section 1.5. Contractor/shall maintain a pool of staffing that has security clearance to work for the VA to provide on-call/as-needed staffing. The duration of employment will be determined as needed.

Could the government explain on-call/as needed and when would the government request additional personnel?

· Clinics experience staffing fluctuations and therefore, temporary Medical Support Assistant staffing services are needed to supplement the staffing gaps. That’s why services are as needed. The Contracting Officer’s Representative (COR) will request the Contractor to provide additional staff when needed.

2. Can the government provide historical data to show the average hours and the number of Full-time employees (FTEs) and/or Part-time employee (PTEs) needed per location?

· The Price/Cost Schedule reflects the Government’s current bona fide need.

3. Reference PWS Section 2.8. Key Personnel and Temporary Emergency Substitutions: The Contractor shall assign to this contract the following key personnel (all personnel working on this contract must have Contracting Officer (CO) approval once a clearance submittal by a contract employee has been successfully accepted by the and access granted by the CO):

Who are the Key Personnel?

· The key personnel refer to the contractor’s Medical Support Assistant employees who are providing services on this contract.

4. Would the government explain if the Lead MSA would be located at the facility or located as needed to other locations?

· Lead MSAs are VA employees who are located at the facility.

5. Will the employees be allowed to work on the contract pending obtaining clearances?

· No. Contract employees cannot provide services until they receive security clearance.

6. Are health examinations/clearances required prior to working on the contract?

· Yes.

7. Reference PWS Section 5.1 and 5.2.

5.1 Complete annual mandatory training by using the mandatory packet, attending training in person, or by going-on-line to complete the training. Complete mandatory security training, sign computer security agreement, receive training on the mandatory private policy, and receive copy of the Privacy Directive, VA Directive 6504, Restrictions on Transmission, Transportation and Use of, and Access to VA Data Outside VA Facilities. The Compliance and Business Integrity Training & Education—Contract (Revenue Cycle) Employees includes the following training:.

5.2 . TMS Courses Will the Government sponsor these trainings?

· For annual mandatory training and TMS courses, the Government will provide these trainings.

8. For Technical Proficiency, would the Government provide the testing platform for ongoing testing for MSAs?

· In reference to PWS section 3.7 Technical Proficiency, the Contractor is responsible for ensuring their proposed candidates/employees meet the minimum technical proficiency.

9. Reference PWS Section 5.6. All MSA staff, with scheduling access, will have mandatory scheduling training provided by the government. This requirement could be up to two weeks of training.

Since employees will be required to be compensated, will this training be billable?

· Mandatory trainings for the Medical Support Assistant (MSA) position are completed during the contractor personnel’s scheduled tour of duty. Since mandatory trainings must be completed during scheduled work hours, the vendor can invoice for these hours as services rendered because it’s part of their scheduled tour of duty. Please note that non-mandatory or voluntary training (like skill set improvement trainings) completed outside working hours cannot be invoiced as these are optional.

10. Reference PWS Section 13.4. Health Tests – Contractor attests that assigned personnel have fulfilled all testing and screening requirements as described below prior to providing services at first duty shift. Evaluations and tests shall be current within the past year.

Will the Government pay for these health-related tests?

· No.

11. Should the Quality Assurance Surveillance Plan (QASP) be submitted as an attachment?

· The QASP is part of the Technical Quote. Please carefully read the ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES.

12. Will commercial past performance be considered equally as government past performance?

· For past performance, the Government will review performance data available on Contractor Performance Assessment Reporting System (CPARS). Vendors who do not have CPARS past performance will be provided with a neutral rating.

13. Commercial past performance is not completed in any government rating system. Will written/verbal references from our commercial customers be on equal par as government past performance?

· For past performance, the Government will review performance data available on Contractor Performance Assessment Reporting System (CPARS). Vendors who do not have CPARS past performance will be provided with a neutral rating.

14. Is the government satisfied with the current incumbent?

· Vendors would need to file a Freedom of Information Act request for this information.

15. My company is fairly new to contracting; In lieu of past performance can I provide my resume and a list of references that can speak to my ability to manage a contract of this magnitude and nature?

· For past performance, the Government will review performance data available on Contractor Performance Assessment Reporting System (CPARS). Vendors who do not have CPARS past performance will be provided with a neutral rating.

16. What type of medical administrative staff are you looking for?

· The requirement is for administrative Medical Support Assistant staff.

17. If this contract is being performed by an incumbent, has the contract SOW changed since the last contract?

· There were minor clarification changes to the performance work statement for this follow-on requirement.

18. If this work is being performed by an incumbent, will the government provide start dates for current personnel supporting the project so contractors can properly quote the pricing and consider PTO accruals?

· Services are to be provided from January 1, 2023 – December 31, 2026. The price schedule contains the period of performances for each ordering period.

19. If this contract is being performed by an incumbent, will the government consider removing the requirement for candidate resumes as this gives a clear advantage to the incumbent contractor?

· No. Candidate resumes provide vendors with the opportunity to demonstrate their abilities to find qualified candidates.

20. With this contract being under DOL SCA guidelines, any incumbent employees will have the first right of refusal to maintain their current role?

· On November 18, 2021, President Joseph R. Biden signed Executive Order 14055 “Nondisplacement of Qualified Workers Under Service Contracts” to promote economy and efficiency in procurement. It requires federal contractors and subcontractors on a covered successor contract to offer jobs to qualified employees employed under the predecessor contract. Among many benefits, the Executive Order promotes retention of skilled workers, preventing disruptions in federal services.

21. Will the awardee be able to transition incumbents to provide services on this contract or is this going to be used as a back-up contract to support the current contract that is in place?

· See Question 20.

22. Is the incumbent eligible to bid on this requirement?

· Yes.

23. Can you confirm if this contract includes EO13706?

· Yes.

24. Will the government correct the CLIN structure hours to align with the 1920 expected billable hours rather than 2080 billable hours? Given the DOL mandated PTO and Holidays no one FTE will be able to work 2080 hours. Requiring contractors to submit a quote for 2080 hours causes a higher estimated cost and an overallocation of funds to the contract.

· Per your request, the price schedule has been revised to account for 1920 hours per FTE. Note that these hours are estimates and may fluctuate over the contract period.

25. Does the government expect OT on this contract? If so, will the government please add a CLIN for OT for each location?

· The Government does not expect overtime on this contract.

26. Will the government please provide the DOL Occupational Code & Title that should be used for this requirement?

· 12100 Medical Assistant

27. Will the government provide a 1-week extension to allow contractors time to review the Q&A and implement any changes into their quote?

· Yes. See SF30 for Amendment 0002 for the new due date/time.

28. Resumes: For the 16 resumes required to submit with the proposal, given that our firm has not won the contract yet, are the names and resumes submitted subject to change as we can only speculate which employees we'd like to use to fill the requirement until we have a concrete contract in place?

· The Government understands that the proposed candidates may change upon award of the contract. However, the Government expects the same quality of candidates to be submitted at the time of award.

29. Are there incumbent staff currently providing services? If so, how many and how long have they been in place?

· Yes. There are currently 19 contract personnel providing services and the length of service varies per contract personnel.

30. How many vacancies exist?

· The program office confirmed there are no vacancies at this time.

31. What is the maximum file size that can be accepted for submission? Can the offeror submit the offer in separate emails?

· According to Microsoft Outlook, the combined file size limit is 20 megabytes.

· Yes, the offeror can submit the quote in separate emails. Note that all emails must be received by the due date and time of the solicitation.

32. Can the proposal be submitted in an email with separate PDFs for each part, or must it be submitted in one document?

· Please submit the quote in two parts – Part 1 Price and Part 2 Technical.

33. What is the estimated total value allocated for this contract?

· Per B.2 Price/Cost Schedule, the maximum aggregate value of orders that can be placed under this contract is $6,900,000. The Government does not guarantee that it will place any orders under this contract in excess of the guaranteed minimum award amount.

34. What is the Start date and Award date for this contract?

· The start date of the contract is January 1, 2023.

· The award date is tentative.

35. Is it mandatory to have medical liability insurance or it can be waived off?

· The medical liability insurance is required. Please review C.7 Supplemental Insurance Requirements.

36. According to Solicitation 36C26123Q00171, under “E.8 VAAR 852.273-73 EVALUATION - HEALTH-CARE RESOURCES” in which refers to point 4 4. Past Performance, the statement says “Vendors who do not have CPARS past performance will be provided with a neutral rating.” Can you specify what will be the neutral rating?

· In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance. Thus, a neutral rating is neither favorable nor unfavorable.

37. The 1449 states that the Request for Quote is for “temporary Administrative Medical Support Assistant (MSA) staffing services on an as-needed basis.” What is the nature of the “temporary position status” in terms of timeframe, position location, position status, etc.?

· The program office views contract staff as temporary because they are not permanent VA employees. The timeframe for services varies for each clinic because it depends on the hiring and turnover of VA employees. The price schedule provides an estimate number of hours each year. Please note that these hours are estimates and can fluctuate over the lifetime of the contract. The position location is based on each clinic’s need; therefore, the Contracting Officer’s Representative will work with the contractor on the number of contract staff needed per location over the lifetime of the contract.

B.2 PRICE/COST SCHEDULE

Note: Indefinite Delivery, Indefinite Quantity Contract is being used because it is impossible to determine the exact quantities in any given year.

The guaranteed minimum award amount for this contract is $1,000. The maximum aggregate value of orders that can be placed under this contract is $6,900,000. The Government does not guarantee that it will place any orders under this contract in excess of the guaranteed minimum award amount.
